Yes, the Cruz home septic permit and site plan are still applicable and accurate. Sorry for not including them this time. Regarding the wetland credits, I had checked with the two RES private banks before submitting the application and the confirmed they did not have any available, though that was 12 days prior to submittal. That email exchange is attached. I can request an update if you need. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: During review of the first version of the subject project, the Division requested a map/figure that shows the location of the new home and septic system on the north side of Caleb Drive. The attached documents entitled Cruz home septic permit and Cruz home site plan were provided to the Division on March 22, 2023, but were not included in the most recent submittal. Please confirm the attached figures are still applicable and accurately depict the structures planned for the subject project. [15A NCAC 02H .0502(a)(9)] An acceptance letter from DMS was provided with the PCN to fulfill the project's compensatory mitigation requirement. North Carolina General Statute 143-214.11(d1) only allows the use of payment to DMS to fulfill compensatory mitigation requirements when it has been demonstrated that credits are not available from private banks. Email correspondence from you on April 18, 2023, indicates wetland mitigation credits were not available in the French Broad basin. A review of RIBITS today indicates wetland mitigation credits are available from private mitigation banks. Please confirm no wetland credits were available from private mitigation banks at the time the PCN was submitted. If wetland credits were available from a private mitigation bank at the time the PCN was submitted, those credits will need to be purchased before credits may be used from DMS to fulfill the mitigation requirement. [15A NCAC 02H .0506(c)] Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please provide your response by June 19, 2023. If all of the requested information is not received, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and appropriate fee.
