All additions or revisions to originally approved plans and specifications are also r bject to approval by the Architectural Committee. This includes changes to exterior color. Section 7. The Association shall not have any authority to require any modification to the interiors of residences not visible from outside of the dwelling. Section 8. ARTICLE VI PARTY WALLS Section 1. General Rules of Law to Apply. Each wall which is built as a part of the original construction of the homes upon the Properties and placed on the dividing line between the Lots shall constitute a party wall, and, to the extent not inconsistent with the provisions of this Article, the general rules of law regarding party walls and of liability for property damage.due to negligence or willful acts or omission shall apply thereto. The wti i° 0n regional 0ffic5 cost of reasonable repair and maintenance of a party wall shall be shared by the Owner who makes use of the wall in proportion to such use. Section 3. Destruction by Fire or Other Casualty. If a party wall is destroyed or damaged by fire or other casualty, any Owner who has used the wail may restore it, and if the other Owners thereafter make use of the wall, they shall contribute to the cost of restoration thereof in proportion to such use without prejudice, however, to the right of any such Owner to call for a larger contribution from the others under any rule of law regarding liability for negligent or willful acts or omission. Section 4. Weatherproofing. Notwithstanding any other provision of this Article, an Owner who by his negligent or willful act causes the party wall to be exposed to the elements shall bear the whole cost of furnishing the necessary protection against such elements. Section 5. Right to Contribution Runs With Land. The right of any Owner to contribution from any other Owner any holder, insurer or guarantor of any first mortgage ,that is secured by a Lot within the development. Section 6. Arbitration. Any controversy or claim arising out of or relating to this Article VI, or the breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgement on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. It is the understanding of this office that an Erosion and Sedimentation Control Plan or a CAMA Major Permit was not required for your project, thus your project is exempt from stormwater regulations set forth in Title 15 NCAC 2H .1003. However, please be reminded that at such time as an Erosion & Sedimentation Control Plan or a CAMA Major Permit are required, a Stormwater Management Plan will be required. We are not required to submit for an erosion and sedimentation control permit or a CAMA Major permit. According to the regulations we are therefore exempt. We feel certain we could meet the low density option anyway. Therefore if we did submit the end result would be the same. Thank you for your assistance further. ------------------------- Dominick S.
