APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Warwick:
You have our approval, in accordance with the attached conditions and those listed below, to fill in
0.09 acres of wetlands or waters for the purpose of driveway and landscaping at 9165 River Oaks Lane,
as you described in your application dated 16 June 1997. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number 3106. This certification
allows you to use Nationwide Permit Number 18 when it is issued by the Corps of Engineers. In
addition, you should get any other federal, state or local permits before you go ahead with your project
including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non - Discharge and
Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA
permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except
as modified below. If you change your project, you must notify us and you may be required to send us
a new application. If total wetland fills for this project (now or in the future) exceed one acre,
compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this
approval to be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed below. Deed restrictions, conservation easements or similar mechanisms shall be
placed in all lots with remaining jurisdictional wetlands and waters to prevent future fill. These
mechanisms shall be put in place within 30 days of the date of this letter. The applicant is required to
contact the Wilmington Regional Office of the N.C. division of Coastal Management before the wetland
or water impact occurs to determine whether a CAMA Permit is needed for this project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send
a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office
of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611 -7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean
Water Act. If you have any questions, please telephone John Dorney at 919 - 733 -1786.

Dear Mr. Warwick:
Reference your application received May 3, 1997, for Department of the
Army (DA) authorization to discharge fill material into 4080 square feet of
wetlands adjacent to Town Creek for instillation of a driveway and landscaping
on your property located at 9165 River Oaks Lane, near Leland, Brunswick
County, North Carolina.
For the purposes of the Corps of Engineers' Regulatory Program, the
"December 13, 1996 Federal Register, Final Notice of Issuance, Reissuance, and
Modification of Nationwide Permits (61 FR 65874)" listed nationwide permits.
Authorization, pursuant to Section 10 of the Rivers and Harbors Act and
Section 404 of the Clean Water Act, was provided for discharges of dredged or
fill material into all waters of the United States provided that the activity
meets all the following criteria:
a. The quantity of the discharge and the volume of the excavated area
does not exceed twenty -five (25) cubic yards below the plane of the ordinary
high water mark or the high tide line;
b. The discharge, including any excavated areas, will not cause the loss
of more than 1/10 acre of a special aquatic site, including wetlands. For the
purposes of this nationwide permit, the acreage limitation includes the filled
area and excavated area plus special aquatic sites that are adversely affected
by flooding and special aquatic sites that are drained so that they would no
longer be a water of the United States as a result of the project;
C. If the discharge, including any excavated area, exceeds 10 cubic
yards below the plane of the ordinary water of the high tide line or if the
discharge is in a special aquatic site, including wetlands, the permittee
notifies the District Engineer in accordance with the "Notification" general
condition. For discharges in special aquatic sites, including wetlands, the
notification must also include a delineation of affected special aquatic
sites, including wetlands;

d. The discharge, including all attendant features, both temporary and
permanent, is part of a single and complete project and is not placed for the
purpose of stream diversion; and
e. This nationwide permit cannot be used in conjunction with nationwide
permit No. 26 for any single and complete project.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions and provided
you receive a Section 401 water quality certification from the North Carolina
Division of Water Quality (NCDWQ) and, in the coastal area, a consistency
determination from the North Carolina Division of Coastal Management (NCDCM).
You should contact Mr. John Dorney, telephone [phone], regarding
water quality certification, and Mr. Steve Benton, telephone [phone],
regarding consistency determination. This nationwide permit does not relieve
you of the responsibility to obtain other required State or local approval.
This verification will be valid until the nationwide permit is modified,
reissued or revoked, which will occur by February 11, 2002. It is incumbent
upon you to remain informed of changes to the nationwide permits, which will
be announced by public notice when they occur. If you commence, or are under
contract to commence, this activity before the date the nationwide permit is
modified or revoked, you will have twelve months from the date of the
modification or revocation to complete the activity under the present terms
and conditions of this nationwide permit.
This verification will be valid for two (2) years from the date of this
letter unless the nationwide authorization is modified, reissued or revoked.
This verification will remain valid for the two (2) years if, during that
period, the nationwide permit is reissued without modification or the activity
complies with any subsequent modification. If during the two (2) years, the
nationwide permit authorization expires or is suspended or revoked, such that
the activity would no longer comply with the terms and conditions of the
nationwide permit, activities which have commenced or are under contract to
commence, in reliance upon this nationwide permit, will remain authorized.
This is provided the activity is completed within twelve (12) months of the
date of the nationwide permit's expiration, modification or revocation.
-We have evaluated potential impacts of your activity, and we have
determined that your proposal will not likely have an adverse affect on) any
endangered species.
When you have completed your work and any required mitigation, please
sign and return the enclosed certification form.

The project is located in one of the 20 Coastal Counties. You should contact the nearest State Office of
Coastal Management to determine their requirements.
Placement of dredged or fill material in wetlands on this property without a Department of the Army
permit is in most cases a violation of Section 301 of the Clean Water Act (33 USC 1311). A permit is
not required for work on the property restricted entirely to existing high ground. If you have any

Dear Mr. Hosey:
This letter is to serve as an application for two permits. I have also enclosed a copy of the
plot diagrams for your reference.
On March 4, 1997, you visited my property, delineated the wetland area, and discussed
my options. I have looked over the low sections and have changed my plans to minimize
the work to be done.
Due to the storms last year, trees in and along the natural ravine have fallen and have
uprooted, causing water in areas that had previously drained very well. I am applying for
a permit type #18 for this area. I would like to fill in an area measuring 77' long and from
30' wide uphill to 50' wide downhill. This is an area of approximately 3,080 square feet.
This fill will include a sock -drain pipe along the original grades which will allow drainage
under the soil. All uphill plans have been dropped as they are now unnecessary. The
boundaries will include your ribbons, stopping downhill at ribbon line #10/ #19 east to west
for this permit.
the application for permit type #14 is to cover creation of a driveway across the downhill
end of the area in permit type #18 above. This is to provide access across this section to
"Town Creek" at the bridge. We hope to build a boat dock in the future and will need to
be able to go through the woods to get there. The area to be covered by this permit is 20'
(or less) wide by 50' long, or less than 1,000 square feet. It runs along the downhill base
of the permit type #18 area and will also have a sock -drain pipe, and will be properly
tapered for drainage.
