Paul The Wilmington Regional Office received a complete, modified Stormwater Management Permit Application for the subject project on December 20, 2017. Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000 (1995 Rules) as amended by Session Law 2008-211 and as subsequently amended on January 1, 2017 (2017 Rules), as applicable. We are forwarding modified Permit No. SW8 960329 dated January 2, 2018 for the construction, operation and maintenance of the stormwater control measures (SCMs), built -upon areas, as well as the stormwater collection system and/or vegetated conveyance system associated with the subject project. Please add the attached plans to the previously approved plan set. --101), the Infiltration Basin Supplement.for Drainage Area Please replace the previous application (SYi'U F, and an updated Operation and Maintenance (O&hI) Agreement for this infiltration basin with the attached modified versions. This permit shall be effective from the date of issuance until February 20, 2022 and shall be subject to the conditions and limitations as specified therein, and does not supersede any other agency permit that may be required. Please pay special attention to the permit conditions regarding the operation and maintenance of the SCA4s, stormwater collection system, and/or vegetated conveyances; the limitation of built -upon area; modification of the project; the procedures for changing ownership of and/or transferring the permit: and the need to renew the permit. Please also pay attention to the permit conditions that requires the recordation of deed restrictions and protective covenants, easements, and the maintenance agreement, which must all be provided along with certification upon completion of the project. Failure to comply with these requirements will result in future compliance problems. Please refer to Attachment 1 for a detailed description of the current proposed major modification and a list of all the past modifications approved during the effective period of this permit. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of this permit. This permit shall be effective from the date of issuance until February 20, 2022, and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. This stormwater system has been approved for the management of stormwater runoff as described in Sections 1.10 and 1.11 of this permit. The stormwater controls and drainage areas have been identified as follows and have been designed to handle the following amounts of build -upon area (BUA). The permit for SW8 090630 appears to have been modified on May 29, 2012 to include the additional built - upon area. Since this area is covered under both this permit; SW8 960329: and SW8 090630 any future improvements within the affected area will impact both permits. 4. The drainage area labeled "2017 Redevelopment' is exempted from State Stormwater permitting requirements under the following conditions: a. The project must be constructed as shown on the plans submitted to this Office, b. The total proposed built -upon area of 52,718 square feet does not exceed the existing built -upon area of 52,718 square feet: and, c. The proposed stormwater control, sheet flow over vegetated areas, provides equal protection of surface waters as the existing stormwater control, which is sheet flow over vegetated areas. 5. The additional infiltration areas located prior to the pond and as shown on the plans has not been demonstrated to meet State Stormwater BMP design requirements and therefore is not considered a part of the approved state stormwater treatment system. These additional measures are incorporated only by reference and are not enforceable parts of the permit. 6. A 50 foot wide vegetative buffer must be provided adjacent impounded structures, streams, rivers and tidal waters. 7. The wet detention ponds and infiltration basin do not require a vegetated filter strip. 8. The tract will be limited to the amount of impervious area indicated on the application and in Sections 1,2; 1.10, and 1.11 of this permit; and per approved plans. The built -upon area for future development within the drainage areas labeled J and "2017 Redevelopment' is limited to 10,000 and 5,730 square feet, respectively. Within the other drainage areas, there is no impervious area allocated for the future development. 9. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. 10. The runoff from all impervious areas within the permitted drainage areas of this project must be directed into the permitted stormwater control system within drainage areas labeled East (or G), West (or H); A, B, C, D, E, F, and J. Pretreatment devices have been provided for the infiltration basin treating Drainage Area F to prevent clogging. This project uses vegetated sheet flow. II. SCHEDULE OF COMPLIANCE No person or entity, including the permittee, shall alter any component of the approved stormwater system shown on the approved plans unless and until the Division has approved of the revised plan. 2. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. Infiltration BMP's that are used as Erosion Control devices shall be inspected and cleaned out on a more frequent basis during construction. The permittee shall at all time provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. G. Mowing and re -vegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structures, orifice devices, flow spreaders, infiltration media; catch basins and piping. a. Access to the outlet structure must be available at all times. Page 4 of 9 State Stormwater Management Systems Permit No. SW8 960329 5. Records of maintenance activities must be kept and made available upon request to authorized personnel of the Division. The records will indicate the date, activity; name of person performing the work and what actions were taken. 6. The facilities shall be constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. Decorative spray fountains will be allowed in the stormwater treatment system, subject to the following criteria: a. The fountain must draw its water from less than 2 foot below the permanent pool surface. b. Separated units, where the nozzle; pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond. c. The falling water from the fountain must be centered in the pond; away from the shoreline. d. The maximum horsepower for a fountain in this pond is identified in this permit Section 1.10. Ponds with less than 30,000 cubic feet of permanent pool volume may not have a fountain. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 9. Access to the stormwater facilities for inspection and maintenance shall be maintained via appropriate recorded easements at all times. 10. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Redesign or addition to the approved amount of built -upon area or to the drainage area. C. Further development, subdivision, acquisition, lease or sale of any, all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. d. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. e. The construction of any future BUA listed on the,application. 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee at all times. 12. Prior to transfer of the permit, the stormwater facilities will be inspected by Division personnel. The project and the stormwater facility must be in substantial compliance with all permit conditions. Any items not in substantial compliance must be repaired, replaced or restored to design condition prior to the transfer. Records of maintenance activities performed to date will be required. 13. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. GENERAL CONDITIONS Any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the Stormwater rules is subject to enforcement procedures as set forth in NCGS 143 Article 21. This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed Name/Ownership Change Form, accompanied by the supporting documentation as listed on the form, to the Division of Energy, Mineral and Land Resources at least 60 days prior to any one or more of the following events: a. An ownership change including the sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions: b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of Session Law 2011-256; c. Bankruptcy; d. Foreclosure, subject to the requirements of Session Law 2013-121: e. Dissolution of the partnership or corporate entity, subject to NCGS 57D-2-01(e) and NCGS 57D-6-07: f. A name change of the current permittee; g. A name change of the project, h. A mailing address change of the permittee; The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. Neither the sale of the project nor the conveyance of common area to a third party constitutes an approved transfer of the stormwater permit. 4. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local; state, and federal) having jurisdiction. 5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. Additional or replacement stormwater management systems shall receive a permit from the Division prior to construction. 6. The permittee grants Division Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 7. The permit remains in force and effect until modified, revoked, terminated or renewed. The permit may be modified. revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re -issuance or termination does not stay any permit condition. 8. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit to the extent necessary to maintain compliance with stormwater regulations. 10. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules and regulations contained in Session Law 2006-246, Title 15A NCAC 2H.1000, and NCGS 143-215.1 et.al. The renewal request must include the appropriate documentation and the processing fee. Permit modified and re -issued this the 2"O day of January 2018. Specifically, it is proposed that the existing 10 foot wide asphalt emergency access lane be widened to 12 foot wide. Additionally, an adjacent existing gravel parking area will be paved. As part of the proposed project, an existing concrete slab (prior basketball courts) will be replaced with a more substantial pavement section, providing an access point for emergency vehicles. A 2,500 SF administrative addition will be made along the north side of NH-100. The project occurs in two drainage areas as permitted under existing Stormwater Permit SW8 960329. Runoff occurs through Drainage Area "F" and the "Exemption Area" of the Naval Hospital complex. There is no established boundary for the "Exempt" area. After consultation with DEQ and the Base, an "Exempt" area drainage basin boundary was established to encompass the project areas. Runoff from Drainage Area "F" drains to Infiltration Basin "E". The existing BUA within this drainage basin exceeds the permitted BUA limits. As a part of this project, the existing infiltration basin will be enlarged slightly to provide the required storage volume from the BUA that presently exists and that which will be modified by this project. A portion of the Fire Lane project and all of the administrative office addition occurs in the "Exempt" area. Runoff in the exempt area basin generally occurs through sheet -flow action to vegetated areas surrounding the impermeable areas. This drainage pattern will be maintained and will not be altered by the proposed construction. There will be a net reduction in the "Exempt" Area of 5,730 SF. No collection systems or other means concentrating flow are proposed by this project. The project drains to Northeast Creek which is located in the White Oak River Basin. Northeast Creek has a Surface Water Classification of SC, NSW, HQW and a Stream Index of 19 —16 — (3.5). As a result of the removal of the gravel edge surfacing, a net reduction in impermeable surfaces will result from the completion of this project. The project occurs in three drainage areas as permitted under existing Stormwater Permit SW8 960329. Runoff occurs through Drainage Area "B", Drainage Area "E" and the "Untreated Area" of the Naval Hospital complex. A net reduction of impermeable surfaces will occur in each of these drainage areas as a result of this project. The net reduction of impermeable surfaces for each drainage area is proposed to be reserved for future development within each of these drainage areas. The enclosed calculations document the demolished and new impermeable surfaces by drainage area. The total net reduction of the BUA as a result of this project is 11,427 ft2. Runoff from Drainage Area "B" is treated by an existing stormwater retention pond (Pond B). No modifications will be made to this existing stormwater pond as a result of this project. Runoff from Drainage Area "E" drains to Infiltration Basin "F". No modifications will be made to this existing infiltration basin as a result of the completion this project. The hospital entry road relocation by another contractor is way behind schedule. As a result, the Medical Clinic's pond cannot be completely built at the front end of this project. The new road is roughed end by the roadway contractor. The pond will be built before the Medical Clinic is completed. The Medical Clinic construction project is awarded and the Base does not want to delay this contractor. The pond will not be available for use as a sedimentation basin during the initial part of the clinic construction. As a result, NAVFAC is asking us to design other temporary sediment basins in the interim - very quickly. i would like to know what we can do from an express permitting standpoint to receive approval. I would also like to verify that this is all good with our Stormwater Permit (Christine was the reviewer). I would appreciate your thoughts.
