REGAN Secrerary TRACY DAVIS Director Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this minor modification references DEMLR as the Division responsible for issuance of the permit. On January 19, 2018, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources received a complete, minor modification application for changes to the approved plans for Stormwater Management Permit Number SW8 130301. It has been determined that the nature of the proposed change meets the definition of a minor modification in that it does not result in an increase in the size of the permitted stormwater control measure (SCM) and does not increase the amount of built - upon area. The minor modification includes the reduction in drainage area to both Pond I and Pond 2. The area removed is being regraded to drain away from the ponds and will be permitted under the modification to SWS 090109 as part of the, jogging trail addition. We are forwarding you an approved copy of the modified plans for your files. Please add the attached plans to the previously approved plan set. Please replace the previous application (S WU-101), supplements and Operation and Maintenance Agreements with the attached modified versions. Please be aware that all terms and conditions of the permit issued on March 27, 2013, remain in full force and effect. Please also understand that the approval of this minor modification to the subject State Stormwater Permit is done on a case -by -case basis. Any other changes to this project must be approved through this Office prior to construction. The approval of this minor modification does not preclude the permittee from complying with all other applicable statutes, rules, regulations or ordinances which may have jurisdiction over the proposed activity, and obtaining a permit or approval prior to construction. DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.6 of this permit. The stormwater controls labeled SWMF-1 and SWMF-2 have been designed to handle the runoff from 80,954 and 11,761 square feet of built -upon area, respectively. 3. A 50' wide vegetative buffer must be provided and maintained adjacent surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the top of bank of both sides of streams and rivers and the mean high water line of tidal waters. 4. Each drainage area will be limited to the amount of built -upon area indicated in this permit, and per approved plans. There is no allocation of built -upon area for future development. 5. The runoff from all built -upon area within the permitted drainage areas of this project must be directed into the permitted stormwater control system. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. The permittee shall, at all times, provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The signed and approved Operation and Maintenance Agreement must be followed in its entirety and maintenance must occur at the scheduled intervals. Records of maintenance activities must be kept and made available upon request to authorized personnel of the Division. The records will indicate the date, activity, name of person performing the work and what actions were taken. Decorative spray fountains will not be allowed in either stormwater treatment system, because the permanent pool volume in either pond is below 30,000 cubic feet. The facilities must be constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. The permittee is responsible for verifying that the proposed built -upon area for the entire project does not exceed the maximum allowed by this permit. Page 2 of 6 State Stormwater Management Systems Permit No. SW8 130301 8. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. The permittee shall provide and maintain clear and unencumbered access to the stormwater facilities for inspection and maintenance. 10. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Redesign or addition to the approved amount of built -upon area or to the drainage area. , C. Further development, subdivision, acquisition, lease or sale of any, all or part of the project area. d. Any permitted future areas shown on the approved plans. e. Filling, altering, relocating, or piping any vegetative conveyance shown on the approved plan. 11. The Director may notify the Permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the Permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The Permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 12. Prior to transfer of the permit, a file review and site inspection will be conducted by Division personnel to ensure the permit conditions have been met and that the project and the on -site stormwater system complies with the permit conditions. Any items not in compliance must be repaired, replaced restored, or resolved prior to the transfer. Records of maintenance activities performed to date may be requested. 13. The permit application, the approved plans and specifications, and the design calculations for this project are incorporated by reference and are enforceable parts of the permit. A copy of the approved plans and specifications shall be maintained on file by the Permittee at all times. III. GENERAL CONDITIONS Any individual or entity found to be in noncompliance with the provisions of this stormwater management permit or the requirements of the Stormwater rules is subject to enforcement procedures as set forth in G.S. 143 Article 21. 2. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 3. In the event that the facilities fail to perform satisfactorily, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. These additional or replacement measures shall receive a permit from the Division prior to construction. Page 3 of 6 State Stormwater Management Systems Permit No. SW8 130301 4. This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed State Stormwater Request Form for Permit Transfer or Permit Information Update, accompanied by the supporting documentation as listed on the form, to the Division at least 60 days prior to any one or more of the following events: a. Any ownership change including: i. The sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions and protective covenants; ii. Dissolution of the partnership or corporate entity, subject to NCGS 57D-2- 01(e) and NCGS 57D-6-07; b. Bankruptcy; c. Foreclosure, subject to the requirements of Session Law 2013-121, d. A name change of the current permittee; e. A name change of the project; f. A mailing address change of the permittee; 5. The permittee is responsible for compliance with all permit conditions until the Division approves the transfer request. Neither the sale of the project in whole or in part, nor the conveyance of common area to a third party constitutes an approved transfer of the stormwater permit. 6. The permittee grants Division Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 7. The permit remains in force and effect until modified, revoked, terminated or renewed. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re -issuance or termination does not stay any permit condition. 8. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 9. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit for cause as allowed by the laws, rules, and regulations contained in Title 15A NCAC 21-1.1000 and NCGS 143-215.1 et.al. 10. A permit renewal request must be submitted at least 180 days prior to the expiration date of this permit. The renewal request must include the appropriate application, documentation and the processing fee as outlined in Title 15A NCAC 02H.1045(3). The complete application package should be submitted to the appropriate DEMLR Office. The jogging trail totals 3,227 linear feet in two segments. The total length includes two separate timber walkways totaling 760 linear feet and various existing pavement crossings totaling 137 linear feet. The project does not involve any other improvements except pavement markings and crosswalk signage. The linear project requires modification to the following existing stormwater permits: - SW8 130301, Wallace Creek Marine Mart (This Modification) - SW8 090109, Wallace Creek Regimental Complex - Roads - SW8 081015, Wallace Creek Regimental Complex - SW8 120612, North Wallace Creek -Roads and Jogging Trail The Marine Mart permit is being modified to alter the drainage boundary to exclude where the new jogging trail ties into the site. The drainage boundary for SCM #1 is being decreased by 40 square feet. The change in stormwater volume as a result of this smaller drainage area is a decrease of 1 cubic foot: The drainage boundary for SCM #2 is being decreased by 1,184 square feet. The change in stormwater volume as a result of this smaller drainage area is a decrease of 7 cubic feet. These two minor volume changes do not change the design of either of the two wet detention ponds. The wet pond supplements have been revised to show the change in drainage areas. The soils on the site are classified as Baymeade and Marvyn by the Onslow County Soil Survey. Baymeade is described as a fine sand. Marvyn is described as a loamy fine sand. 1.5 acres of the site will be disturbed by this project in order to construct the site improvements. The property is owned by the Federal Government. The jogging trail totals 3,227 linear feet in two segments. The total length includes two separate timber walkways totaling 760 linear feet and various existing pavement crossings totaling 137 linear feet. The project does not involve any other improvements except pavement markings and crosswalk signage. The linear project requires modification to the following existing stonnwater permits: - SW8 430301, Wallace Creek Marine Mart (This Modification) - SW8 090109. Wallace Creek Regimental Complex - Roads - SW8 081015, Wallace Creek Regimental Complex - SW8 120612, North Wallace Creek -Roads and Jogging Trail The Marine Mart permit is being modified to alter the drainage boundary to exclude where the new jogging trail ties into the site. The jogging trail is being graded to direct all runoff away from the two Marine Mart SCM's. There are not any other changes proposed for the Marine Mart permit. The drainage boundary for SCM #1 is being decreased by 40 square feet and the drainage boundary for SCM #2 is being decreased by 1,184 square feet. The soils on the site are classified as Baymcade and Marvyn by the Onslow County Soil Survey. Baymeade is described as a fine sand, Marvyn is described as a loamy fine sand. 1.5 acres of the site will be disturbed by this project in order to construct the site improvements. The property is owned by the Federal Government. Previous permits have been issued for the work area as discussed above. There is not any off -site built -upon area draining into the site. There are not any known historic sites on the property. The site drains to Beaverdam Creek, a tributary of the New River. Beaverdam Creek is classified as SB;NSW, index #19-20-2. There are not any Coastal wetlands on the site. 404 wetlands exist on the site but are all being crossed with pile supported structures. This project does not impact any wetlands.
