On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any development approval issued by
the Division of Energy, Mineral and Land Resources under Article 21 of Chapter 143 of the General Statutes, which is
current and valid at any point between January 1, 2008, and December 31, 2010. The law extends the effective period of
any stormwater permit that was set to expire during this time frame up to three (3) years from its current expiration date.
On August 2, 2010, the Governor signed Session Law 2010-177, which granted an extra year for an extension of up to
four (4) years.
As a result, 120 USMC Camp Lejeune permits are impacted. Of the 120 permits, 45 permits have previously been
issued extensions and 75 permits have been extended effective today. This is summarized in Attachment A.

MCAS and MCIEAST are working on a pilot study to reduce geese usage in ponds near the
flightline in order to help the BASH program. The state has given us permission to plant
shrubs along the pond slopes to reduce line of sight for the geese. In order for us to do
this we had to submit 0&M addendums, which I dropped off to you this afternoon. The state
has already approved the 0&Ms and has requested that Carl sign the documents for their files.

The Division of Water Quality (DWQ) received a request from Lauren Acosta, Camp Lejeune
Environmental Office, to assist in a study to reduce Bird/Wildlife Aircraft Strike Hazard (BASH)
incidents at the Air Station. DWQ was asked to consider allowing the use of low profile, low
maintenance shrubs on the aquatic shelf of selected permitted wet detention ponds that have
high geese usage. The study approach proposes to decrease geese usage of the ponds by
planting shrubbery that will create cover for geese predators and steepen the takeoff/landing
angles for the geese. Basically the theory states that if the geese have to walk through high
vegetation, where predators could be hiding, to access a nearby feeding area, or if the angle of
takeoff and landing is too steep, then the geese may not find the pond a favorable habitat.
The study calls for the installation of four shrub species on the outer edge of the aquatic shelf,
Baccharis hamilifolia, Itea virginica, Lindera benzoin, and Ilex glabra. According to the
documentation submitted with the request, these species were chosen for the following reasons
1. The height should not exceed 4-5 feet above the top of the pond bank;
2. The fruits are not a significant food source for geese;
3. They can adapt to wet or dry growing conditions and low soil nutrients; and,
4. They are available for a December 2011/January 2012 planting period.

The Division is approving your request as proposed, subject to the following conditions:
1. Use as many non -deciduous shrub species as possible to avoid adding additional floating
debris to the pond.
2. Provide the Division with a copy of the final report of the study's conclusions.
3. Upon receipt of this approval letter send signed and dated copies of each "BASH Mitigation
— Stormwater Plantings Operation and Maintenance Agreement Addendum" to DWQ. This
agreement will be placed into the file for each Stormwater project listed above and will
become an enforceable part of that permit.
4. Notify the Division immediately of any compliance issues or nuisance maintenance
conditions that arise as a result of the use of these shrubs.
5. If the Division concludes that the use of the shrubbery creates a compliance issue or leads to
nuisance maintenance conditions, then the Division may require that the shrubs be removed
and the pond be restored to its original design condition.
