On October 30, 2007, the 401 Oversight/Express Permitting Unit of the Division of Water Quality received your
letter regarding a project known as "Lot 12, Southerby's Subdivision". The following conditions must be met:
1. The planting plan (submitted on June 15, 2007) must be implemented prior to closing on the property. We
recommend that tree irrigation bags be installed around planted trees to improve success. rate.
2. A deed restriction (as opposed to the deed notification that was a condition of your buffer variance),
specifying the requirement of replanting any of the planting plan shrubs and trees that die within the next 5
years, is required. Please provide a copy of the deed restriction to our office (to the attention of Lia Myott)
immediately after planting and prior to closing on the property.
