Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified. Please note that any updated pages or addendums to the permit will now reference DEMLR as
the Division responsible for issuance of the permit.
Permit Transfer per Session Law (SL) 2013-121
On January 12, 2016, the Division of Energy, Mineral and Land Resources (DEMLR) received a
complete request to transfer ownership and to change the project name of the subject state stormwater
management permit under the provisions of Session Law 2013-121. A Notice of Deficiency datee-L
December 15, 2015 identified that the project was not in compliance with the terms and conditions of the
state stormwater permit. To address two of the identified deficiencies, an application to renew the permit
and a signed operation and maintenance agreement were submitted on January 20, 2016. The remaining
deficiency identified in the previously provided inspection report that will need to be addressed is as.
follows:
1. Permit condition 1.5 and 1.7: It appears that additional impervious area has been added along the
northern property line for a sidewalk and boat and trailer storage and along the utility easement
for a utility type building. Please confirm if changes have been made to the amount of built -upon

The Division has determined that the provisions of SL 2013-121 have been met as indicated by the
supporting documents and findings listed below:
1. The successor -owner of the property has submitted a written request for the transfer of the permit.
Reference is made to the attached signed Name/Ownership Change Form;
2. The original permit holder, Britts Self Storage, LLC, was lawfully and finally divested of title to
the property on which the permitted activity is occurring. Reference is made to bankruptcy case
No. 1 1-07688-8-JRL filed with the Eastern District of North Carolina,
3. The successor -owner holds title to the property on which the permitted activity is occurring.
Reference is made to the deed recorded on July 18, 2013 in Deed Book 4290 on Page 0247 on file
with the Pender County Register of Deeds.
4. The successor owner has not proposed any substantial changes to the permitted activity.
5. The updated permit does not impose new or different terms - it merely restates some of the
previous terms to provide you with a better understanding of your obligations under the permit.

includes the application and supplement forms you have accepted the responsibility for complying with '
the terms and conditions outlined in this permit, including the correction of the deficiencies outlined in
the inspection report. The Division is hereby notifying you that the subject permit has been transferred
and the project name has been changed on January 28, 2016 per the requirements of SL 2013-121.
Permit Renewal
On January 28, 2016 the Wilmington Regional Office received two (2) complete 8 year Stormwater
Management Permit Renewal Applications for 17 Storage, LLC. The Division is hereby notifying you that
permit SW8 960208 has been renewed on January 29, 2016, and shall be effective until May 29, 2022. The
plans originally approved on May 29, 1996, will remain in full force and effect in accordance with the
regulations set forth in Tide 15A NCAC 2H.1000 effective September 1, 1995.
For your records, please find enclosed an updated permit, a copy of the Name/Ownership Change form,
and a copy of the renewal application. Please keep this permit on file at all times. This permit is subject
to the conditions and limitations as specified in the updated permit
Please be aware that the project's built -upon area and stormwater controls must be built and maintained in
compliance with the permit documents and the approved plans. Maintenance of the approved system shall
be performed in accordance with the signed Operation and Maintenance agreement. Any modifications to
this project must be submitted to DEMLR and approved prior to construction. The issuance of this
approval does not preclude you from complying with all other applicable statutes, rules, regulations or
ordinances, which may have jurisdiction over the proposed activity, and obtaining a permit or approval
prior to construction.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings
(OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and
must be filed with the OAH within thirty (30) days of receipt of this permit. You should contact the OAH
with all questions regarding the filing fee (if a filing fee is required) and/or the details of the filing process
at 6714 Mail Service Center, Raleigh, NC 27699-6714, or via telephone at 919-431-3000, or visit their
website at www.NCOAH.com. Unless such demands are made this permit shall be final and binding.

following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater described in the
application and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as described
in the Project Data section on page 3 of this permit. The stormwater control has been designed to
handle the runoff from 31,800 square feet of impervious area.
3. Approved plans and specifications for this project are incorporated by reference and are
enforceable parts of the permit.

4. No property owner/developer shall fill in, alter, or pipe any vegetative practices (such as swales)
shown on the approved plans as part of the stormwater management system without submitting a
revision to the permit and receiving approval from the Division.

and per approved plans.
6. The permittee is responsible for verifying that the proposed built -upon area does not exceed the
allowable built -upon area.

7. ' The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
c. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision of the project area.
f.. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.
In addition, the Director may determine that other revisions to the project should require a
modification to the permit.
8. The Director may notify the permittee when the permitted site does not meet one or more of the
minimum requirements of the permit. Within the time frame specified in the notice, the permittee
shall submit a written time schedule to the Director for modifying the site to meet minimum
requirements. The permittee shall provide copies of revised plans and certification in writing to the
Director that the changes, have been made.
II. SCHEDULE OF COMPLIANCE
1. The permittee will comply with the following schedule for construction and maintenance of the
stormwater management system:
a. The stormwater management system shall be constructed in its entirety, vegetated and
operational for its intended use prior to the construction of any built -upon surface except roads.
b. During construction, erosion shall be kept to a minimum and any eroded areas of the system
will be repaired immediately.
2. The permittee shall at all times provide the operation and maintenance necessary to assure the
permitted stormwater system functions at optimum efficiency. The approved Operation and
Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled
intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal, based on results of inspections. Pond depth must be maintained at 2'.
c. Mowing side slopes during the growing season.
d. Immediate repair/revegetation of eroded areas and side slopes.
e. Monthly, or after a runoff -producing rainfall event, debris removal and unclogging of outlet
structure, orifice device and collection system, including catch basins and piping.
f. Access to the outlet structure must be available at all times.
3. Records of maintenance activities must be kept and made available upon request to authorized
personnel of the Division. The records will indicate the date, activity, name of person performing
the work and what actions were taken.
4. This permit shall become voidable unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other supporting data.
5. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to
operation of this permitted facility, a certification must be received from an appropriate designer for
the system installed certifying that the permitted facility has been installed in accordance with this
permit, the approved plans and specifications, and other supporting documentation. Any deviations
from the approved plans and specifications must be noted on the Certification.
6. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a
minimum of ten years from the date of the completion of construction.

III. GENERAL CONDITIONS
This permit is not transferable to any person or entity except after notice to and approval by
the Director. The permittee shall submit a completed and signed Name/Ownership Change
Form, accompanied by the supporting documentation as listed on the form, to the Division at
least 60 days prior to any one or more of the following events:
a. An ownership change including the sale or conveyance of the project area in whole or
in part;
b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's
Association, subject to the requirements of Session Law 2011-256;
C. Bankruptcy;
d. Foreclosure;
e. Dissolution of the partnership or corporate entity;
f. A name change of the current permittee;
g. A name change of the project,
h. A mailing address change of the permittee;
2. The permittee is responsible for compliance with all permit conditions until such time as the
Division approves the transfer request. Neither the sale of the project, in whole or in part, nor
the conveyance of common area to a third party constitutes an approved transfer of the
stormwater permit.
3. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to enforcement action by the Division of Environmental Management, in accordance
with North Carolina General Statute 143-215.6(a) to 143-215.6(c).
4. The issuance of this permit does not preclude the Permittee from complying with any and all
statutes, rules, regulations, or ordinances which may be imposed by other government agencies
(local, state, and federal) which have jurisdiction.
5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate corrective action, including those as may be
required by this Division, such as the construction of additional or replacement stormwater
management systems. Worn out components will be repaired/replaced per the approved design
specifications.
6. The permittee grants Regional Office Staff permission to enter the property for the purpose of
inspecting all components of the permitted stormwater management facility.
7. The permit may be modified, revoked and reissued or terminated for cause. The filing of a
request for a permit modification, revocation and reissuance or termination does not stay any
permit condition.
8. The issuance of this permit does not prohibit the Director from reopening and modifying the
permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws,
rules and regulations contained in Session Law 2008-211, Title 15A NCAC 2H.1000, and
NCGS 143-215.1 et. al.
9. The permittee shall submit a permit renewal application request at least 180 days prior to the
expiration date of this permit. The renewal request must include the appropriate application,
documentation and the processing fee.

A request to transfer a permit will not be approved by the Division of Water Quality (DWQ) unless all
of the applicable required items listed below are included with the submittal. Failure to provide the
listed items may result in processing delays or denial of the transfer.
1. This completed and signed form. This certification must be bompleted and signed _by both the

3. A copy of any recorded deed restrictions, covenants, or easements, if required by the permit.

6. The $40.00 processing fee. If this is an initial transfer from the original permittee the processing
fee is not required. Subsequent ownership transfers will require the $40.00 processing fee.

Request for Additional Information
The Wilmington Regional Office received and accepted an application to transfer and re -name
the State Stormwater Management Permit for Britt's Mini Storage on October 9, 2015 under the
provisions of Session Law 2013-131. A preliminary in-depth review of that information has
determined that the application is not complete. The following information is needed to continue
the stormwater review and transfer the permit:
15A NCAC 02H.1003(e): In the case of a corporation (including LLC), the application
must be signed by a manager of a manager -managed LLC. The documentation
available on the Corporation's Database with the NC Secretary of State does not list
Carolyn Duke as being a manager. Please either:
a. Provide official documentation demonstrating Ms. Duke is a manager of the LLC.
b. Provide a letter of authorization from one of the managers listed with the NC
Secretary of State allowing Ms. Duke to sign on their behalf.
2. Recommendation: Please confirm the project / permit name that is desired for the
permit. The Name/Ownership Change Form lists "17 Storage LLC" as the proposed
project name. Please confirm If "LLC" should remain in the title.
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received in this Office prior to January 20, 2016, or the
application will be returned as incomplete. The return of a project will necessitate resubmission
of all required items, including the application fee.
If you need additional time to submit the information, please mail, email or fax your request for a
time extension to the Division at the address and fax number at the bottom of this letter. The
.request must indicate the date by which you expect to submit the required information, which
shall be no later than 30 days past the original due date. The Division is allowed 90 days from
the receipt of a completed application to issue the permit.
Notice of Inspection
On December 15, 2015, the Wilmington Regional Office of the Division of Energy, Mineral and
Land Resources (DEMLR) inspected Britt's Mini Storage, located on Hwy 17 in Pender County
to determine the status of compliance with the State Stormwater Management Permit Number
SW8 960208 issued on May 29, 1996. DEMLR file review and site inspection revealed that the
site is not in compliance with the terms and conditions of this permit. Please find a copy of the
completed form entitled "Compliance Inspection Report" attached to this letter, which
summarizes the findings of the recent inspection.

15A NCAC 2H.1003 (h): This permit expired on May 29, 2006 and must be renewed.
The current renewal period is 8 years. In order to bring this permit into an active status,
two renewals are required to be submitted by the new owners as demonstrated below:
Renewal 1: May 29, 2006 + 8 years = May 29, 2014 (new expiration date)
Renewal 2: May 29, 2014 + 8 years = May 29, 2022 (new expiration date)

2. 15A NCAC 02H.1003(d)(2) and 02H.1008(i): An operation and maintenance agreement
could not be found in the file for the stormwater system. Please provide an operation
and maintenance plan signed by the responsible party. The operation and maintenance
plan shall indicate the specific actions that shall be taken, the quantitative criteria that
shall be used to determine when those actions must be taken, and who is responsible
for those actions. The plan shall also indicate what steps must be taken and who will be
responsible for restoring a system to design specifications if a failure occurs.
3. Permit condition 1.5 and 1.7: It appears that additional impervious area has been added
along the northern property line for a sidewalk and boat and trailer storage and along the
utility easement for a utility type building. Please confirm if changes have been made to
the amount of built -upon area or to the site layout. If changes have been made, please
submit a revision or modification to the permit once it has been transferred and renewed.
Since the application to transfer the permit was requested under the provisions of
Session Law 2013-121, the noted deficiencies will be addressed separately from the
transfer request. Please provide a plan of action, including a timeline to resolve the identified
deficiencies, by January 20, 2016. If the requested information and/or plan of action is not
submitted to this office by the due date, then DEMLR staff will re -inspect the site and may issue
a Notice of Violation. Please also note that any individual or entity found to be in
noncompliance with the provisions of a stormwater management permit or the stormwater rules
is subject to enforcement action as set forth in NCGS 143 Article 21, including the assessment
of civil penalties of up to $25,000 per day.

Guidelines for Access: The staff of Wilmington Regional Office is dedicated to making public records in
our custody readily available to the public for review and copying. We also have the responsibility to the
public to safeguard these records and to carry out our day-to-day program obligations. Please read

1. Due to the large public demand for file access, we request that you call at least a day in
advance to schedule an appointment to review the files. Appointments will be scheduled
between 9:00am and 3:00pm. Viewing time ends at 4:45pm. Anyone arriving without an
appointment may view the flies to the extent that time and staff supervision is available.
2. You must specify files you want to review by facility name. The number of files that you
may review at one time will be limited to five.
3. You may make copies of a file when the copier is not in use by the staff and if time permits.
Cost per copy is $.05 cents. Payment may be made by check, money order, or cash at the
reception desk. Copies totaling $5 00 or more can be invoiced for your convenience.
4. FILES MUST BE KEPT IN ORDER YOU FOUND THEM. Files may not be taken from
the office. To remove, alter, deface, mutilate, or destroy material in one of these files is a

On September 16, 2015, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) conducted a file review inspection of the Britts Mini Storage permit, located off
Highway 17 in Pender County to determine the status of compliance with the State Stormwater
Management Permit Number SW8 960208 issued on May 29, 1996. DEMLR file review revealed that
the site is not in compliance with the terms and conditions of this permit. Please find a copy of the
completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the
findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
Permit conditions 1.5 and 111.1: According to the Pender County GIS website and tax records, it
appears that the property associated with this permit, Britts Mini Storage, has been sold to 17
Storage, LLC. Upon further review of the file, it appears that the original permittee for this site,
Britt's Self Storage may have been lawfully and finally divested of the title of this property,
possibly due to bankruptcy. Per the aforementioned permit conditions, a request must be
submitted to the Division to transfer the ownership of the permit. If the original permittee, Britt's
Self Storage, has dissolved or has been lawfully and finally divested of the title to the property,
the current property owner, 17 Storage, LLC, must choose one of the options below:
a. Option 1: The new owner accepts the transfer of the current permit in accordance with
Session Law 2013-121. Please note that the first transfer is free and the permit
conditions remain the same as when the permit was originally issued under 15A NCAC
2H .1005 effective September 1, 1995, which is commonly referred to as the 1995
Coastal Rules.
In order to transfer the permit, please submit the appropriate Name/Ownership change
form available on our website at: http://portal.ncdenr.oM/web/Ir/state-stormwater-
forms docs along with the documentation necessary to transfer the permit to the new
owner. Please note that the "HOA Name/Ownership Change Form" is only for use by
permittees that have developed their project under the Planned Community Act. The
other "Name/Ownership Change Form" is for all other projects planning to change the
name of the project or transferring their permit to the new owner of the project.

b. Option 2: If the new owner refuses the current permit then they will have to apply
for their own permit. If they do not apply for a permit they will be issued a Notice
of Violation (NOV) including possible fines for owning and operating a treatment
system and discharging to surface waters without a permit. This option will not be
advantageous to the new owners because the new permit will be issued under
the 2008 Coastal Stormwater, Rules (Session Law 2008-211) unless a vested
right is presented which allows the project to be reviewed under the 1995 Coastal
Rules. However, keep in mind that vested rights are not granted to sites that are
in violation. This means the stormwater control measure must be redesigned
according to the standards in Session Law 2008-211 and the latest version of the
Stormwater Best Management Practices (BMP) manual. As a result, changes in
permit conditions and technical changes, such as the increase in the design
storm from 1.0 to 1.5 inches, may require significant and costly physical changes
to the BMPs currently serving the projects. All costs associated with the permit
application, the possible NOV, the design and the construction for changes to the
ponds will be the sole responsibility of the new owners.
2. 15A NCAC 2H.1003 (h): This permit expired on May 29, 2006 and must be renewed.
The current renewal period is 8 years. In order to bring this permit into an active status,
two renewals are required to be submitted by the new owners as demonstrated below:
Renewal 1: May 29, 2006 + 8 years = May 29, 2014 (new expiration date)
Renewal 2: May 29, 2014 + 8 years = May 29, 2022 (new expiration date)
The renewal application is available on the DEMLR website at:

3. Permit condition 11.5: Please submit a designer's certification for the project
demonstrating that the project has been installed in accordance with the permit,
approved plans and specifications, and other supporting documentation. Any deviations
from the approved plans and specifications must be noted on the certification.
Please inform this Office in writing before October 19, 2015, of the specific actions that will be
undertaken and the time frame that will be required to correct the deficiencies. Failure to provide
the requested information, or to respond to this letter by the due date, may initiate enforcement
action including the assessment of civil penalties of up to $25,000 per day. If a written plan of
action is not submitted to this office by October 12, 2015 then DEMLR staff will re -inspect the
site and issue a Notice of Violation if the listed deficiencies have not been addressed.
If the property covered by this permit has been/will be sold or legally conveyed to another entity
or if the permit holder has changed its name and/or mailing address, or if the project name has
been changed, it is your responsibility as the permittee to submit a completed and signed
Name/Ownership change form to DEMLR at least 30 calendar days prior to making the
changes. These forms are available on our website at: http://portal.ncdenr.org/web/Ir/state-

The Division of Water Quality issued a high density Stormwater Management Permit, Number SW8 960208
to Britt's Self Storage for the Britt's Self Storage project located off US 17 in Pender County on May 29,
1996. This permit expired on May 29, 2006. The Division of Water Quality recently discovered that a
Renewal Notification was never sent. However, per 15A NCAC 2H.1003(h) (the stormwater rules), it is
your responsibility to submit an application to renew the permit 180 days prior to the expiration of a permit.
If this is still an active project please complete and submit the enclosed renewal application along with the
processing fee, which is currently set at $505.00 prior to June 3, 2013. If this project has not been
constructed and a permit is no longer needed, please submit a request to have the permit rescinded. If you
have sold the project please provide the name, mailing address and phone number of the person or entity
that is now responsible for this permit. Enclosed is a form for change of ownership, which should be
completed and submitted if the property has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted
stormwater treatment system, a certification of completion be submitted to the Division from an appropriate
designer for the type of system installed. This is to certify that the permitted facility has been installed In
accordance with the permit, the approved plans, specifications and supporting documentation. If you have
not already provided a Designer's Certification to our office, please include a copy with your permit renewal
request and processing fee. A copy of the certification form is enclosed for your convenience.
You should be aware that failure to provide the Designer's Certification and the operation of a stormwater
treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and may result in
appropriate enforcement action Including the assessment of civil penalties of up to $25,000 per day.
If a renewal application is not submitted prior to June 3, 2013, enforcement actions may be initiated, which
may include the assessment of civil penalties. If you have any questions, please feel free to contact Christine
