Dear Jimmy L. McLamb:
We received your application for an NPDES discharge permit on August 22,2022.On May 22, 2023,
Brian Lambe with the Wilmington Regional Office conducted a site visit to determine whether the
facility was compliant with coverage under Stormwater General Permit NCG020000.
The Operation and Maintenance Plan provided is inadequate for observed mining activities.Staff
noticed the dewatering basin is insufficient when compared to the installed pump.Land just below
the basin is erosive and there is sediment deposited in a constructed channel leading to a ditch.
DEMLR Staff cannot grant coverage under NCG020000 at this time.Additionally,Stormwater Staff
found inconsistencies in the submitted NCGO20000 application.Section 6,Wastewater Treatment
was left blank even though you checked"Yes" for the presence of mine dewatering.
With this letter,your application is being returned to you. Please make modifications of the 0&M
Plan and dewatering methods to your mining permit and reapply for coverage under NCG020000.
