PROJECT SUMMARY: The applicant proposes to expand an existing docking facility, by creating four (4) additional slips (totaling five boats slips), install a vertical vinyl breakwater/sill, bulkhead and new excavation within an existing a boat basin/canal within Mill Creek. PROJECT DESCRIPTION: The project site is located at 2213 Washington Acres Road adjacent to a man-made basin/canal, in Long Point Estates, Hampstead, Pender County. To access the site from Wilmington, take US Hwy 17 N toward Jacksonville. Travel approximately 11 miles (from WIRO) to Washington Acres Road. Turn right onto Washington Acres Road and travel approximately 1.8 miles to the end of the road. The site is located along the left-hand side at 2213 Washington Acres Road. Existing man-made features on the property include a single-family dwelling, uncovered deck and private one -slip docking facility. The high ground contains several mature Oaks and the understory is blanketed in ornamental landscaping. A quick search of DCM's permit database confines the existing docking facility was permitted in March 2018 under CAMA general permit No. 70718. The permit also authorized a 10' x 40' x 4' dredge footprint around the permitted 6' x 32' floating dock; however, it is believed that no dredging ever occurred under the general permit. The applicant is now proposing to apply for a new four -slip docking facility (creating five slips total within the basin), perform maintenance dredging within the canal, perform new dredging around the proposed five -slip docking facility, and install a new breakwater wall/sill and bulkhead. The width of the waterbody in the location of the proposed docking facility ranges from approximately 60'-80' from the edge of marsh on one side to the opposing edge of marsh, allowing a maximum distance between15'-20' beyond the nearshore edge of marsh. The marsh area along the applicant's shore is approximately 6'-13' in with and is comprised mostly of Smooth Marsh Cordgrass (Spartina Altern fora). Mill Creek and the finger canals associated with the creek system, has a documented history of dredging, as authorized under CAMA Major/Dredge and Fill Permit 175-07, which was issued to Mill Creek Waterway Restoration, Inc., in 2007. According to the permit, the subject channel was dredged to a depth of 4 (@NLW), and a width of approximately 25', along the centerline. As proposed, new dredging associated with the application package would be located outside of the existing dredge footprint; therefore, it would be considered new dredging. The waters of the AIW W adjacent to the project site are classified as SA-HQW by the North Carolina Division of Water Resources. They area is NOT designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries, and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to expand an existing docking facility, by adding four (4) additional slips (totaling five boats slips), install a vertical vinyl breakwater/sill, bulkhead and new excavation within an existing a boat basin/canal within Mill Creek. As proposed, the total slip count at the subject property would be expanded from a single slip to five. Currently, the applicant maintains a single 6' x 32' section of floating dock along the center of his shoreline that is accessible by a ramp, which extends from the upland. In this location, the applicant proposes to install a new 6' x 6' landing along the waterward edge of the proposed bulkhead and install a new ramp/gangway that would provide access to the existing floating dock. According to the applicant package, the existing dock would be realigned, but would still run parallel with the channel and would also be extended in a northern direction. Along the northern end of the floating dock, the applicant is requesting authorization to install a new 12.5' x 13.5' boatlift. This lift would be accessible by a proposed 6' x 16' fixed finger pier that would originate from the proposed bulkhead and extend westerly toward the channel. This lift (referred to on sheet 4 of 5 as slip 1), would be positioned at a near 45-degree angle to the shoreline to allow for ingress and egress. Along the southern end of the floating dock, the applicant proposes to install a second boatlift (labeled as slip 5 on sheet 4 of 5) that would measure approximately 14' x 16'. This lift would also be installed at a near 45-degree angle to the shore to allow for ingress/egress. A new 6' x 14' walkway and 4' x 16' finger pier would extend from the proposed bulkhead, providing access to the new lift. As proposed, both lifts would be oriented at a near 45-degree angle to the shoreline and would approximate the'/4 width of water body limitation. Neither the floating dock, nor the lifts, would encroach within the 15' riparian corridor setback of either adj. riparian property owner (ARPO), nor would they extend into the channel. Just inland of the proposed docking facility, between the docking facility and the outer edge of Coastal Wetlands, the applicant is proposing to install a vertical vinyl sheetpile breakwater wall/sill that would be approximately 1' in width by 186' in length. As described in the application package, the sill would span the shoreline at a distance of approximately 2'-4' waterward of the outer edge of Coastal Wetlands. There would be a break in the wall beneath the walkway leading to the existing floating dock, with 100' of free-standing wall along the northern side of the access pier and approximately 86' of free-standing wall along the southern side. The breakwater wall/sill would stop short of the 15' riparian corridor setback on either side, and although there is no reference to the height of the sill on the MP-2 form, the total height should not exceed more than 12" above the normal high water (NHW) line. Just inland of the proposed breakwater/sill, the applicant is proposing to install a new vinyl or concrete wall. The bulkhead would measure approximately 257' in length (including wing walls) and would be located upland of any/all wetlands on site. The topography of the lot transitions abruptly, and the proposed bulkhead would approximate the upper escarpment, which is the leading edge of "high ground". The applicant estimates that approximately 20' of ground disturbance would occur on the landward side of the bulkhead for installation of tie pilings and dead men. This area is void of any wetland vegetation so any disturbance would be limited to upland areas. The final component of the applicant's project involves dredging an area of the canal, adjacent to and beneath the proposed docking facility. As designed, an approximate 220' x 27' boat basin would be dredged to a depth of approximately -4' @ NLW, just east of the maintained channel. Concurrent to the proposed new work, a maintenance dredging request is being sought for the area located just west of the proposed docking facility, along the previously excavated channel (15' x 60' x -4' NLW). Considering the main channel of Mill Creek, including the side channel which provides access to the subject facility, has been previously dredged under CAMA major permit 175-07, the new proposal does not appear to be inconsistent with current DCM Rules. Spoil material resulting from the proposed dredging operations would be handled via a bucket to barge type operation and would be disposed of on property owned by the applicant and located off Shaw Highway at Pender County Parcel ID No. 3256-12-7448-0000. The designated disposal area (50' x 100') is located within a larger parcel that is approximately 100 acres in size. The disposal site is located approximately 14 miles from the project site and transportation would occur via land haul. Based on previous site visits, there does not appear to be any shellfish resources or SAV within the project area. Additionally, the disposal area appears to be void of any wetlands. 10. ANTICIPATED IMPACTS The proposed new docking facility and breakwater wall/sill would incorporate approximately 1,043 sq. ft. of Estuarine Waters and Pubic Trust Area. The proposed docking structure would not encroach into the adjacent 15' Riparian Corridor Setback Areas, and would not extend beyond the ''A width limitation, nor encroach into the maintained channel. The proposed dredging would disturb approximately 900 sq. ft. of previously disturbed bottom and approximately 5,500 sq. ft. of previously undisturbed bottom. Installation of the bulkhead (with backfill) and spoil disposal would impact approximately 10,140 sq. ft. of upland area, with no proposed impacts to any wetlands. Minor increases in turbidity should be expected; however, no long-term impacts are anticipated. The total area of the proposed structures was calculated as follows: Shoreline length = +/-236 ft. x 8 sq. ft. = 2,000 sq. ft. allowable. Proposed: Access piers = 6' x 16' and 6' x 14' = 180 sq. ft. Project Narrative JUN 0I 2023 4.1.1 Project Location and Existing Conditions ®CM WILMINGTON, NC The project is located adjacent to the Long Point Estates Canal and Atlantic Intracoastal Waterway at 2213 Washington Acres Road in Hampstead, Fender County. There is an existing single family home with a driveway and the site is currently vegetated with trees, shrubs and grasses. There is a floating dock measuring 6' wide x 32' long that can accommodate one large vessel, and platform constructed under CAMA General permit 70718. A dredge footprint of 15' wide x 60' long to a depth of -4' Normal Low Water under the floating dock was also authorized under CAMA General permit 70718. A boatlift was also authorized but never constructed. Normal High Water and Coastal Wetlands were delineated by Davey Resource Group in December 2022 and approved by DCM staff on May 4, 2023. Water depths relative to normal low water were client collected on February 8, 2023. Channel water depths relative to normal low water were client collected on April 19, 2023. An upland survey was conducted by Robert H. Goslee & Associates, PA in February 2023 and included location of the surveyed approximate normal high water and coastal wetland lines. The shoreline at approved normal high water is 230'. A maintenance channel and dredge boundary for the majority of Mill Creek was authorized by CAMA Major Permit 157-07 and provides a 25' width and 4' depth in the project area. Waters in the project area are classified as SA/HQW and are not open to shellfishing. The area is classified as Permanent Secondary Nursery Area. See appendix B for details. 4.1.2 Proposed Action The applicant proposes one bulkhead with a wingwall on the northern portion to be constructed landward of the coastal wetland line of either concrete or naval style vinyl sheet pile measuring 1' wide x 257' long. The proposed bulkhead will tie to the existing southern bulkhead. The backfill area will measure approximately 1,100 square feet and tie to the existing grade / top of bank where upland erosion has occurred. Backfill volume will measure approximately 75 cubic yards and will be comprised of sand obtained from a sand mine or other upland source. A 6' wide x 6' long platform extension to the existing platform is proposed. The existing 6' wide x 32' long floating dock will be reoriented and a 6' wide x 60' long floating dock addition is proposed on the north side. The proposed floating dock will generate an additional two wet slips. A boat lift is proposed on the northern portion of the property measuring 13.3' wide on center and 12.5' long outside to outside with a fixed access pier measuring 6' wide x 16' long. A boat lift is also proposed on the southern portion of the property measuring 16' wide on center and 14' long outside to outside with a fixed access pier measuring 6' wide x 14' long and a fixed access dock measuring 4' wide x 16' long to allow enhanced access to the proposed boat lift. The total number of proposed slips will increase from one to five. There are two sheetpile sills proposed 2' waterward of the existing outer edge of marsh. The southern sill will measure 86' long, originate from 15' north of the southern riparian corridor, and terminate at the southern portion of the existing fixed pier. The northern sill will measure 100' long, originate from the northern portion of the existing fixed pier, and terminate 21' south of the northern riparian corridor. There will be a 5' gap between the two proposed sills underneath the existing fixed pier access gangway. The sills will include sheathing board gap areas, the height not to exceed six inches above normal high water, and markings with 3' tall yellow reflectors will be installed at 50' intervals. Due to water depths in the vicinity of the existing and proposed docking facilities, dredging is proposed. The proposed bulkhead will tie to the existing southern bulkhead. The backfill area will measure approximately 1,100 square feet and tie to the existing grade / top of bank where upland erosion has occurred. Backfill volume will measure approximately 75 cubic yards and will be comprised of sand obtained from a sand mine or other upland source. An 8' wide x 6' long platform extension to the existing platform is proposed. The existing 6' wide x 32' long floating dock will be reoriented and a 6' wide x 60' long floating dock addition is proposed on the north side. The proposed floating dock will generate an additional two wet slips. A boat lift is proposed on the northern portion of the property measuring 13.3' wide on center and 12.5' long outside to outside with a fixed access pier measuring 6' wide x 16' long. A boat lift is also proposed on the southern portion of the property measuring 16' wide on center and 14' long outside to outside with a fixed access pier measuring 6' wide x 14' long and a fixed access dock measuring 4' wide x 16' long to allow enhanced access to the proposed boat lift. The total number of proposed slips will increase from one to five. There are two sheetpile sills proposed 2' waterward of the existing outer edge of marsh. The southern sill will measure 86' long, originate from 15' north of the southern riparian corridor, and terminate at the southern portion of the existing fixed pier. The northern sill will measure 100' long, originate from the northern portion of the existing fixed pier, and terminate 21' south of the northern riparian corridor. There will be a 5' gap between the two proposed sills underneath the existing fixed pier access gangway. The sills will include sheathing board gap areas, the height not to exceed six inches above normal high water, and markings with 3' tall yellow reflectors will be installed at 50' intervals. Due to water depths in the vicinity of the existing and proposed docking facilities, dredging is proposed. A proposed channel maintenance dredge area of approximately 3,200 square feet to a depth of 4' below normal low water level will generate approximately 325 cubic yards of dredge spoil. The maintenance dredge channel was originally authorized by CAMA Major Permit 175-07 with a width of 30' x 4' depth in the project area. The existing floating dock maintenance dredge area was originally authorized by CAMA General Permit 70718. An additional proposed dredge area of approximately 1,900 square feet to a depth of 4' below normal low water level will generate approximately 120 cubic yards or dredge spoil. Dredge spoil will be placed on a 50' x 100' upland portion of PIN 3256-12-7448-0000 in Pander County. The parcel is owned by the applicant. This is necessary to demonstrate that no portion of the proposed docking facility will extend beyond the near shore edge of the existing channel footprint (example: the southern lift is shown to extend beyond (waterward) of the existing edge of channel). / Once a survey has been completed, please overlay the proposed development plan on top of the survey.
