The Wilmington Regional Office received a complete, modified State Stormwater Management Permit
Application for the subject project on November 21, 2017. Staff review of the plans and specifications
has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in
Title I5A'NCAC 2H.1000 and Session Law 2008-211. It has been determined that the nature of the
proposed change meets the definition of a minor modification in that it does not result in an increase in
the size of the permitted stormwater control measure (SCM) and does not increase the amount of built -
upon area. We are forwarding modified Permit No. SW8 1408041 dated November 21, 2017, for the
construction, operation and maintenance of the stormwater control measures (SCMs),- built -upon areas, as
well as the stormwater collection system and/or vegetated conveyance system associated with the subject
project. Please add the attached plans to the previously approved plan set. Please replace the previous
application (Sli'U=101) and operation and maintenance agreement with the attached modified versions.
This permit shall be effective from the date of issuance until August 5, 2022 and shall be subject to the
conditions and limitations as specified therein, and does not supersede any other agency permit that may
be required. Please pay special attention to the conditions listed in this permit regarding the Operation
and Maintenance of the BMP(s), recordation of deed restrictions, procedures for changes of ownership,
transferring the permit, and renewing the permit. Failure to establish an adequate system for operation
and maintenance of the stormwater management system, to record deed restrictions, to transfer the permit,
or to renew the permit, will result in future compliance problems.
The following modifications are included and covered by this permit:
1. The site layout on Lot 2 for the proposed Dollar "free.
2. The addition of Shallotte Investments, LLC, owner of Lot 2, as a co-permittee.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings
(OAH). The written petition must conform to Chapter 15013 of the North Carolina General Statutes and
must be filed with the OAH within thirty (30) days of receipt of this permit. You should contact the OAH
with all questions regarding the fling fee (if a filing fee is required) and/or the details of the filing process

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction, operation and maintenance of one (1) wet detention pond in compliance with
the provisions of 15A NCAC 2H .1000 and Session Law 2008-211 (hereafter collectively
referred to as the "stormwater rules') the approved stormwater management plans and
specifications and other supporting data as attached and on file with and approved by the
Division of Energy, Mineral and Land Resources (the "Division" or "DEMLR") and considered
an enforceable part of this permit.
This permit shall be effective from the date of issuance until August 5, 2022, and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data. The maximum amount of built -
upon area (BUA) allowed for the entire project is 69,300 square feet.
2. This stormwater system has been approved for the management of stormwater runoff
as described in Section 1.7 of this permit. The runoff from all built -upon area within the
permitted drainage area of this project must be directed into the permitted stormwater
control measure. The stormwater control measure has been designed to handle the
runoff from 69,300 square feet of impervious area.
The tract and drainage areas will be limited to the amount of built -upon area indicated
in this permit and per approved plans. The built -upon area for the future development
is limited to 6,758 square feet.
4. Since this site is being redeveloped, a 30' wide vegetative buffer must be provided
and maintained adjacent surface waters, measured horizontally from and
perpendicular to the normal pool of impounded structures, the top of bank of both
sides of streams and rivers and the mean high water line of tidal waters.
All runoff being directed into wetlands shall flow into and through those wetlands at a
non -erosive velocity.

All stormwater collection and treatment systems must be located in either dedicated
common areas or recorded easements. The final plats for the project will be recorded
showing all such required easements, in accordance with the approved plans.

No person or entity, including the permittee, shall alter any component of the approved
stormwater system shown on the approved plans unless and until the Division has
approved of the revised plan.
2. The stormwater management system shall be constructed in its entirety, vegetated
and operational for its intended use prior to the construction of any built -upon surface.
3. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately. If the stormwater system was used as an
Erosion Control device, it must be restored to design condition prior to operation as a
stormwater treatment device, and prior to occupancy of the facility.
4. The permittee shall, at all times, provide the operation and maintenance necessary to
assure the permitted stormwater system functions at optimum efficiency. The signed
and approved Operation and Maintenance Agreement must be followed in its entirety
and maintenance must occur at the scheduled intervals.
5. Records of maintenance activities must be kept and made available upon request to
authorized personnel of the Division. The records will indicate the date, activity, name
of person performing the work and what actions were taken.
6. Decorative spray fountains will not be allowed in the stormwater treatment system, as
the permanent pool volume is less than 30,000 cubic feet.
7. The facilities shall be constructed in accordance with the conditions of this permit, the
approved plans and specifications, and other supporting data.

- 8. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that the permitted facility has
been installed in accordance with this permit, the approved plans and specifications,
and other supporting documentation. Any deviations from the approved plans and
specifications must be noted on the Certification. A modification may be required for
those deviations.
Access to the stormwater facilities for inspection and maintenance shall be maintained
via appropriate recorded easements at all times.
10. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
C. Further development, subdivision, acquisition, lease or sale of any, all or part of
the project area. The project area is defined as all property owned by the
permittee, for which Sedimentation and Erosion Control Plan approval or a
CAMA Major permit was sought.
d. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
e. The construction of any future BUA listed on the application.
11. Prior to transfer of the permit, the stormwater facilities will be inspected by Division
personnel. The project and the stormwater facility must be in substantial compliance
with all permit conditions. Any items not in substantial compliance must be repaired,
replaced or restored to design condition prior to the transfer. Records of maintenance
activities performed to date will be required.
12. The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit. Within the time frame specified in
the notice, the permittee shall submit a written time schedule to the Director for
modifying the site to meet minimum requirements. The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been
made.
13. Approved plans and specifications for this project are incorporated by reference and
are enforceable parts of the permit. A copy of the approved plans and specifications
shall be maintained on file by the Permittee at all times.
III. GENERAL CONDITIONS
Any individual or entity found to be in noncompliance with the provisions of this
storrmwater management permit or the requirements of the Stormwater rules is
subject to enforcement procedures as set forth in G.S. 143 Article 21.
2. The issuance of this permit does not preclude the Permittee from complying with any
and all statutes, rules, regulations, or ordinances, which may be imposed by other
government agencies (local, state, and federal) having jurisdiction.
3. In the event that the facilities fail to perform satisfactorily, the Permittee shall take
immediate corrective action, including those as may be required by this Division, such
as the construction of additional or replacement stormwater management systems.
Additional or replacement stormwater management systems shall receive a permit
from the Division prior to construction.

4. This permit is not transferable to any person or entity except after notice to and
approval by the Director. The permittee shall submit a completed and signed
Name/Ownership Change Form, accompanied by the supporting documentation as
listed on the form, to the Division of Energy, Mineral and Land Resources at least 60
days prior to any one or more of the following events:
a. An ownership change including the sale or conveyance of the project area in
whole or in part, except in the case of an individual lot'sale that is made subject to
the recorded deed restrictions,
b. The sale or conveyance of the common areas to a Homeowner's or Property
Owner's Association, subject to the requirements of Session Law 2011-256;
c. Bankruptcy;
d. Foreclosure, subject to the requirements of Session Law 2013-121;
e. Dissolution of the partnership or corporate entity, subject to NCGS 57D-2-01(e)
and NCGS 57D-6-07,
f. A name change of the current permittee;
g. A name change of the project;
h. A mailing address change of the permittee;
5. The permittee is responsible for compliance with all permit conditions until such time
as the Division approves the transfer request. Neither the sale of the project, in whole
or in part, nor the conveyance of common area to a third party constitutes an
approved transfer of the stormwater permit.
6. The permittee grants Division Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
7. The permit remains in force and effect until modified, revoked, terminated or renewed.
The permit may be modified, revoked and reissued or terminated for cause. The filing
of a request for a permit modification, revocation and re -issuance or termination does
not stay any permit condition.
8. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit as
allowed by the laws, rules and regulations contained in Session Law 2006-246, Title
15A NCAC 2H.1000, and NCGS 143-215.1 et.al.
10. The permittee shall submit a permit renewal request at least 180 days prior to the
expiration date of this permit. The renewal request must include the appropriate
documentation and the processing fee.

Certification Requirements:
1. The drainage area to the system contains approximately the permitted acreage.
2. The drainage area to the system contains no more than the permitted amount
of built -upon area.
3. All the built -upon area associated with the project is graded such that the runoff
drains to the system.
4. All roof drains are located such that the runoff is directed into the system.
5. The outlet structure elevations are per the approved plan.
6. The outlet structure is located per the approved plans.
7. Trash rack is provided on the outlet structure.
8. All slopes are grassed with permanent vegetation.
9. Vegetated slopes are no steeper than 3:1.
10. The inlets are located per the approved plans and do not cause short-circuiting
of the system.
11. The permitted amounts of surface area and/or volume have been provided.
12. Required drawdown devices are correctly sized and located per the approved
plans.
13. All required design depths are provided.
14. All required parts of the system are provided, such as a vegetated shelf, and a
forebay.

V. SUPPLEMENT AND O&M FORMS
The applicable state stormwater management permit supplement and operation and maintenance (O&M) forms
must be submitted for each BMP specified for this project. The latest versions of the forms can be downloaded

VI. SUBMITTAL REQUIREMENTS
Only complete application packages will be accepted and reviewed by the Division of Energy, Mineral and

THIS AMENDED AND RESTATED OPERATING AGREEMENT (the "Agreement")
of SHALLOTTE INVESTMENTS, LLC, a North Carolina limited liability company (the
"Company"), is made effective as of April 30, 2015 by Turtle Creek (Phase I), LLC, a North
Carolina limited liability company ("Owner") and Jason D. Swain and H. David Swain, each an
individual resident of North Carolina (the "Nan -Member Managers").
1. Definitions. The terms "company official", "manager", "member", "limited
liability company", "operating agreement", "organizer", "ownership interest" and "transfer" shall
have the meanings given to them in the North Carolina Limited Liability Company Act (as
amended, modified or supplemented from time to time, or any corresponding provisions of
succeeding law, the "Act").
2. Formation of Company. The Company was formed under the Act on March 10,
2014, by the filing of Articles of Organization with the North Carolina Secretary of State. The
Company's initial member, Triple A Investments Limited Partnership, North Carolina limited
partnership ("Triple A"), and the Non -Member Managers executed that certain Operating
Agreement of the Company dated March 14, 2014 (the "Original Agreement'). Triple A
assigned its ownership interest in the Company to Owner on April 30, 2015. This Agreement
Amends and restates the Original Agreement in its entirety.
3. Name. The business and affairs of the Company shall be conducted under the
name Shallotte Investments, LLC. The Company shall be operated in accordance with its
Articles of Organization, this Agreement and the Act.
4. Purpose and Powers. The purpose and business of the Company shall be to enter
into any lawful transaction or engage in any lawful activity for which limited liability companies
may be organized under the Act, except as may be limited or restricted by the Company's
Articles of Organization. The Company shall have any and all powers which are necessary or
desirable to carry out the purpose and business of the Company, to the extent that such powers
may be legally exercised by limited liability companies under the Act.
5. Management.
(a) Designation and Removal of the Manager by the Member. The business
and affairs of the Company shall be managed by one or more managers. Non -Member
Managers shall be the managers. The managers shall hold office until dissolution,
resignation or removal. The member shall have the power to designate, replace or
remove either manager. A manager of the Company may resign at any time by giving
written notice to the member of the Company. The resignation of such manager shall
take effect upon receipt of notice thereof or at such later time as shall be specified in such
notice and, unless otherwise specified therein, the acceptance of such resignation shall
not be necessary to make it effective. The resignation of a manager who is also the

member shall not affect such manager's rights as the member and shall not cause such
person to cease to be a member.
(b) Management Authority. If there is more than one manager, decisions with
respect to the management of the business and affairs of the Company may be made by
one of the managers without the consent or joinder of the other manager(s). Such
decisions may be taken at a meeting or evidenced by a written consent executed by either
manager. Each manager shall have full and complete discretion to manage and control
the business and affairs of the Company, to make all decisions affecting the business and
affairs of the Company and to take all such actions as it deems necessary or appropriate
to accomplish the purposes of the Company. The managers shall have the right to
examine all books and records of the Company for a purpose reasonably related to their
positions as the managers. The member shall have no authority or right to act on behalf of
or bind the Company, unless otherwise provided herein. The managers may, from time
to time, designate one or more company officials with such titles and authority as
determined by either manager to act in the name of the Company. Any such company
official shall act pursuant to such delegated authority until such company official is
removed by a manager. Any action taken by the manager or a company official pursuant
to authority delegated to such company official shall constitute the act of and serve to
bind the Company. Persons dealing with the Company are entitled to rely conclusively on
the power and authority of a manager or any company official set forth in any instrument
designating such company official and the authority delegated to him or her.
6. Capital Contributions; Loans. The member shall have no obligation to make a
contribution of capital to the Company. If the manager determines that additional contributions
of capital are needed to carry out the purposes of the Company, the member may (but shall not
be required to) make additional contributions to the capital of the Company or make loans to the
Company.
7. Distributions. At such time as either manager shall determine, a manager may
cause the Company to distribute to the member any cash held by the Company that is not
reasonably necessary for the operation of the Company. No distribution shall be declared and
paid if payment of such distribution would cause the Company to violate any limitation on
distributions provided in the Act, any loan agreements, other financing documents, or other
contracts or agreements to which the Company or its property may be subject.
8. Tax Matters. The Company shall be disregarded as an entity separate from the
member for federal income tax purposes and for state income tax purposes in those states that
follow federal tax classification.
9. Transfer of Interest to Third Party.
(a) Free Transferability. The member may transfer not less than all of its
ownership interest without restriction. Such transferred ownership interest shall continue
to be subject to the terms and conditions of this Agreement unless and until this
Agreement is thereafter amended. Any such transferee shall automatically be deemed
admitted to the Company as a substituted member in respect of such owner i '

and bound by and a party to this Agreement, and the transferring member and shall cease
to be a member in respect of such ownership interest.
(b) Pledge of Ownership Interest. A member may pledge all of its ownership
interest in the Company and, in the event of foreclosure by the pledgee or other
successful bidder at a foreclosure sale or other disposition will automatically succeed to
all of such pledged ownership interest and be deemed admitted as a member of the
Company.
(c) Additional Members. No additional person may be admitted as a member
of the Company except upon an assignment by the member of all of its ownership interest
under this Section.
10. Term; Dissolution. The Company began on the date of the filing of its Articles of
Organization and shall continue until dissolved by the consent of the member and the filing of
Articles of Dissolution with the North Carolina Secretary of State, or as otherwise provided
under the Act. Upon dissolution of the Company, the Company shall immediately commence to
wind up its affairs and the manager shall promptly liquidate the business of the Company.
During the period of the winding up of the affairs of the Company, the rights and obligations of
the member and manager under this Agreement shall continue. In the event of dissolution, the
Company shall conduct only such activities as are necessary to wind up its affairs (including the
sale of the assets of the Company in an orderly manner), and the assets of the Company shall be
applied as follows: (a) first, to creditors, to the extent otherwise permitted by law, in satisfaction
of liabilities of the Company (whether by payment or the making of reasonable provision for
payment thereof); and (b) thereafter, to the member. The managers shall be responsible for
overseeing the winding up and dissolution of the Company.
11. Limitation of Liability. Neither the member nor the managers shall be liable for
the debts, obligations and liabilities of the Company beyond, in the case of the member, the
capital contributions the member has made or agreed to make in writing. Neither the member
nor the managers of the Company shall be liable to the Company for monetary damages for an
act or omission in such person's capacity as a member or manager, except in the case of (a) a
manager for any liability or damages therefor arising by reason of the failure of the manager to
discharge its duties (i) in good faith, (ii) with the care an ordinary prudent person in a like
position would exercise under similar circumstances, and (iii) subject to this Agreement, in a
manner the manager believes to be in the best interests of the Company; or (b) distributions in
violation of the Act or this Agreement. The failure by the Company or its member or a manager
to observe any formalities or requirements relating to the exercise of its powers and management
of the Company's business and affairs under this Agreement or the Act shall not be grounds for
imposing personal liability on either of them.
12. Indemnification. In addition to any indemnification that may be provided to a
member under the Act, the Company shall indemnify and hold harmless the member and
managers, each of their members, managers, officers, directors, stockholders, partners,
employees and agents, and each company official (collectively, the "Indemnitees"; each an
"Indemnitee") against all losses, liabilities, judgments, penalties (including excise and similar
taxes, and punitive damages), fines, settlements, and reasonable expenses (includingy h�

limitation, reasonable attorneys' fees) actually incurred or suffered by an Indemnitee who was or
is made a party or is threatened to be made a party to or is involved in any threatened, pending,
or completed action, suit, or proceeding, whether civil, criminal, administrative, arbitrative, or
investigative (a "Proceeding"), or any appeal in such a Proceeding or any inquiry or
investigation that could lead to such a Proceeding, to which an Indemnitee may become subject
by reason of (a) any act or omission or alleged act or omission performed or omitted to be
performed on behalf of the Company, the member or a manager, in connection with the business
of the Company; or (b) such Indemnitee being or acting in connection with the business of the
Company as the member or a manager, or a company official, employee or agent of the
Company; or (c) that such Indemnitee is or was serving at the request of the Company as a
member, manager, director, 'officer, employee or agent of any person; provided, that (x) such
Indemnitee complied with the standards of conduct in Section 11 and, with respect to any
criminal proceeding, had no reasonable cause to believe his conduct was unlawful; and (y) such
Indemnitee's conduct did not constitute fraud, gross negligence, willful misconduct or a material
breach of this Agreement. The Company may advance expenses incurred by an Indemnitee upon
the receipt by the Company of an undertaking by such person to reimburse the Company unless
it is ultimately determined that such person is entitled to be indemnified by the Company against
such expenses. Notwithstanding anything contained in this Agreement to the contrary, any
indemnity by the Company relating to the matters covered in this Section shall be provided out
of and to the extent of Company assets only, and neither the member, manager, nor any other
person shall have personal liability on account thereof and the member shall not be required to
make additional capital contributions to help satisfy such indemnity of the Company.
13. Affiliates. Either manager is specifically authorized to employ, contract and deal
with any of its affiliates from time to time and in connection therewith to pay such affiliate fees,
prices or other compensation, provided that such employment, contracts, and dealings are
commercially reasonable and necessary or appropriate for Company purposes, and the fees,
prices or other compensation paid by the Company are, in the judgment of the member,
reasonable and typical or competitive with the fees, prices or other compensation customarily
paid for similar property or services in the same general area.
14. Amendment. Each of this Agreement and the Articles of Organization may only
be amended or modified by a writing executed and delivered by the member.
15. Governing. Law. This Agreement is entered into pursuant to the Act, and the
rights and obligations of the member and manager hereunder shall be interpreted, construed, and
enforced in accordance with the laws of the State of North Carolina.
16. Integration; Entire Operating Agreement. This Agreement sets forth the entire
agreement and understanding of the member and manager with respect to the subject matter
hereof, constitutes the one and only operating agreement in respect of the Company's business
and affairs and supersedes all prior written and oral statements, including any prior
representation, statement, condition or warranty. Any and all agreements constituting the
Company's operating agreement must be in writing.

17. Binding Provisions. This Agreement is binding upon, and inures to the benefit of,
the parties hereto and their respective heirs, executors, administrators, personal and legal
representatives, successors and permitted assigns.

DESIGN NARRATIVE
Shallotte Investments, LLC proposes to construct a retail building on Lot 2, adjacent to the
existing O'Reilly's Auto Store and near the intersection of Main Street (US Highway 17
Business) and Hinson Street within the Town of Shallotte in Brunswick County, NC. The
address of the proposed development is 4607 Main Street, Shallotte, NC with a latitude and
longitude of 33°58'40"N, 78°22'42"W (Parcel ID#108816836551; Deed Book 3526 Page 111).
There is currently a State permitted stormwater wet detention basin on Lot 2, SW8 140801 that
was constructed when the O'Reilly's was constructed on the adjacent Lot 1. Lot 1 is currently
owned by Shallotte Developers, LLC and Lot 2 is currently owned by Shallotte Investments,
LLC. Since the owners of Lot 1 and Lot 2 are the same parent company, as evidenced by the
attached documents, the applicant would like to modify the permit to include both entities as
the owners of the wet detention BMP.
There is currently some existing impervious on the property with the majority of the site being
good open space. Soils consist of Baymeade & Marvyn (BDC), Longshoal Muck (LA), and
Norfolk loamy fine sand (NoB) according to the provided soils map from NRCS and have a
HSG classification of either A or A/D. According to the attached USGS map, the project drains
to Woodward Branch, C;Sw,HQW, which is within the Lumber River Basin.
PROPOSED IMPROVEMENTS-STORMWATER/EROSION CONTROL
The applicant is proposing to build a retail building on Lot 2 along with associated parking,
utility services, that drains to an existing stormwater management system, SW8 140801. It is
proposed that all runoff resulting from impervious surfaces will be collected by a storm
drainage collection system and then be conveyed to an existing wet detention pond where
stormwater quality requirements will be met. The pond has been designed to meet NCDEQ
requirements which include a forebay and a drawdown orifice at permanent pool. Stormwater
from greater storm events will be allowed to exit the wet detention pond by means of a riser
barrel outlet structure and a secondary spillway during emergency situations.
With regards to erosion control, it is proposed to install inlet protection at the storm the drain
inlets to prevent sediment from entering the system, as well as silt fence and temporary
construction entrances on Main and Hinson Streets. Please see Sheet C-1.0 for all Erosion
Control and Sequence of Construction notes. The sedimentation and erosion control design
will commence as depicted in the construction sequence. Please find all reference material and
stormwater / erosion control calculations in the following pages of this report. Note that some
calculations have also been located on the plans for easy reference during construction.

MAINTENANCE
Contractors shall be responsible for periodic inspection and maintenance of all indicated
erosion control devices in accordance with the plans and specifications. In addition, inspection
and any necessary maintenance will be required immediately following any significant storm

The Wilmington Regional Office received and accepted a modified Express State Stormwater
Management Permit Application for the subject project on November 7, 2017. A preliminary in-depth
review of that information has determined that the application is not complete and that additional
information is needed. To continue the review, please provide the following additional information:
VK 15A NCAC 021-1.1040(1)(a): The provided documentation from the NC Secretary of State (SOS)
for Shallotte Investments, LLC lists 1-1. Swain as the manager instead of Jason D. Swain. Please
provide documentation either from the NC SOS or official documentation from the LLC
demonstrating Jason D. Swain is a manager of Shallotte Investments, U.C.
15A NCAC 021-1.1002(25): Please provide a narrative describing the changes proposed by this
modification to support that a minor modification is being requested.
3. Due to the minor nature of these comments, the express additional information review fee has
been waived.
Please remember to confirm that any revised information is presented consistently throughout the
application documents including calculations, supplements, narrative, and plans. Please also remember to
provide two hard copies of any updated documents per 15A NCAC 0211.1042(2).
The requested information should be received in this Office prior to November 28, 2017, or the
application will be returned as incomplete. If the project is returned and you wish to rc-submit to the
Express Program, you will need to reschedule the project through the Express Coordinator for the next
available review date and will need to resubmit all required items at that time, including the application
fee.

prior to the original due date, to the Division at the email address provided below. The extension request
must include a justification and a date of when the requested information will be submitted to the
Division, which shall be no later than 5 business days past the original due date. Please remember that
extension requests delay the issuance of the final permit.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement
action pursuant to N'CGS 143-215.6A.

Based on the information originally submitted with the express request, I did mark this as being a minor modification
($1,500 fee). Per 15A NCAC 02H.1002(25), a minor modification is considered to include changes that do not increase
the net BUA or do not increase the overall size of the SCM. However, per 15A NCAC 02H.1002 (23), if the proposed
changes are not considered a minor modification, then they are considered a major modification ($4,000 fee).
Please don't forget to bring deeds and LLC info from the Secretary of State (or other sources) to support the
corporations are registered in NC and to support the titles for the individual(s) signing the form.

In preparing for our express meeting on November 71h, I want to make sure I show up with all the correct documents
needed. I will bring a revised SWU-101 form, wet detention supplement form, and O&M form, with both owners listed
(Shallotte Developers, LLC & Shallotte Investments, LLC) and signed. I will also bring plans of the Lot 2 (Shallotte
Investments, LLC) development, showing the proposed impervious coverage is within the previously permitted
allocation.
Will this be considered a minor modification?
Please let me know if I am missing anything else.

I'm sorry, I'm moving too fast. I should have looked closer at that recorded map earlier and not relied on the Brunswick
Co GIS page. Based on deed book 3526, page 115 referenced on that map you provided, Lot 1 is owned by Shallotte
Developers, LLC while Shallotte Investments, LLC will own the to -be -expanded lot 2. Can you confirm that this is
correct?
If it is desired to maintain this as a single permit, both entities will need to be listed on the permit as property
owners. Otherwise, we are looking at subdividing this permit and submitting an offsite at the same time. Are you still
intending this to stay as a single permit with both LLCs as co-permittees?

Thanks for the confirmation that Shallotte Investments, LLC will be the responsible entity. In looking at the permit, it
was issued to Shallotte Developers, LLC. In looking closer at the originally submitted documents, the application lists the
owner as Shallotte Developers, LLC but the deed states the property owner is Shallotte Investments, LLC. For this
project, I am willing to correct the permit to get the right LLC listed so that a transfer isn't needed.
I will get with Cameron to get this one scheduled.

Cameron brought me the express request for the subject project. In looking at the previously approved plans, the
proposed site plan, and the Brunswick County GIS Data Viewer, it looks like Shallotte Developers, LLC does not own the
entire project area. There is a corner that is showing up on the Brunswick County GIS Data Viewer as being owned by
Shallotte Seafood, LLC. Can you provide more information regarding the ownership of this project area? Did Shallotte
Developers, LLC sell the parcel? Are they looking to obtain the parcel? Does the permit need to address any subdivision
in project area? Is there something else going on?

DESIGN NARRATIVE
Shallotte Developers, LLC proposes to modify the existing S\N8 140801 issued on 1/9/15 permit
to include the remaining development which will include a 10,000 sf building with
corresponding impervious area. The total impervious for the site will remain the same as the
original permit therefore requesting a plan revision for Lot 2. The address of the property is
4607 Main Street, Shallotte, NC with a latitude and longitude of 33°58'40"N, 78°22'42"W (Parcel
ID4108816836551; Deed Book 3526 Page 111).
"There is currently some existing impervious on the property with the majority of the site being
good open space. Soils consist of Baymeade 8. Marvyn (131DC), Longshoal Muck (LA), and
Norfolk loamy fine sand (NoB) according to the provided soils map from MRCS and have a
HSG classification of either A or A/D. According to the attached USGS map, the project drains
to Woodward Branch, C;Sw,I-IQSV, which is within the Lumber River Basin.
