Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 960823 Modification dated July 24, 1998, for the construction of Wrightsboro Elementary School. This permit shall be effective from the date of issuance until July 24, 2008, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will resull in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this P permit shall be final and binding. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built - upon area. The following items will require a modification to the permit: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area.' e. Further subdivision of the project area. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. In addition, the Director may determine that other revisions to the project should require a modification to the permit. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. II. SCHEDULE OF COMPLIANCE The permittee will comply with the following schedule for construction and maintenance of the stormwater management system: a. The stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface except roads. b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 2. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. g. Access to the outlet structure must be available at all times. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. Decorative spray fountains will not be allowed in the ponds. 5. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 7. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 8. Prior to the sale of any portion of the property, an access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale of any portion of the property. RI. GENERAL CONDITIONS 1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143- 215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. Permit issued this the 24th day of July, 1998. Deed Restriction Language The following statements must be recorded for all low density projects and for all projects that involve the subdivision and selling of lots or outparcels: 1. No more than square feet of any lot, including that portion of the right-of-way between the edge of pavement and the front lot line, shall be covered by impervious structures including asphalt, gravel, concrete, brick, stone, slate or similar material but not including wood decking or the surface of swimming pools. This covenant is intended to insure continued compliance with the stormwater permit issued by the State of North Carolina. The covenant may not be changed or deleted without the consent of the State. 2. No one Wray fill in, pipe, or alter any roadside swale except as necessary to provide a minimum driveway crossing. NOTE: If lot sizes vary significantly, the owner, developer must provide an attachment listing each lot number, size and the allowable built -upon area for each lot. For commercial projects that have outparcels or future development the following statements must also be recorded: 3. The connection front the outparcel orfuture area into the stormwater system must be made into the forebay such that short-circuiting of the system does not occur. 4. All built -upon area from the outparcel or fitture development must be directed into the permitted stormwater control system. 5. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. Please block off the overflow piping from the former infiltration pond inlet structure. For detention, all overflows must take place after the runoff has gone through the pond. You also have the option of raising the weir overflow by 1 foot, to the same elevation as the top of bank, 98.0. 2. Is the drainage area to the system unchanged from the previous infiltration approval? 3. Provide pavement, sidewalk and building dimensions. 4. The permit application must be signed by the Superintendent, or a signed agent authorization must be provided. 5. There was a mistake in the addition of the impervious surfaces on the previous submittal, which was corrected then, but is not shown now. Phillip Norris, P.E. • Fax 910/343-9604 We have been asked by New Hanover County Schools to respond to your letter of March 24, 1998 concerning the above project. First, it was an oversight that your inspection report dated October 6, 1997 was not responded to in writing. It was certainly not anyone's intention to ignore your concerns. In fact, before receipt of that letter and since its receipt, we have all been working with the contractor on the project to correct the failure of the infiltration system to function as designed. We are enclosing copies of a few construction observation reports from July 21, 1997 to January 7, 1998 which indicate our concerns about the construction of the infiltration area. We have been back and forth with the contractor to correct previous problems which included over -excavation of the infiltration area into the water table, over -filling of the area and incorrect construction of the outlet/inlet structures. As of today, we believe that the infiltration area now represents the design as permitted. However, as expressed in our construction observation report dated January 7, 1998, we are concerned that in the over -excavation, over -filling and re -grading of the infiltration area, compaction has taken place that has limited the ability of the soils to accept the stormwater. We had attempted to monitor this over the last month, but were hampered by the unusual rainfall events. With several weeks of dry weather, we had hoped that the system would ,respond in a positive fashion. However, a site visit today revealed that water was still in the infiltration area. Our preliminary design work shows that this is possible within the existing infiltration area footprint. We suggest the following schedule for your review and discussion for the redesign, permitting and construction of a wet pond system. 1. Submit package for NC DENR approval 4/3/98 '2. Allow 90 days for NC DENR review & approval; Obtain permit 7/3/98 3. Bid and construct pond and certify 8/20/98 *If this review time proves to be less then the schedule will be accelerated. Met on site 4:30 p.m. Purpose of the visit was to look at the stormwater infiltration area to determine if the contractor has made corrections that were requested in previous reports. During the visit, we measured the distance from the top of the grate to the top of the weir in the inlet structure. It measured 8". The plans call that the top of the weir should be 12" from the top of the grate. We recommend that the contractor come back and either cut a notch in the wall or either tear the wall down so the weir height is 12" below the top of the grate. Measured the water depth in the infiltration area itself by going into the pond wearing hip boots and using a tape. We had readings anywhere from 12" to 18" in depth. We feel that once the weir elevation has been revised as previously mentioned that the water depth in the infiltration area will be within tolerances allowable for that area. We are concerned that with the amount of construction activity that has taken place in the infiltration area from the contractor making repairs and placing material in the infiltration area due to his previous over excavation of that area that compaction of the subgrade may have taken place that would inhibit the infiltration rate of the existing soils. We hope that once the weir has been repaired that this will not prove to be the case. The purpose of the site visit was to look at the infiltration area to determine if corrections had been made per previous reports. It is apparent contractor has placed fill material in the infiltration area as suggested to bring it back up to the proper grade. There was no water observed to be standing anywhere in the infiltration area with the exception of the area near the inlet structure. I question whether the fill material has been placed at the proper grade. It appears that it might be higher now than the plans call for, but this can be only be substantiated by survey information. Also noted that at the inlet structure into the inlfiltration area, someone has broken down the baffle wall that separates the two chambers, rendering the structure useless, and certainly not certifiable. This will need to be repaired per project plans. Items that require revision are as follows: 1. The outlet structure that directs the water from the parking lot into the infiltration area has not been built correctly: It currently has grates on both side of the baffle wall. Details shown on the plans indicate that there should be a grate on the side of the box that leads directly to the pond. The other side of the box should only have an access, which is nothing more'than a manhole ring and cover. As the box currently exists, water can by-pass the infiltration area, which is not allowable under the permit. 2. Secondly, based on survey information provided by the Contractor, it is apparent that the infiltration area has been built lower than the plans call for. We are still not certain of the exact extent of that. The survey indicates that the inlet into the infiltration area is approximately 6-8 inches lower than what the plans indicate. Based on my site observaticns, I would assume that it is over -excavated anywhere from 1 to 1'/z feet. This cannot be determined without additional survey information and spot elevations in the infiltration area itself. The possibilities of ways to remedy this problem would be to bring in suitable fill material back to design grade, or secondly, to install some type of French drain system underneath or on the sides of the pond to allow water to soak through the soils and then go out into the adjacent ditch. %155 CONSTRUCTION OBSERVATION REPORT Project Name: Wrightsboro Elementary School Date: 7/21/97 Weather: Hot & Partly Cloudy Report: Project No. 96155 Contractor: Graka Builders 1. Conducted site visit this date to look at stormwater infiltration area. Observed that water was standing in the infiltration area. This area is designed to hold water for less than 5 days after a rainfall event. Based on previous site visits we have always seen water in the basin. We question whether the basin has been over excavated and suggest that the bottom elevation be confirmed by the contractor. 2. The side slopes on the basin are not built as shown on the plan. The plan contours indicate a gentle side slope of 4 or 5 to 1, which is mowable and not steep in appearance. This must be corrected. No indication of grassing was seen. Only weeds are growing on the pond banks. This has been an ongoing issue between the contractor and the engineer for over six (6) months. It is my understanding that the infiltration area should not hold water for more than five (5) days. I have never seen the area without standing water. There have been numerous conversations concerning this issue and the contractor has made unsuccessful attempts to correct the problem. I have heard excuses from it being a design problem to it being a installation problem. NCDEHNR has been more than reasonable and lenient in dealing with this matter. We are appreciative of their notice and grateful that they have given Lis the opportunity to respond. Please provide me and Mr. Rick Shiver, P.G., NCDEHNR Regional Supervisor, with an explanation for this violation and a detailed plan to resolve this issue. This plan must outline steps required to correct all violations and timelines for completing each step. The report is stating that the pond has not drawn down completely within 5 days of the last rain and DEHNR is requesting us to perform maintenance on the system to provide the required 5 day drawdown. They also state that the system may be redesigned as a detention pond. It is our understanding that the system is not constructed as designed and that the contractor is waiting for the pond to dry up before making the corrections agreed upon with the engineer. To my knowledge the pond has not been dry since mid summer. We may need to assist the drying process in some way to expedite corrective actions. Please discuss this issue with the engineer and contractor and collectively make a recommendation.
