Furthermore, please note that you should include DWQ in your correspondence reflecting the decision the Town intends to take with regards to the existing and proposed actions at the site. When you arrive at your conclusion, please be sure to provide us five copies of your updated application materials reflecting the corrected impacts and project description details. We would anticipate treating this application in a similar fashion regarding enforcement versus an Individual Certification. Please advise of the Town's decision. Manuele, Jean B SAW wrote: Harlan, I have spoken with Justin and while we recognize that the impacts for permanent impacts at one crossing now total 306 feet of permanent impacts versus the permitted 294', and that the Corps now has the ability to require a Department of the Army (DA) individual permit. However, while we might tend toward proceeding with the remediation through enforcement protocol versus the individual permit, we would prefer an official response from the town prior to finalizing that decision. My apologies for not having gotten to this the yesterday, but i got tied up with other issues and it slipped my mind until it was after 5 and likely wouldn't have helped at that point. Has the Corps made a decision as to whether or not the agency will require an Individual Permit for the project under construction at this time and if so what can I tell the town related to that decision?
