Staff review of the plans and specifications has determined that the prot1ect, as proposed, will comply with the Stormwater Regulations set forth in Session Law 2008-211 and Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 100502 dated December 13, 2012, for the construction of the subject project. On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any development approval issued by the Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which is current and valid at any point between January 1, 2008, and December 31, 2010. The law extends the effective period of any stormwater permit that is set to expire during this time frame to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177 which grants an extra year for a total of four (4) years extension. Accordingly, this permit, which was set to expire on September 27, 2020, shall be effective from the date of issuance until December 31, 2021, which includes all available extensions. This permit shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. The following modifications are included and covered by this permit: 1. The permitted built -upon area (BUA) within drainage area 5 is increasing from 42,000 square feet to 43.086 square feet for the addition of 1,086 square feet of BUA due to road improvements. 2. The previously approved layout and grading plans remain in effect and are incorporated into the current approved plan set. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicato hearing by filing a written petition with the Office of Administrative Hearings (OAHI. The written petition must conform to Chapter 150B of the North Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of this permit. This permit shall be effective from the date of issuance until December 31, 2021, and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS 1. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described in Sections 1.6 and 1.7 of this permit. The bioretention cell in DA-1, D.�-2 and DA-3 gave been designed to handle the runoff from 22,934 ft , 20,671 ft , and 1,770 ft , of built -upon area respectively. The infiltration Pasins in DA-4 anq DA-5 have been designed to handle the runoff from 60,621 ft , and 43,086 ft of built -upon area, respectively. Infiltration Basin DA-4 is designed to handle the 10 year storm without discharging, per Section 16.3.9 of the 07/23/2009 BMP Manual, therefore a vegetated filter is not required for that basin. A level spreader and vegetated filter are required for the infiltration basin in DA-5. The drainage area limits for each BMP shall not exceed what is shown on the approved drainage area plan and listed in Sections 1.6 and 1.7 of this permit. Each BMP shall treat no more than that amount of built -upon area indicated in Sections 1.2, 1.6 and 1.7 of this permit, and per the application documents and the approved plans. The runoff from all permitted built -upon area within each BMP drainage area shall be directed to the appropriate BMP. Page 3 of 9 State Stormwater Management Systems Permit No. SW8 100502 4. The project shall provide a 50' wide vegetated buffer adjacent surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the top of bank of both sides of streams and rivers, and the mean high water line of tidal waters. ,A 7 The bioretention cells in DA-1, DA-2 and DA-3 do not provide sufficient volume to completely handle the 3.67" design storm, therefore, they all overflow into the infiltration basin in DA-4, which has been designed to accommodate the runoff from DA's 1-4, inclusive, less the total volume stored in the bioretention basins. SCHEDULE OF COMPLIANCE The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all time provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and re -vegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch basins and piping. a. Access to the outlet structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. The facilities shall be constructed as shown on the approved plans. This permit shall become void unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 6. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. If the stormwater system BMP is used as an Erosion Control device during construction, more frequent maintenance will be required during construction to maintain functionality. Once the drainage area is stabilized and prior to occupancy of the facility, the BMP must be fully restored to design condition. Access to the stormwater facilities shall be maintained via appropriate recorded easements at all times. All stormwater collection and treatment systems must be located in public rights - of -way, dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required rights -of -way, common areas and easements, in accordance with the approved plans. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 11. Prior to construction, the permittee shall submit final site layout and grading plans for any future development areas with BUA allocations, as designated on the approved plans. 12. A copy of this permit, the permit application documents, the approved plans and specifications shall be maintained on file by the Permittee for the life of the permit. At the time a permit transfer is approved, the permittee shall forward the approved plans to the proposed new permittee. 13. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS 1. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 2. This permit is not transferable to any person or entity except after notice to and approval by the Director. At least 30 days prior to a change of ownership, or a name change of the permittee or of the project, or a mailing address change, the permittee must submit a completed and signed Name/Ownership Change form to the Division of Water Quality, accompanied by the appropriate documentation as listed on the form. The approval of this request will be considered on its merits and may or may not be approved. 3. The permittee is responsible for compliance with all permit conditions until such time as the Division approves a permit transfer request. Neither the sale of the project in whole or in part nor the conveyance of common area to a third party shall be considered an approved permit transfer request. 4. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. This includes any local flood control requirements. 6. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 7. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re -issuance or termination does not stay any permit condition. 8. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 9. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit to the extent necessary to maintain compliance with stormwater regulations. 10. At least 180 days prior to the expiration date of this permit, the permittee shall submit a permit renewal request to the Division of Water Quality along with the required application feet. DEC 0 �2012 DESIGN NARRATIVE L GENERAL: On behalf of NAVFAC and the Marine Corps Base Camp Lejeune (MCBCL) — Public Works Division, Cape Fear Engineering is submitting a stormwater permit modification to the existing P-1357 Child Development Center Courthouse Bay (SW8 100502) to accommodate additional intersection improvements as part of the P-1253 Project. The project site is located at the intersection of Hwy 172 & DA Munro Road in the Courthouse Bay area of Marine Corps Base Camp Lejeune (MCBCL). The offsite roadway improvements will consist of road widening to add additional turning lanes and signalization at the intersections. Of these improvements, approximately 1,086 sf of additional impervious is being added to previously approved Drainage Area #5. This modification does not affect any other previously permitted drainage areas. 2. EXISTING SITE AND DEMOLITION: There are no jurisdictional wetlands located within the proposed project limits. There are no known contaminated areas located within the proposed project limits. For Drainage Area #5, existing drainage patterns onsite consist of overland sheet flow from the existing pavement to a shallow roadside drainage swale. The roadside swale conveys runoff to a small infiltration basin for treatment. The project site is part of the White Oak river basin and drains to Courthouse Bay (19-36 SA;HQW). Slopes onsite are generally mild and range from 0 to 3%. There are some areas near the existing drainage features with steeper slopes. 3. PROPOSED IMPROVEMENTS: Offsite road improvements are included to facilitate the anticipated increase in vehicular traffic as a result of the P-1253 CEB Complex construction and other ongoing projects in the area. The offsite roadway improvements are located at the intersection of Sneads Ferry Road and Marines Road and at the intersection of Sneads Ferry Road and DA Munro Road. At the intersection of Sneads Ferry and DA Munro Road, a 240-ft left turn lane will be added on westbound Sneads Ferry onto DA Munro. The existing right turn lane on westbound Sneads Ferry will be extended to 140-ft, and a 100-ft right turn lane will be added to DA Munro. A new traffic signal will be installed which will be synchronized with the existing traffic light at the intersection of Sneads Ferry and Marines Road. 4. DRAINAGE CONSIDERATIONS: The proposed project does not alter the existing drainage patterns onsite. Proposed grading will generally consist of cuts and fills of approximately I-ft. There is sufficient capacity in the previously permitted infiltration basin to accommodate the additional impervious area. This permit modification does not make any changes to the existing infiltration basin. 5. EROSION CONTROL CONSIDERATIONS: Best Management Practices (BMP's), designed in accordance with the North Carolina Erosion and Sediment Control Planning and Design Manual, will be utilized to prevent sediment migration and transport from the site. The project site is located at the intersection of Hwy 172 & DA Munro Road in the Courthouse Bay area of Marine Corps Base Camp Lejeune (MCBCL). The offsite roadway improvements will consist of road widening to add additional turning lanes and signalization at the intersections. Of these improvements, approximately 1,086 sf of additional impervious is being added to previously approved Drainage Area #5. This modification does not affect any other previously permitted drainage areas. 2. EXISTING SITE AND DEMOLITION: There are no jurisdictional wetlands located within the proposed project limits. There are no known contaminated areas located within the proposed project limits. For Drainage Area #5, existing drainage patterns onsite consist of overland sheet flow from the existing pavement to a shallow roadside drainage swale. The roadside swale conveys runoff to a small infiltration basin for treatment. The project site is part of the White Oak river basin and drains to Courthouse Bay (19-36 SA;HQW). Slopes onsite are generally mild and range from 0 to 3%. There are some areas near the existing drainage features with steeper slopes. 3. PROPOSED IMPROVEMENTS: Offsite road improvements are included to facilitate the anticipated increase in vehicular traffic as a result of the P-1253 CEB Complex construction and other ongoing projects in the area. The offsite roadway improvements are located at the intersection of Sneads Ferry Road and Marines Road and at the intersection of Sneads Ferry Road and DA Munro Road. At the intersection of Sneads Ferry and DA Munro Road, a 240-11 left turn lane will be added on westbound Sneads Ferry onto DA Munro. The existing right turn lane on westbound Sneads Ferry will be extended to 140-I1, and a 100-11 right turn lane will be added to DA Munro. A new traffic signal will be installed which will be synchronized with the existing traffic light at the intersection of Sneads Ferry and Marines Road. 4. DRAINAGE CONSIDERATIONS: The proposed project does not alter the existing drainage patterns onsite. Proposed grading will generally consist of cuts and fills of approximately 1-ft. There is sufficient capacity in the previously permitted infiltration basin to accommodate the additional impervious area. This permit modification does not make any changes to the existing infiltration basin. 5. EROSION CONTROL CONSIDERATIONS: Best Management Practices (BMP's), designed in accordance with the North Carolina Erosion and Sediment Control Planning and Design Manual, will be utilized to prevent sediment migration and transport from the site. Temporary measures will primarily consist of wattle sediment barriers in the roadside swales. Additional temporary measures will consist of rip -rap inlet/outlet protection and temporary seeding.
