Wastewater Sutrface Irrigation System Permit No. WQ0015010 County - Sampson Dear Mr. Niemond: You are hereby notified that, having been issued .a permit for spray irrigation operations for the subject facility, TDM Farms Inc., was found to be in violation of the following permit conditions. Violation 1: Failure to meet installation deadline for monitoring well "MW-1" Section I(1), Permit Number WQ0015010. ) During a routien compliance inspection conducted on Noverber 17, 2016,.it was noted that monitoring well "MW-1" had not`been installed. Installation of "MW-1" was required to be complete prior to January 31, 2016, Section I(1) of Permit NI Q0015010. - J Suggested Corrective action for Violation 1: 1. Install "MW-1"as soon as possible. 2. Inform the Fayetteville Regional Office when drilling of the monitoring well has commenced and again upon completion of the monitoring well installation, to allow for a site visit from regional office staff. Violation 2: Failure to meet the sampling frequency of the required parameters listed in Attachment "C" for Permit Number WQ0015010. During a routine compliance inspection conducted on November 17, 2016, it was noted that all required sample parameters of Attachment "C" had been missed for 2016. -`">—Nothing Compares':--,. Upon completion of installation of "MW-1 ", take an initial sample for all required parameters listed in Attachment "C".. 2. Establish a sampling schedule as listed in Attachment "C" of Permit WQ0015010. You are required to take any necessary action to immediately correct the above violationsi .and to provide a written response to this Notice by February 25, 2017. Please include in your r response, a plan of actions to include a time line for the monitoring well installation. Please be advised that this Notice of Violation does not prevent the Division of Water Resources from taking enforcement actions for this violation or any past or future violation. Neither does this notice remove you from the responsibility or liability for failure to comply with any State Rule, State Statue or permitting requirement. Furthermore, the Division of Water Resources has the authority to levy a civil penalty of not more than $25,000.00 per day per violation. On 1/9/17 Jim Barber and Kent White visited the site and identified the location for the monitoring well. On 1/19/17 the well was inst z Iled by Cannady Brothers Well Drilling of Clinton. On 2/1/17 initial well sampling was done by Kent White and Tony Honeycutt of the Fayetteville office along with me. The samples were split and I delivered the samples to Pace Analytics in Raleigh. Kent sent the other half to the DWR labl. Additional samples will be analyzed for the required parameters listed in attachment "C" of Permit WQ00150010 and the sampling schedule will be followed.
