A 401 Water Quality Certification is required from the Division for any federally permitted project that may result in a discharge to waters of the U.S. The Division issues two types of Certifications: Individual and General. Individual Certifications are issued for individual activities and require application submittal and approval. General Certifications cover specific groups of activities and do not require application submittal and approval for coverage. I have attached to this email General Certification 4256 (GC4256), which corresponds to NWP 29. The second page of the attached document lists a number of thresholds or circumstances under which an Individual Certification would be required. If your proposed activity will not meet any of the thresholds listed, an Individual Certification is not required and the project may be covered by the General Certification, provided all of the conditions will be met. Your proposed project is on a stream classified as Trout. Therefore, per threshold h) of GC4256, an Individual Certification is required. To begin the process of requesting an Individual Certification, you must first submit a pre -filing meeting request at least 30 days prior to application (Pre -Construction Notification [PCN]) submittal to the Division. More information regarding the pre -filing meeting request, as well as instructions for submittal, may be found here https://www.deg.nc.gov/about/divisions/water-resources/water-quality-permitting/401-buffer-permitting/application- forms-help-documents. The PCN form may be completed and submitted electronically, or you may submit a pdf of the completed application electronically.
