PROJECT SUMMARY: The applicant proposes to construct a 4' X 526' pier with a 12' X 12' floating dock, 239 sq ft stationary dock and a 28' X 11' uncovered boat lift all located at the waterward end. Page 2 Donald Crounse 9. PROJECT DESCRIPTION The project site is located at Lot 6 in Marker Fifty Five Subdivision in Holden Beach, Brunswick County, NC. The street address of the property is 338 Marker Fifty Five Drive, Holden Beach, NC. The lot is approximately 3.2 acres located on a moderate bluff (approximately 7 -8 ft). A single family residence currently exists on the property. Coastal wetlands on the lot consist of a very narrow fringe (3 ft) of Snartina ap tens along the lower waterward boundary of the bluff with Snartina alterniflora extending from the fringe of Snartina ap tens waterward approximately 516 ft. to open water. The Town of Holden Beach Land Use Plan classifies the area as Limited Transition - Low Density Residential. The adjacent waters of the AIWW are classified as SA waters by the Division of Environmental Management. The adjacent waters between the AIWW and the lot are not classed as Primary Nursery Area by the Division of Marine Fisheries and are closed to the taking of shellfish. The applicant proposes to construct a 4 X 526 ft. pier to open water. The pier would begin at the edge of the top of the bluff and extend approximately 526 ft. waterward, elevated over the Snartina alterniflora marsh to reach and approximate four feet Mean Low Water contour. The applicant is also requesting a 239 sq. ft. stationary dock, 12 X 12 ft floating dock and a 28 X 11 ft boat lift at the waterward end of the pier. The entire pier, stationary dock, floating dock and boat lift should not exceed 554 ft. in length from Mean High Water. All structures and pilings are proposed to be at least 80 ft. from the near bottom edge of the federally maintained channel and at least fifteen feet inside of each riparian corridor line on either side of the lot. The applicant has presented a survey which identifies the riparian corridor. 10. ANTICIPATED IMPACTS The proposed structure would incorporate approximately 2,860 square feet of Estuarine and Public Trust Waters. The pier would shade approximately 2,104 square feet of Snartina alterniflora marsh, but if elevated sufficiently, should not result in any long -term adverse impacts. The project as proposed meets the 1/3 rule, is 80 ft. from the near water edge of the federally maintained channel, totals less than 500 square feet dock space and is located at least 15 ft inside each adjacent riparian corridor line. Staff review of the plans and specifications has determined that the development activities proposed will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000. By copy of this letter, we are informing you that your project will not require a stormwater management permit. Please keep in mind that this determination does not relieve you of your legal responsibility to obtain other permits which may be required by the Division of Water Quality, the Division of Land Resources, Coastal Areas Management Act, Federal, State, or Local Governments. In addition, any future modifications to the project will require additional review from this Office to assure that stormwater impacts are not an issue.
