NORTH CAROLINA Director Environmental Quality June 7, 2023 Kevin Yates DWR Project #: 2022-1493vl Clearwater Mitigation Solutions, LLC Guilford County (via electronic mail: thamrick cgecomitigation.com ) Re: EMH Farm Mitigation Banking Instrument (MBI) EMH Farm Bank Parcel Credit Release — Task I & Task 2(partial) Dear Mr. Yates, On April 21, 2023, the Division of Water Resources (DWR) approved a Bank Parcel Development Package (BPDP) submitted by Clearwater Mitigation Solutions, LLC (CMS) for the above - referenced site under the terms and conditions of the EMH Farm Mitigation Banking Instrument (MBI) to establish a buffer mitigation bank. On June 6, 2023, the DWR received a recorded conservation easement and corresponding plat for the subject site. On May 18, 2023, the Division of Water Resources (DWR) received documentation from CMS that the EMH Farm site had been planted and constructed in its entirety and monitoring plots had been installed. On June 5, 2023, Blake Hartshorn and Katie Merritt with DWR, with assistance from staff with CMS inspected the site and confirmed that the subject site had been mostly adequately planted and seeded and that all monitoring plots were installed. Additionally, the conservation easement boundary for the site had been adequately marked. In response to concerns noted on the site with regards to dense herbaceous vegetation, areas marked as potentially low in stem density and areas marked as void in adequate stems, DWR is requiring CMS to develop an Adaptive Management Plan (AMP) and submit the AMP with the As -Built Report. DWR will review the AMP as part of the As - Built report review process and future credit releases will be contingent on the submittal, approval and implementation of the AMP. Due to the minor nature of the issues observed during the site visit, DWR will issue 18.5% of the 20% credit release for Task 2, with the remaining 2.5% to be issued upon full implementation of the proposed AMP. The AMP should address the following: • a small area within the outer easement boundary (see map) needed additional trees. This area could benefit from at least 1, maybe 2 rows of trees. No sycamores can be used in this supplemental planting area due to the existing high percentage of planted sycamores across the site. • Transects need to be taken within the areas identified on the attached map as being difficult to discern evidence of planted stems.
