Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000 - 1062 rules. We are forwarding ATC Permit No. SWA000204, dated May 19, 2023, for the construction of the subject project and the stormwater system. This permit shall be effective from the date of issuance and shall be subject to the conditions and limitations as specified therein, and does not supersede any other agency permits that may be required. The original signed permit package and plans are being mailed to the permittee, David Cuthbertson, at the following address (NOTE: An electronic version of this permit can be found in our online repository: https://edocs.deq.nc.gov/WaterResources/Browse.aspx?id=494276&dbid=0&repo=WaterResources): Dependable Development, Inc. Reviews under the Fast-Track permitting process can take up to 30 calendar days to complete. You can see where this project stands in the review queue by emailing me (I have an autoreply set up that has the review queue on it). Please upload all documents that you mailed into our office through the link provided below. Be sure to choose the Central Office as the Primary Contact office. https://edocs.deq.nc.gov/Forms/SW-Supplemental-Upload IMPORTANT NOTE: Please ensure that each file is uploaded under its appropriate file type. Additional file types can be entered into the electronic form by clicking on the “Add Another Post-Construction File Upload” link directly below the “State Stormwater Information Uploads” section of the form. YOU MUST CLICK ON THE “ADD ANOTHER POST- CONSTRUCTION FILE UPLOAD” TO ADD ADDITIONAL FILE TYPES TO THE SUBMISSION. Merely changing the file type dropdown as you upload the various files (without adding additional file uploads) will upload all of the files as the last file type selected, the submission will get flagged during review, and you will need to resubmit the files. Please do not upload entire plan sets through this form, but rather upload the relevant individual sheets under the appropriate file type. Selecting the correct file type ensures that the files are properly named in the electronic repository and it helps expedite the review process. NOTE: We do not require and we discourage the upload/submission of extraneous plan sheets (such as lighting plans, utility plans, striping plans, sight distance plans, etc…) as these files are not needed for review. At this time, the submission is not administratively complete and cannot be accepted for review in its current condition. Please provide the following submittal items by close of business on 4/29/2023 so that we may accept the project and begin the review process, otherwise, the project will be returned as administratively incomplete.  2x hard copies of the Application Form (or pages) with the following corrections made (A complete application is required per 15A NCAC 02H .1043(3)(a)):  Parts G & I – Please provide 2x original signed and notarized/sealed hard copies of Parts G & I of the Application. 2x original signed hard copies of this form are required (the provided signatures appear to be photocopies). NOTE: This is an administrative completeness review, not a detailed engineering review, there may be other issues that may be brought up during the engineering review. If these items are received within the stipulated timeframe, we can accept the project and begin the review process. Once accepted, reviews under the Fast-Track permitting process can take up to 30 calendar days per statute (one of our two reviewer positions is currently vacant). At this time, the submission is not administratively complete and cannot be accepted for review in its current condition. Please provide the following submittal items by close of business on 4/29/2023 so that we may accept the project and begin the review process, otherwise, the project will be returned as administratively incomplete.  Per Union County property records, Lots 130, 131, 133, & 134 are owned by True Homes, LLC (sale dates early 2023). Since the project area is partially owned by Dependable Development, Inc and partly owned by True Homes, LLC, please list True Homes, LLC as a property owner in Part D4 of the Application, have them sign Part I of the Application, and provide official documentation showing the title and position of the signing official for the True Homes, LLC and showing that True Homes, LLC is in good standing with the Secretary of State. If one company is a subsidiary (or other similar legal arrangement) of the other, please let me know as this would impact how to address this comment.  2x hard copies of the Application Form (or pages) with the following corrections made (A complete application is required per 15A NCAC 02H .1043(3)(a)):  Part B5 – The provided project coordinates (35°00’14.40”N, 92°30’37.44”W) correspond to a point in Arkansas. Please revise the coordinates to reflect the project location.  Part E5 – The project density does not appear to be calculated correctly. %BUA is calculated as \[Proposed New BUA\] / \[Total Project Area\]. Per the provided information (Proposed New BUA = 702,622.8 sf & Total Project Area = 3,054,248.4 sf), the %BUA would be about 23% (23.22% is shown). Please revise as needed.  2x hard copies of a plan sheet with the following corrections made:  Wetland delineation or a note on the plans stating that there are no wetlands located on-site. This item is required per 15A NCAC 02H .1043(3)(f) and Part F4 of the Application. Please also list the name of the individual that made this determination in a note on the plans. NOTE: This is an administrative completeness review, not a detailed engineering review, there may be other issues that may be brought up during the engineering review. While not required for administrative completeness, the following items were noted: - Lots 130-134 do not drain to and are not treated by an SCM. Please ensure that the project meets the requirements of Runoff Treatment (15A NCAC 02H .1002(43)) or some other method of treatment is provided. 4 th NOTE: The Standard Application for this project received by our office on March 20, 2023 is being returned as a project can only be accepted into one review queue/permitting path. The submittal items associated with the Standard Application (and not needed for the Fast-Track ATC Application) will be returned to the Applicant. If you would like the items returned to a different address/individual, please let me know by close of business Friday, 4/7/2023. If these items are received within the stipulated timeframe, we can accept the project and begin the review process.
