A. Site May and Features: According to documents in the Orange County Register of Deeds, the parcel
(Parcel ID: 9970-84-9650) originally associated with Permit No. WQ0022017 (9517 Walnut Grove
Church Rd. SFR 91) was subdivided on July 21, 2022. "Lot 1" (Parcel ID: 9970-84-9582) contains
the proposed site of Permit No. WQ0022021 (9517 Walnut Grove Church Rd. SFR 92), according to
its existing permit. "Lot 2" (Parcel ID: 9970-95-0146) is the proposed site of Permit No.
WQ0022017, according to its existing permit. "Lot 3" (Parcel ID: 9970-83-891) is located along the
southern edge of the original parcel and does not contain an associated non -discharge wastewater
permit.
The final site map provided during the 2017 renewal process(es) of these permits depicted a different
proposed property subdivision line between Lots 1 and 2 than what is registered with Orange County
(Plat Book 125 / Page 65) and did not show the proposed subdivision line between Lots 1 and 3. The
final site map also did not depict any of the seven existing shed structures on the property, though a
previous version of the map did.
Please provide an updated site map with the following clearly labeled: the correct property
subdivision lines; revised setbacks from the correct property lines to the proposed treatment/storage
units and fields; all existing and proposed structures on the property; setbacks from said structures to
the proposed treatment/storage units and fields; any surface waters or surface water diversions and
their setbacks; water lines and wells and their setbacks; and any other applicable features subject to
setbacks as noted below in Item C. [15A NCAC 02T .0105(d), 02T .0604(d)]
B. Associated Permits: Permit No. WQ0022021 expired May 31, 2022, and is also in need of renewal.
Please have Danny E. Blackburn and Patricia R. Blackburn submit a renewal request for that permit.
No response is required for this comment.
C. Setback Waivers, Easements, and Access Aereements: Lot 1 is owned by Danny E. Blackburn and
Patricia R. Blackburn. Lot 2 is owned by Danny E. Blackburn, II and Steven A. Johnson. Lot 3 is
owned by Christy B. Davis and Bobby L. Davis, Jr.
As noted in the cover letter of Permit No. WQ0022017, issued June 16, 2017, "subdividing the
property may [... ] require the completion, notarization, and registration of setback waivers." Please
obtain and provide copies of all setback waivers necessary to account for reduced setbacks. For
reference, please see the list of setback requirements on pages 3 and 4. [15A NCAC 02H .0219(i)(5)]
D. Permit Modification: Lot 2 was transferred from Danny E. Blackburn and Patricia R. Blackburn to
Danny E. Blackburn, II and Steven A. Johnson on September 2, 2022 (Deed Book 6796 / Pages 1305
—1306). Per Conditions IL7. and IL9. of Permit No. WQ0022017, the compliance boundary is
established at the property boundary, and the Permittee shall apply for a permit modification to
establish a new compliance boundary prior to the sale or transfer of property affecting a compliance
boundary. If the compliance boundary has changed since the previous permit issuance, please submit
a modification request. Note that modifying the permit may change the setback requirements to match
