On August 24, 2015, the Wilmington Regional Office received a request to revise the approved
plans for Stormwater Management Permit Number SW8 141106. The revisions include relocation .
of the building and parking lot slightly northward to provide a County required landscape buffer
between the project and the adjacent residential home. In addition, some piping was converted into
a drainage swale. There was no additional built -upon area constructed. It has been determined
that a formal permit modification is not required for the proposed changes. We are forwarding you
an approved copy of the revised plans for your files. Please replace the old approved plan sheets
with the new ones.
Please be aware that all terms and conditions of the permit issued on November 25, 2014,
remain in full force and effect. Please also understand that the approval of this revision to the
approved plans or to the permit for the subject State Stormwater project is done on a case -by -
case basis. Any other changes to this project must be approved through this Office prior to
construction. The issuance of this plan revision does not preclude the permittee from complying
with all other applicable statutes, rules, regulations or ordinances which may have jurisdiction
over the proposed activity, and obtaining a permit or approval prior to construction.
If the property for this project has been/will be sold or legally transferred to another entity OR, the
project or permit holder has changed its name and/or mailing address, it is your responsibility as
the permittee to submit a completed and signed Name/Ownership change form to DEMLR at least
30 calendar days prior to making the changes. These forms are available on our website at:

2) Two (2) sets of design drawings, Sheets C-1---C-4, dated 8-1-14, last revised 3-21-15.
In order to meet Brunswick County's buffer requirements between commercial and residential uses the
proposed building and associated parking had to be moved northward. This revision did not increase the
proposed impervious areas or the proposed drainage patterns previously permitted.

I don't know what was in their minds, but the site is under construction. The changes do affect the permitted
stormwater system, so technically, those changes needed to be reviewed BEFORE they build to make sure what they
want to do is OK. The addition of a retaining wall has the potential to cause a complete redesign of the system.

I talked with Jean and we compared the emailed plans she got from the engineer (Arnie Drucker) with the approved
stormwater plans and there are some fairly significant changes. The site is low and is being filled in, but there were no
retaining walls shown on our approved plan and one of the building corners is right at the wetlands line.
Jean included a request for a signed stormwater plan revision application and 2 sets of revised plans in her NOV to Mr.
Elia. I am a bit surprised that Arnie did not submit the new plans to us before construction started. I though she knew
better than that.

Thank you for you quick response to the NOV for Hazy Plaza. Unfortunately, the electronic pdf is not acceptable. A
signed plan revision application form and 2 copies of the revised plans will need to be submitted for state stormwater
approval.
Also, the NOV requires a revised sedimentation and erosion control plan showing how sediment and vegetation will be
contained along the steep slopes adjacent to wetlands at rear of building, which has not been addressed.
Please contact Linda Lewis for questions regarding State Stormwater or me if you need further information for sediment
and erosion control. `
I plan to inspect the site again this week and hope to find the silt fences repaired and sediment removed from offsite
and the wetlands.

design drawings. The building and associated parking were moved north to meet Brunswick County's buffer
requirements between the proposed commercial use and the adjacent existing residential home south of the project.
The proposed impervious area for the site was slightly reduced with this revision. The permitted impervious area is
45,058 sf and the revised proposed impervious area is 44,517 sf (Building 12,710 sf + Walks 3,154 sf+ Pavement 28,653
sf)

Compliance (Deadline: August 7, 2015 or 7 days from receipt of this Notice
Dear Hazy Elia:
On July 27, 2015 personnel ofthis office inspected a project located on Holden Beach Rd., Lockwood Folly Township in
Brunswick County, North Carolina. This inspection was performed to determine compliance with the North Carolina
Sedimentation Pollution Control Act (Act) of 1973. The inspection revealed a land -disturbing activity of approximately
1.43 acres being conducted.
It is our understanding that you and/or your firm are responsible for this land -disturbing activity. The purpose of this
letter is to inform you that this activity was found to be in violation of the Act, G.S. 113A-50 to 66, Title I5A, North
Carolina Administrative Code (NCAC), Chapter 4. If you feel that you are not responsible for the following violations,
please notify this office immediately.
The violations that were found are:
A. Failure submit revised plan - G.S. I I3A-54.1(b) and 15A N.C.A.A. 413.0118(a)
B. Graded slopes and fills too steep - G.S. 113A-57(2) or 15A N.N.413.0124
C. Insufficient measures to retain sediment on site - G.S. 113A-57(3)
D. Failure to take all reasonable measures - 15A N.C.A.C. 4B.0105
E. Failure to install and maintain BMPs and control measures - NCG 010000 Section III. (4)
To correct these violations, you must:
1. Submit a revised sedimentation and erosion control plan for approval for the following areas: at rear ofbuilding
showing how sediment and vegetation will be contained along steep slopes adjacent to wetlands.
2. Submit a revised State Stormwater plan for approval to account for recent changes to stormwater flow
pattem/discharge and additional impervious areas.
3. Install erosion and sediment control devices and proper silt fences, sufficient to retain sediment on the tract.
4. Take all reasonable measures to prevent sedimentation damage to adjacent property such as the following:
Wetlands onsite and neighboring property.
5. Remove sediment from neighboring property and wetlands.

The violations cited herein may be referred to the Director of the Division of Energy, Mineral, and Land'Resources
(Director) for appropriate enforcement action, including civil penalty assessments for an initial one -day violation and/or a
continuing violation. The penalty for an initial one -day violation may be assessed in an amount not to exceed $5;600.00.
The Division of Energy, Mineral, and Land Resources is not required to provide a time period for compliance before
assessing an initial penalty for the violations cited herein. Please be advised that a civil penalty may be assessed for the
initial day of violations regardless of whether the violations are corrected within the time period set out below.
In addition, if the violations cited herein are not corrected within 7 days of receipt of this notice or before August 7
whichever term is longer, this office may request that the Director take appropriate legal action against you for continuing
violations pursuant to NCGS 113A-61.1 and 113A-64. A penalty may be assessed from the date of the violation,
pursuant to NCGS 113A-64(a)(1), and for each day of a continuing violation in an amount not to exceed $5,000.00 per
day.
Please be advised that any new land -disturbing activity associated with this project should not begin until the area
presently disturbed is brought into compliance with the Act. When corrective actions are complete, you should notify
this office so that work can be inspected. You should not assume that the project is in compliance with the Act until we
have notified you. After installation, all erosion control measures must be maintained in proper working order until the
site is completely stabilized.
We solicit your cooperation, and would like to avoid taking further enforcement action. At the same time, it is your
responsibility to understand and comply with the requirements of the Act. Copies of the relevant statute and
administrative rules may be examined at this office or will be sent to you upon request. Should you have questions
concerning this notice or the requirements of the Act please contact either Wilmington Regional Office or me at your
earliest convenience.

I was wondering if you might be able to answer a few questions that I have about Hazy's Plaza near Holden Beach, Jean
Conway with Land Quality brought the site to my attention and mentioned that the site plan that she saw on site (from
03-21-15 but did not have a copy of) had added some sidewalks and that there may be some wetland impacts based
upon their location on the March plan. Also, some of the stormwater design may have changed as well? I pulled the
State SW file (14-1106) and the most recent approved plans were from 11-25-15. 1 have copied Jean and Georgette
Scott on this email in case something erosion control or State SW needs to be changed but I only have authority over the
wetlands. If there are plans for sidewalks or any other wetland impacts please let me know.

Dear Hazy Elia:
On July 27, 2015 personnel ofthis office inspected a project located on Holden Beach Rd., Lockwood Folly Township in
Brunswick County, North Carolina. This inspection was performed to determine compliance with the North Carolina
Sedimentation Pollution Control Act (Act) of 1973. The inspection revealed a land -disturbing activity of approximately
1.43 acres being conducted.
It is our understanding that you and/or your firm are responsible for this land -disturbing activity. The purpose of this
letter is to inform you that this activity was found to be in violation of the Act, G.S. 1 13A-50 to 66, Title 15A, North
Carolina Administrative Code (NCAC), Chapter 4. If you feel that you are not responsible for the following violations,
please notify this office immediately.
The violations that were found are:
A. _Failure submit revised plan Q.S. 113A-54.1(b) and 15A N.C.A.A. 4B.0118(a)
B. Graded slopes and fills too steep - G.S. 1 13A-57(2) or 15A N.N.413.0124
C. Insufficient measures to retain sediment on site - G.S. 113A-57(3)
D. Failure to take all reasonable measures - 15A N.C.A.C. 4B.0105
E. Failure to install and maintain BMPs and control measures - NCG 010000 Section 111. (4)
To correct these violations, you must:
1. Submit a revised sedimentation and erosion control plan for approval for the following areas: at rear of building
showing how sediment and vegetation will be contained along steep slopes adjacent to wetlands.
2. Submit a revised State Stormwater plan for approval to account for recent changesto stormwater flow'
pattern/discharge and additional impervious areas.
3. Install erosion and sediment control devices and proper silt fences, sufficient to retain sediment on the tract.
4. Take all reasonable measures to prevent sedimentation damage to adjacent property such as the following:
Wetlands onsite and neighboring property.
5. Remove sediment from neighboring property and wetlands.

The violations cited herein may be referred to the Director of the Division of Energy, Mineral, and Land Resources
(Director) for appropriate enforcement action, including civil penalty assessments for an initial one -day violation and/ora
continuing violation. The penalty for an initial one -day violation may be assessed in an amount not to exceed $5,000.00.
The Division of Energy, Mineral, and Land Resources is not required to provide a time period for compliance before
assessing an initial penalty for the violations cited herein. Please be advised that a civil penalty may be assessed for the
initial day of violations regardless of whether the violations are corrected within the time period set out below.
In addition, if the violations cited herein are not corrected within 7 days of receipt of this notice or before August 7
whichever term is longer, this office may request that the Director take appropriate legal action against you for continuing
violations pursuant to NCGS 113A-61.1 and 113A-64. A penalty may be assessed from the date of the violation,
pursuant to NCGS 113A-64(a)(1), and for each day of a continuing violation in an amount not to exceed $5,000.00 per
day.
Please be advised that any new land -disturbing activity associated with this project should not begin until the area
presently disturbed is brought into compliance with the Act. When corrective actions are complete, you should notify
this office so that work can be inspected. You should not assume that the project is in compliance with the Act until we
have notified you. After installation, all erosion control measures must be maintained in proper working order until the
site is completely stabilized.
We solicit your cooperation, and would like to avoid taking further enforcement action. At the same time, it is your
responsibility to understand and comply with the requirements of the Act. Copies of the relevant statute and
administrative rules may be examined at this office or will be sent to you upon request. Should you have questions
concerning this notice or the requirements of the Act please contact either Wilmington Regional Office or me at your
t earliest convenience.
