(Wildlands) has reviewed the Division of Water Resources (DWR) comments dated April 4, 2023, for the draft Nutrient Offset and Buffer Mitigation Plan (Buffer Plan) for the Twin Burros Mitigation Bank Parcel. Please note that the tree line data used in the draft Buffer Plan was based on aerial imagery. The final Buffer Plan has been updated using a GPS tree line survey. Credit totals have been adjusted accordingly. The DWR comments are listed below in bold, while Wildlands responses are noted in italics lettering. 1. Cover Page a. Change to Nutrient Offset & Buffer Mitigation Plan The correction has been made. b. Add the DWR ID# (2021-1425v1) The correction has been made. 2. Change BPDP here to Nutrient Offset & Buffer Mitigation Plan (or to Buffer Mitigation & Nutrient Offset Plan) whichever you prefer, but make the change consistent throughout the cover page and text. The correction has been made. b. It references the UMBI but only an MBI was proposed and the name of the MBI is called "Twin Burros" MBI, not Wildlands Cape Fear 02. General Comment —when using the term "Buffer", this only refers to the Zone land Zone 2 riparian zones adjacent to a subject stream. Since this site includes more than just the Jordan riparian "buffer", need to use "Riparian areas" to be all-inclusive. Edit accordingly throughout the text. Section 4.1- Add a specific reference to where the grading plan is located within the stream wetland plan. The following text has been added: "The specifics of the stream restoration project are in the Twin Burros Stream and Wetland Mitigation Plan. Section 6.7 of the Twin Burros Stream and Wetland Mitigation Plan contains information on grading." 7. Table 8- Add a column for "tree/shrub" and fill in fields accordingly. The addition has been made. 8. Table 9- Tag Alder is not an acceptable species for planting in areas generating RBC or NOC. If only being planted in wetland mitigation credit areas, then that is fine. Otherwise, remove from planting plan where RBC or NOC is being generated. Tag Alder has been removed from the planting plan. 9. Section 4.2- If at least 8 species will be planted, then Wildlands needs to identify which 8 of the 12 are their primary species and then select the remaining 4 that will be used as "substitutions" if any of the 8 primary species are not available. Additionally, Wildlands needs to include the % of those remaining 4 substitutions that may need to be utilized. Wildlands anticipates that planting less than 12 species will be unlikely. If a species is not available at the time of planting, the percentage composition of one or more of the available species will be increased to ensure the some number of trees required to meet the proposed density are planted. Wildlands proposes that any of the 12 species be viable for an increase in percent composition so long as there are at least 8 species planted. Wildlands will ensure that no one species is planted at a composition higher than 15%. Text has been added to section 4.2. 10. Section 7.0 a. The MBI refers to "Riparian Buffer Credit" and "Nutrient Offset Credit" or "RBC" and "NOC". Throughout this section, the credits are referred to inconsistently and as "buffer mitigation credit", "buffer credits" or "riparian buffer credit". Edit accordingly using the terms Riparian Buffer Credit" and "Nutrient Offset Credit as noted in the MBI template. The correction has been made throughout the text. b. Add a statement within this section that credits are determined based on existing riparian conditions (forested vs non -forested) adjacent to existing streams. In areas where riparian restoration for purposes of the Buffer Plan overlaps planting for the Twin Burros Stream and Wetland Mitigation Site, the some vegetation plot will be used for both monitoring reports. References to vegetation plots related to the Twin Burros Stream and Wetland Mitigation Site have been removed from Figure 9 for clarity. Plan HUC 03030002 Page ii June 2023 Nutrient Offset & Buffer Mitigation Plan Twin Burros Mitigation Bank Parcel Cape Fear River Basin Wildlands Holdings VI 1.0 Project Introduction The Twin Burros Mitigation Bank Parcel (Parcel) is proposed under the terms and conditions of the Twin Burros Mitigation Banking Instrument (MBI), proposed to be made and entered into by Wildlands Holdings VI, LLC acting as Bank Sponsor (Sponsor) and the North Carolina Department of Environmental Quality (NCDEQ) Division of Water Resources (NCDWR). The Parcel shall be planned and designed according to the MBI, 15A NCAC 0213.0703, and the Consolidated Buffer Mitigation Rule 15A NCAC 02B .0295. The Nutrient Offset and Buffer Mitigation Plan (Buffer Plan) has also been designed in concurrence with the Wildlands Cape Fear 02 Umbrella Mitigation Bank, Twin Burros Mitigation Site (SAW 2021-01308, DWR ID 2021-1425 V.1) The project is in Caswell County approximately four miles north of Pleasant Grove, North Carolina (Figure 1). Directions are included on Figure 1. The Parcel creates a protected riparian area from top of bank out to 200 feet along twelve unnamed tributaries (Maria Creek, Caballo Creek, Gallo Creek, Pollo Creek, Jesus Creek, Perro Creek, Burro Creek, Pinto Creek, JR Creek, Panchito Creek, Vaca Creek, and Martinez Creek). The primary purpose of the project is to provide riparian buffer mitigation credits and nutrient offset credits to compensate for unavoidable impacts in the Cape Fear River Basin 03030002 Hydrologic Unit Code (HUC), within the Haw River sub -watershed of the Jordan Lake Watershed (Figure 2). The Parcel is located within the Cape Fear River Basin HUC 03030002030040 and NCDWR Subbasin 03-06-02 in Caswell County. 1.1 Parcel Description The project features flow to Hughes Mill Creek, which is a tributary to Jordan Creek. Jordan Creek drains to Stoney Creek and eventually to the Haw River and Jordan Lake. Hughes Mill Creek is classified as Water Supply II (WS-II), High Quality Waters (HQW), and Nutrient Sensitive Waters (NSW). This riparian mitigation project will reduce sediment and nutrient loading, provide and improve terrestrial and instream habitats, and improve stream and bank stability. The Parcel is located on an active cattle farm and is currently occupied by areas of pasture grass and existing forest. See Appendix A for September 2022 current land use photographs. Restoring and enhancing the riparian area up to 200 feet from the streams will reduce nutrient and sediment inputs in the tributaries to Hughes Mill Creek, and subsequently to the Haw River and Jordan Lake. The restored floodplain areas will filter sediment during high rainfall events and provide cover and food for wildlife throughout the Parcel. Fencing out cattle will protect the riparian buffers from their impact and aid in the development of a functioning multi stratum forest. Preventing cattle access to streams will also further reduce sediment and nutrient inputs by improving stream bank stability. 2.0 Mitigation Project Summary 2.1 Project Goals The major goals of the proposed nutrient offset and buffer mitigation project are to provide ecological and water quality enhancements to the Cape Fear River Basin by restoring, enhancing, and preserving, WTwin Burros Mitigation Bank Parcel Nutrient Offset & Buffer Mitigation Plan HUC 03030002 Page 1 June 2023 the riparian area to create a functional riparian corridor. Specific enhancements to water quality and ecological processes are outlined below in Table 1. Permanently protect the project Parcel from A conservation easement will be recorded on the Parcel. harmful uses. 2.2 Existing Parcel Conditions The proposed buffer mitigation and nutrient offset project includes approximately 33.9 acres of livestock pasture and forest along twelve unnamed tributaries to Hughes Mill Creek. Livestock have access to all forested areas and project streams. The Parcel easement boundary will extend from top of bank to at least 30 feet along nearly all project streams and out to 200 feet where possible (Figure 3). There is a small area along Burro Creek, Jesus Creek, Maria Creek, and Vaca Creek where the easement boundary does not extend to 30 feet, no credit will be proposed in these areas (Figure 7). In general, project streams have a forested buffer that vary in width and are then surrounded by pasture grass. Maria Creek flows west; it originates from a pond off -site and is bordered by existing forest that varies in width from approximately 15 feet to 150 feet for its project length. Caballo Creek is an ephemeral channel that originates from a wetland and flows north then turns into an intermittent channel for 33 feet before joining Maria Creek. At its origin, Caballo Creek lacks a riparian buffer and is surrounded by pasture grass. It then possesses a narrow -forested buffer for most of its length that ranges from 10 feet to roughly 40 feet. Gallo Creek flows north and is surrounded by a narrow existing forest that varies between 10-50 feet wide. Pollo Creek is a short channel that flows west for 100 feet with mostly pasture grass surrounding the origin before entering a forested buffer. Jesus Creek begins off -site and flows west across the Parcel. It is surrounded by a forested buffer for most of its project extent, which ranges from 10 feet to over 200 feet. Perro Creek flows south until its confluence with Jesus Creek and is surrounded in its entirety by existing forest that extends out to approximately 100 WTwin Burros Mitigation Bank Parcel Nutrient Offset & Buffer Mitigation Plan HUC 03030002 Page 2 June 2023 feet in some areas. Burro Creek, Pinto Creek, and Panchito Creek flow north and are surrounded by forest all the way to their confluence with Jesus Creek. JR Creek flows south and begins as an ephemeral channel originating from a wetland. About halfway down its project extent it becomes intermittent and is surrounded by forest. Vaca Creek also originates from a wetland and is an ephemeral channel that flows south until its confluence with Jesus Creek. The right floodplain has a narrow line of trees around it with pasture grass dominating the remainder of that floodplain within the project extent. The left floodplain is a forested buffer that reaches up to 100 feet. Martinez Creek begins within the project and flows north out of the easement boundary before it eventually reaches its confluence with Jesus Creek off -site. The Parcel is characterized by moderately sloped valleys of agriculture fields. In general, this area has maintained its rural, farming character over the last 60 years with only minor changes in land cover (see historical aerials in Appendix B). The consistency in land use within the project watershed indicates that processes affecting hydrology, sediment supply, and nutrient and pollutant delivery have not varied widely over this period. With a lack of developmental pressure, watershed processes and stressors from outside the project limits are likely to remain consistent throughout the implementation, monitoring, and closeout of this project. NCDWR also performed an onsite visit of the project area to determine viability for buffer mitigation and nutrient offset on September 7, 2022 and issued a site viability letter on October 26, 2022. Twelve features were assessed by NCDWR during the September 71h site visit and all twelve were deemed viable for buffer credits. Gallo Creek, Pollo Creek, Maria Creek, Caballo Creek, Jesus Creek, Vaca Creek, and JR Creek were deemed viable for nutrient offset credits. There have been no changes to land use in the project area since NCDWR's 2022 site visits. A copy of both the "On -Site (Stream Origin) Determination for Applicability to Jordan Lake Buffer Rules" and the "Site Viability for WTwin Burros Mitigation Bank Parcel Nutrient Offset & Buffer Mitigation Plan HUC 03030002 Page 3 June 2023 Buffer Mitigation & Nutrient Offset" letters from NCDWR are included in Appendix C and summarized in Table 3. The proposed project complies in the following ways: Riparian Restoration and Enhancement on Non -Subject Streams (15A NCAC 02B .0295 (o)(3): • The non -subject streams were confirmed as intermittent or perennial streams by Division staff certified per G.S. 143-214.25A using the Division publication, "Methodology for Identification of Intermittent and Perennial Streams and Their Origins (v.4.11, 2010)" (See Appendix C for the On -Site Determination for Applicability to the Jordan Lake Buffer Rules letter). Cattle exclusion enhancement of grazing areas adjacent to streams (15A NCAC 02B .0295 (o)(6): • Grazing has been the predominant land use since the effective date of the applicable buffer rule (See Appendix B for historical aerials). • Mitigation work will include the permanent exclusion of grazing livestock and credit will be at a 2:1 ratio (See Table 10 for credit calculations and Figure 7 for proposed fencing). Riparian Restoration on ephemeral channels (15A NCAC 02B .0295 (o)(7): • The entire area proposed for mitigation credit is within the contributing drainage area to the ephemeral channel (See Figure 5 for watershed areas and Figure 7 for credit areas). WTwin Burros Mitigation Bank Parcel Nutrient Offset & Buffer Mitigation Plan HUC 03030002 Page 4 June 2023 The ephemeral channel is directly connected to an intermittent or perennial stream and contiguous with the rest of the mitigation site protected under the perpetual conservation easement • The area of the mitigation site on ephemeral channels will not comprise more than 25% of the total area of buffer mitigation (See Table 10 for mitigation areas). • The riparian buffer preservation area on ephemeral channels meets all the requirements of 15A NCAC 02B .0295(o)(4) Riparian Preservation on subject and non -subject streams (15A NCAC 02B. 0295 (o)(4) & (o)(5)): • Both subject and non -subject streams were confirmed as intermittent or perennial streams by Division staff certified per G.S. 143-214.25A using the Division publication, "Methodology for Identification of Intermittent and Perennial Streams and Their Origins (v.4.11, 2010)" (See Appendix C for the On -Site Determination for Applicability to the Jordan Lake Buffer Rules letter) • The area of preservation credit will not comprise more than 25% of the total area of buffer mitigation 2.5 Watershed Characterization The Parcel is located within the HUC 03030002030040. All project features flow to Hughes Mill Creek, which is a tributary to Jordan Creek. Jordan Creek drains to Stoney Creek and eventually to the Haw River and Jordan Lake. Hughes Mill Creek is classified as Water Supply II (WS-II), High Quality Waters (HQW), and Nutrient Sensitive Waters (NSW). Topography, as indicated on the Burlington and Anderson USGS 7.5-minute topographic quadrangle, shows moderately sloped areas throughout the Parcel (Figure 4). Maria Creek, Jesus Creek, and Pinto Creek are depicted as streams on the USGS Topographic Map. Drainage areas were delineated using the USGS Stream Stats website and the North Carolina Floodplain Mapping Program's 2014-2015 Light Detection and Ranging (LiDAR) data. Land uses draining to the project streams are primarily a combination of agricultural and forested land. The watershed areas and current land use around project streams are depicted in Figure 5, the current land use photographs in Appendix A, and are summarized in Table 4 below. The project area soils are described below in Table 5. None of the project features are depicted as streams on the 1908 NRCS Soil Survey provided in Figure 6. Existing vegetation species across the project area are listed in Table 6. This is not an exhaustive list but gives an indication of types of species growing in the area. Additionally, the USFWS responded to the prospectus for the Twin Burros Mitigation Site on November 29, 2021, stating "it appears the action [this project] is not likely to adversely affect federally listed species or their critical habitat as defined by the ESA". All correspondence with USFWS and a list of Threatened and Endangered Species in Caswell County, NC is included in Appendix D. 2.9 Cultural Resources There are no existing structures in the project area. The Parcel is not located near any sites listed on the National Register with the State Historic Preservation Office (SHPO). SHPO was contacted with request for review and comment on June 9, 2022. SHPO responded on August 2, 2022 that they "are aware of no historic resources which would be affected by the project" and have no comment on the project as it is currently proposed. The SHPO request and response are included in Appendix D. 2.10 FEMA Floodplain Compliance The Parcel is represented on the Caswell County Flood Insurance Rate Map (FIRM) Panels 9900 and 9901. There are no FEMA-mapped streams within the Parcel. However, 200 LF of Maria Creek falls within the mapped 100-year floodplain of Hughes Mill Creek. Wildlands will coordinate with the local floodplain administrator to make sure that all regulatory requirements are met. The Parcel will be designed to avoid adverse floodplain impacts or hydrologic trespass on adjacent properties or local roadways. 2.11 Parcel Location, Parcel Constraints, and Access The project area is split into two sections which are both easily accessible, one via Shaniqua Drive and the other via Ross Acres Road 2. Within each section, there are no easement breaks. There are no internal crossings on the northern project section, however, there are four proposed internal culvert crossings on the southern project section. The internal crossings will have gates and cattle will be permitted to cross only in these areas, per the conservation easement language. There are multiple existing private access easements, all located outside of the proposed conservation easement. 2.12 Other Environmental Conditions An EDR Radius Map Report with Geocheck was ordered for the Parcel through Environmental Data Resources, Inc. on May 11, 2021. Neither the target property nor the adjacent properties were listed in any of the Federal, State, or Tribal environmental databases searched by EDR. There were no known or potentially hazardous waste sites identified within or immediately adjacent to the project area. The Executive Summary of the EDR report is included in Appendix D. 3.0 Site Protection Instrument The land required for planting, management, and stewardship of the mitigation project includes portions of the parcels listed in Table 7. The Parcel will remain in private ownership, protected in its WTwin Burros Mitigation Bank Parcel Nutrient Offset & Buffer Mitigation Plan HUC 03030002 Page 7 June 2023 entirety by an approved NCDWR long term steward, and will be managed under the terms detailed in an approved NCDWR conservation easement. Figure 7 illustrates the nutrient offset credit areas and riparian buffer credit areas and conceptual design; Figure 8 depicts the riparian zones and designated widths for the Parcel. 4.1 Parcel Preparation In general, riparian areas will either be restored, enhanced by installing fencing to exclude cattle, or preserved with minimum widths of 20 feet from tops of banks and maximum widths of 200 feet from tops of banks. Much of the land within 200 feet from top of bank of the project features has either been cleared and maintained for active cattle pastures or has remained forested. Areas slated for riparian restoration that are not impacted by the construction of the stream and wetland mitigation project will require little site preparation including select herbicide treatments or limited mechanical clearing to removed undesirable underbrush, invasive species, and fescue (Festuca spp.). Other areas of the easement will be graded in accordance with the IRT approved stream mitigation plan. Any haul roads or other areas of compacted soil including areas compacted by cattle within the easement boundary will be ripped prior to planting. The specifics of the stream restoration project are in the Twin Burros Stream and Wetland Mitigation Plan. Section 6.7 of the Twin Burros Stream and Wetland Mitigation Plan contains information on grading. A 401 & 404 permit will be required for all stream restoration work and will be obtained before any work in the waters begins. 4.2 Riparian Area Restoration Activities Riparian area restoration will involve planting appropriate native tree species along the riparian corridor. Vegetation management and herbicide applications may be needed over the first few years of tree establishment in the riparian restoration areas to prevent encroachment of undesirable species that may out -compete the planted native vegetation. Tree and shrub species planted across the riparian areas of the Parcel will include a mixture of the species listed in the Twin Burros Mitigation Site Planting Tables, located in Appendix E. The primary species will include the species listed in Table 8. All activities associated with generating riparian buffer and nutrient offset credits will occur at the same time as the stream and wetland mitigation activities and not before. At least 8 species listed in Table 8 will be planted. If a species is not available at the time of planting, the percentage composition of one or more of the available species will be increased to ensure the same number of trees required to meet the proposed density are planted. No one species will be planted at a composition higher than 15%. Due to the nature of random mixing, some stems of the same species might be planted together in some areas. No one tree or shrub species will be greater than 50% of the established stems. The final performance standard shall include a minimum of four native hardwood tree and native shrub species. A regionally appropriate seed mix of warm season grasses and wildflowers will also be applied to provide temporary and permanent ground cover for soil stabilization and reduction of sediment loss during rain events in areas without existing herbaceous cover. The proposed planting area includes the areas identified as Riparian Restoration for Buffer Credits and Riparian Restoration for Nutrient Offset Credits on Figure 7. Additionally, areas that are generating wetland credits in the associated Twin Burros Mitigation Site will be planted with species listed in Table 9. These areas will not generate riparian buffer or nutrient offset credit and are therefore not tied to success criteria stated in Section 5.0. Planting is scheduled for January 2024. 4.3 Riparian Area Enhancement Via Cattle Exclusion Activities For enhancement areas under NCAC 02B .0295(o)(6), cattle exclusion, planting isn't anticipated to be needed except where required in the stream mitigation plan. Fencing will be installed throughout the entirety of the easement to discontinue cattle access. A seed mix as identified in Appendix E will be applied where livestock have created bare soils and sufficient sunlight is available to support the species in the seed mix. 4.4 Riparian Area Preservation Activities There will be no parcel preparation work done in the riparian preservation areas under 15NCAC 02B .0295(o)(4) except as required in the stream mitigation plan. The area of preservation credit within the buffer mitigation site is less than 25% of the total area of buffer mitigation, as shown in Table 10. The preservation area will be protected in perpetuity under a conservation easement and fencing will be installed throughout the entire easement boundary. 4.5 NCDWR As -Built Evaluation Within 30 calendar days after completing the establishment of the buffer mitigation and nutrient offset areas, the Sponsor will submit written notification to NCDWR documenting that all buffer mitigation and nutrient offset activities have been completed, including the installation of fencing and adequate marking of easement boundaries. In addition, all stream and wetland mitigation activities for the Twin Burros Stream and Wetland Mitigation Site must be completed prior to the NCDWR as -built evaluation. Failure to submit written notification within 30 days may result in a modified credit release schedule or a delay in the issuance of credit releases. 5.0 Monitoring and Maintenance Plan 5.1 Monitoring Protocol Vegetation monitoring plots will be installed and evaluated within the riparian restoration areas to measure the survival of the planted trees and shrubs. The plots will be randomly placed throughout the planted riparian areas and will be representative of areas generating riparian buffer credits and nutrient offset credits. A total of 5 plots will be established within restoration areas and will be randomly placed such that the plots are representative of the buffer mitigation credit areas (Figure 9). The size of individual quadrants will be 100 square meters. All 5 vegetation plots will be shared with the stream and wetland mitigation bank. Vegetation assessments will be conducted and follow the Carolina Vegetation Survey (CVS) Level 2 Protocol for Recording Vegetation (Lee et al., 2008). A reference photo will be taken from the WTwin Burros Mitigation Bank Parcel Nutrient Offset & Buffer Mitigation Plan HUC 03030002 Page 10 June 2023 southwestern corner of each of the 5 plots. Overview photos will be taken each monitoring year and provided in the annual reports. All planted stems will be marked with flagging tape and recorded. The first annual monitoring activities will commence at the end of the first growing season, at least five months after planting has been completed and no earlier than the fall season. Species composition, height, vigor, and survival rates will be evaluated on an annual basis by plot. The total number of volunteer woody stems will also be documented and reported. The measure of vegetative success for the Parcel will be the survival of at least four native hardwood tree and shrub species, where no one species is greater than 50% of the established planted stems, and an established density of at least 260 planted trees and shrubs per acre at the end of the fifth year of monitoring. Appropriate and desirable native volunteer species may be included in the Parcel's density to meet the performance standards with written NCDWR approval. A visual assessment of the cattle exclusion areas within the conservation easement will also be performed each year to confirm: • Existing fencing is in good condition throughout the site; • No cattle access within the conservation easement area; • No encroachment has occurred; • Diffuse flow is being maintained in the conservation easement area; and • There has not been any cutting, clearing, filling, grading, or similar activities that would negatively affect the functioning of the buffer. The Sponsor shall submit the annual monitoring report to NCDWR by December 315T of each year for five consecutive years and will follow the terms and conditions of the MBI. 5.2 Parcel Maintenance If the Parcel or a specific component of the Parcel fails to achieve the success criteria outlined in Section 5.1, adaptive measures will be developed and/or appropriate remedial actions will be implemented. Maintenance will be performed to correct any identified problems on the Parcel that have a high likelihood of affecting project success. Such items include, but are not limited to, fire, flooding, drought, or insects that cause excess tree mortality. Any actions implemented will be designed to achieve the success criteria and will include a work schedule and updated monitoring criteria. A rigorous herbicide schedule may need to be implemented in the first few years of tree establishment in the restoration areas to prevent establishment of invasive species that may out -compete the planted native vegetation. The only herbicides used on the Parcel will be aquatic approved herbicides that will be applied in accordance with North Carolina Department of Agriculture rules and regulations. The easement boundary will be checked annually as part of monitoring activities. The condition of fencing will be assessed to ensure livestock do not have access to the easement. Easement boundary conditions as well as any maintenance performed will be reported in the annual monitoring reports to NCDWR. 5.3 Easement Boundaries Easement boundaries will be identified in the field to ensure clear distinction between the Parcel and adjacent properties. Boundaries may be identified by marker, post, tree -blazing, or other means as allowed by site conditions and/or conservation easement prior to the NCDWR onsite As -Built evaluation for Task 2 credit release. Boundary markers that have been disturbed, damaged, or destroyed will be repaired and/or replaced on an as needed basis. Contact information for the conservation easement holder will be included on easement markers. These areas will not be convertible to riparian buffer credits per the MBI. The total credit potential of riparian buffer credit convertible to nutrient offset credit is represented in Table 9 below and will be documented in the As -Built Report and will be supported by the As -Built survey. There will be four(4) credit ledgers for the project: Buffer Restoration, Buffer Enhancement (Cattle Exclusion) with Buffer Preservation, Nitrogen Nutrient Offset Credits (46.10836 Delivery Factor) and Phosphorus Nutrient Offset Credits (1,009.66554 Delivery Factor). The proposed easement boundaries on the maps include all riparian areas intended to be proposed as part of the buffer mitigation and nutrient offset site. Additionally, Figure 3 shows the stream origins performed by DWR and is attached to this correspondence. This site is also being proposed as a stream mitigation site and therefore stream bank instability or presence of erosional rills within riparian areas were not addressed. On September 5, 2022, Ms. Merritt performed a site assessment of the subject site. Staff with RS were also present. Ms. Merritt's evaluation of the features onsite and their associated mitigation determination for the riparian areas are provided in the table below. Site cannot be a Preservation Only site to comply with this rule. 3NC Division of Water Resources - Methodology and Calculations for determining Nutrient Reductions associated with Riparian Buffer Establishment 'Determinations made for this Site are determined based on the proposal provided in maps and figures submitted with the request. s All features proposed for buffer mitigation or nutrient offset, must have a planted conservation easement established that includes the tops of channel banks when being measured perpendicular and landward from the banks, even if no credit is viable within that riparian area. 6The area of the mitigation site on ephemeral channels shall comprise no more than 25 percent (25%) of the total area of buffer mitigation per 15A NCAC 02B .0295 (o)(7). 7The area described as an Enhancement Site was assessed and determined to comply with all of 15A NCAC 02B .0295(o)(6). Cattle exclusion fencing is required to be installed around the mitigation area to get buffer credit under this part of the rule. Determinations provided in the table above were made using a proposed easement boundary showing proposed mitigation areas and features shown in Concept Map A, Concept Map B and Figure 3. The maps representing the proposal for the site are attached to this letter and initialed by Ms. Merritt on October 26, 2022. Substantial changes to the proposed easement boundary as well as any site constraints identified in this letter, could affect the Site's potential to generate buffer mitigation and nutrient offset credits. This letter does not constitute an approval of this Site to generate buffer mitigation and nutrient offset credits. Pursuant to 15A NCAC 02B .0295, a mitigation proposal and a mitigation plan shall be submitted to DWR for written approval prior to conducting any mitigation activities in riparian areas and/or surface waters for buffer mitigation credit. Pursuant to 15A NCAC 02B .0703, a proposal regarding a proposed nutrient load -reducing measure for nutrient offset credit shall be submitted to DWR for approval prior to any mitigation activities in riparian areas and/or surface waters. All vegetative plantings, performance criteria and other mitigation requirements for riparian restoration, enhancement and preservation must follow the requirements in 15A NCAC 02B .0295 to be eligible for buffer and/or nutrient offset mitigation credits. For any areas depicted as not being viable for nutrient offset credit above, one could propose a different measure, along with supporting calculations and sufficient detail to support estimates of load reduction, for review by the DWR to determine viability for nutrient offset in accordance with 15A NCAC 02B .0703. The project, based on the description in your letter to our office, and other information, is expected to have minimal adverse impacts to fish and wildlife resources.
