Rosewood Bank Parcel Credit Release — Task 2 (partial)
Dear Mr. Hutton,
On March 10, 2023, the Division of Water Resources (DWR) received documentation from
Wildlands Holdings III, LLC (Wildlands) that the Rosewood site had been planted and constructed in
its entirety and monitoring plots had been installed. On April 3, 2023, staff with DWR, with
assistance from staff with Wildlands, inspected the site and observed that the subject site had been
adequately planted in most areas, but identified areas lacking in planted stems. All monitoring plots
were installed, however, DWR staff had concerns with how the plots had been planted. The
conservation easement boundary for the site was marked, but DWR staff observed that easement
signs did not seem to line up the same way as depicted on the supporting figures Wildlands had
provided for the site visit. Lastly, it was observed that Wildlands did not seed the riparian restoration
areas; however, as noted in the approved Bank Parcel Development Package, "if herbaceous
vegetation does not appear to grow naturally, Wildlands will note the areas of deficiency and seed
them in Spring of 2023 ".
On May 17, 2023, DWR staff provided a summary to Wildlands of the concerns and observations
made on site. On June 5, 2023, Wildlands submitted a satisfactory and acceptable response to the
concerns noted by DWR. Of the responses received, it was noted that Wildlands would be
implementing supplemental planting efforts in areas void of planted stems during Winter 2023/2024.
A proposed supplemental planting plan needs to be included in the As -Built Report with a
commitment to implement the supplemental planting prior to the submittal of the Year 1 Monitoring
Report.
DWR will only issue a partial credit release of 10% at this time. DWR will issue the remainder 10%
of this credit release upon receiving confirmation that Wildlands has fully implemented the
supplemental planting efforts required for the site. Photo documentation, supporting maps, figures
and a summary narrative will be required to be reviewed and approved by DWR prior to the issuance
of the remaining credit release.
DWR received a performance bond (#107652731) issued to Wildlands from Travelers Casualty and
Surety Company of America, in the amount of $150,000, to cover performance obligations for the
construction of the subject site. The term of this bond will remain in effect until DWR has provided
a written approval of the As -Built Report.

In accordance with the UMBI, signed on February 15, 2022, the following Project Milestones have
been partially met and the corresponding credits shall be released:

By copy of this correspondence, DWR confirms that you have partially satisfied the above
requirements for the above -referenced tract and the following credits are released:
• 10% of the Neuse buffer Restoration credits (0.10 x 717,568.750 ft2 = 71,756.875 ft2) are
now available to sell.
• 10% of the Nitrogen nutrient offset credits (0.10 x 57,914.395 lb-N = 5,791.440 lb-N) are
now available to sell.
Please note that nutrient offset credits generated at this site must be used for impacts in HUC
03020201 of the Neuse River Basin excluding the Falls Lake Watershed pursuant to 15A NCAC
02B .0703, which became effective on April 1, 2020. Additionally, the riparian buffer credits
must be used for impacts in the Neuse River Basin in accordance with guidelines in the
Consolidated Buffer Mitigation Rule, 15A NCAC 02B .0295, which became effective on
November 1, 2015.
