On August 20, 1997, the Wilmington Regional Office received a copy of the Notice of Violations of the
Sedimentation Pollution Control Act for Britt's Mini Storage. The North Carolina Administrative Code requires any project
that must receive either a Sedimentation and Erosion Control Plan permit and/or a CAMA major permit to apply for and
receive a Stormwater Management Permit by the Division of Water Quality. Any construction on the subject site, prior
to receipt of the required permit, will constitute a violation of 15A NCAC 2H.1000 and may result in appropriate
enforcement action by this Office.
Either a Stormwater Permit Application Package including 2 sets of plans, completed application form, fee, and
supporting documentation, or a written response regarding the status of this project and the expected submittal date must
be received in this Office no later than September 20, 1997, or the subject project file will be closed and construction may
experience a subsequent delay. Please reference the Project Number above on all correspondence. If you have any

NOTICE OF VIOLATIONS OF THE
SEDIMENTATION POLLUTION CONTROL ACT

Dear Mr. Britt:
On August 14, 1997, personnel of this office inspected a project located US Hwy 17 South of
Hampstead in Pander County, North Carolina. This inspection was performed to determine compliance
with the North Carolina Sedimentation Pollution Control Act of 1973. The inspection revealed a land -
disturbing activity.
It is our understanding that you and your firm are responsible for this land -disturbing activity.
The purpose of this letter is to inform you that this activity was found to be in violation of the Act,
NCGS 113A-50 to 66, and Title 15A, North Carolina Administrative Code, Chapter 4. If you feel that
you are not responsible for the following violations, please notify this office immediately.
The violation that was found is:
1. Failure to file an erosion and sedimentation control plan with this office at least 30 days prior
to beginning a land -disturbing activity on a tract comprising more than one acre, when more
than one acre.is to be uncovered, failure to secure this office's prior approval of the plan for
any land -disturbing prior to beginning the land -disturbing activity. NCGS 113A-57(4) and 15A
NCAC 46.00O7(c).
An erosion and sedimentation control plan has not been submitted for this phased development.
Once the one acre threshold is reached, each phase, regardless of size must be permitted.
To correct this violation, you must:
Supply the Land Quality, office with an erosion and sedimentation control plan.

Please be advised that if these violations are not corrected within 20 days of receipt of this
notice, the Director, Division of Land Resources, will be requested to take appropriate legal action
against you pursuant to NCGS 113A-64. That action could be the assessment of a civil penalty and
the amount may be up to $500 per day for each day of the violation. The penalty may be assessed
from the date of your receipt of this Notice of Violation. (15A NCAC 4C.0007). If these violations
are corrected within the time period specified for compliance, no further legal action will be pursued.
Please be advised that any.new land -disturbing activity associated with this project must not
begin until the area presently disturbed is brought into compliance with the Act. When corrective
actions are complete, you should notify this office so the work can be inspected. You should not
assume that the property is in compliance with the Act until we have notified you. After installation,
all erosion control measures must be maintained in proper working order until development is complete
and the site is completely stabilized.
We solicit your cooperation, and would like to avoid taking further enforcement action. At the
same time, it is your responsibility to understand and comply with the requirements of the Act. Copies
of the relevant statute and administrative rules may be examined at this office or will be sent to you
upon request. Should you have questions concerning this Notice or the requirements of the Act,
please contact either Janet Paith or me at your earliest convenience.

The Wilmington Regional Office received your December 19, 1995 response letter concerning the
Notice of Violation issued to Mr. Roy Britt for the project, Britt's Self Storage, located in Pender County,
North Carolina. The letter essentially requests that the State consider the date that the building permit was
issued to decide whether this project is subject to the new stormwater rules or not. The project had
disturbed more than 1 acre of land, and the Land Quality Section required an Erosion Control plan to be
filed, consequently, a stormwater permit was required.
The Central Office in Raleigh and the Attorney General's Office have already made the
determination that any project that was not received in this Office prior to September 1, 1995, is subject
to the new rules. In addition, the rules clearly require that any project that is required to receive an Erosion
Control Plan permit is required to apply for and receive a Stormwater Management Permit. If there was
any indication that more than 1 acre of land would be disturbed, or if the site was very tight, the option
to file an Erosion Control Plan was always open. Lack of oversight during construction does not mean that
the rules can be ignored. A site that is close to completion will be difficult to go back and design to meet
the stormwater regulations, however, that is the chance that was taken when the option to continue working
without an Erosion Control plan was followed.
It is my understanding that you have contacted Mr. Jim Craig for advice, and he indicated that
given the amount of land in the tract, the project may be considered as low density. Please be aware that
pockets of high density are routinely disallowed under the low density option, however, additional BMP's
may be designed to treat the runoff.

Stormwater Management Permit for this site.

On December 12, 1995, Wilmington Regional Office personnel received a copy of the Notice of
Violation issued by the Land Quality Section for exceeding 1 acre of disturbance without an approved plan.
The project is located off Highway 17, south of Hampstead, in Pender County, North Carolina.
The project has been found in violation of the Stormwater Management Rules for failing to apply
for a Stormwater Management Permit. All projects in the 20 coastal counties that are required to obtain
Erosion Control Plan approval or a CAMA Major permit must apply for and receive a Stormwater
Management Permit.
To correct this violation you must :
1. Provide a written "Plan of Action" which outlines the actions you will take to correct the
violation and a time frame for completion of those actions, on or before January 12, 1996.
2. Submit 2 sets of plans, application form, fee, and supporting documentation for the project,
per the requirements of NCAC 2H.1000.

Failure to provide the "Plan of Action" by January 12, 1996, or to correct the violations by the date
designated in the "Plan of Action", are considered violations of 15A NCAC 2H.1000, and may result in
the initiation of enforcement action which may include recommendations for the assessment of civil and
criminal penalties, pursuant to NCGS 143-215.6A.
By copy of this letter to the Pender County Building Inspector, this Office is requesting that
the Building Inspector consider withholding building permits and Certificates of Occupancy for this
project until this matter is satisfactorily resolved.

Guidelines for Access: The staff of Wilmington Regional Office is dedicated to making public records in

Dear Mr. Britt:
On October 25, 1996, Wilmington Regional Office personnel performed a Compliance Inspection
of the project known as Britt's Self Storage, located off Highway 17 south of Hampstead in Pender
County, North Carolina. The inspection was performed to determine the status of compliance with
Stormwater Permit Number SW8 960208, issued to you on May 29, 1996.
The project has been found in violation of Stormwater Permit Number 960208, issued pursuant to
the requirements of 15A NCAC 2H.1000. The violations found are:
1. Section II, No. 1- The stormwater management system has not been constructed.
To correct this violation you must :
1. Provide a written "Plan of Action" which outlines the actions you will take to correct the
violation and a time frame for completion of those actions, on or before November 25,
1996.
2. Construct the stormwater management system per the approved plans within 60 days.

Failure to provide the "Plan of Action" by November 25, 1996, or to correct the violations by the
date designated in the "Plan of Action", are considered violations of 15A NCAC 2H.1000, and may result
in the initiation of enforcement action which may include recommendations for the assessment of civil and
criminal penalties, pursuant to NCGS 143-215.6A. The date designated in the "Plan of Action' must be
reasonable, and may not exceed 60 days.
By copy of this letter to the Pender County Building Inspector, this Office is requesting that the
Building Inspector consider withholding building permits and Certificates of Occupancy for this project
until this matter is satisfactorily resolved.
