existing floating dock and constructing a new floating dock in line with the existing fixed pier. The modified docking
facility would have a total of 4 boat slips.

9. PROJECT DESCRIPTION
The project site is located at 405 N. Lumina Avenue, adjacent to Banks Channel, in the Town of Wrightsville Beach,
New Hanover County,
According to the application, the parcel located at 405 N, Lumina Avenue has a maximum elevation of approximately
4' - 7' above normal high water (NHW) and is approximately 4,130 ft2 (0.10 acres). The lot has an existing single-
family residence and private 2-slip docking facility with the high ground vegetation consisting primarily of ornamental
landscaping and maintained lawn grasses. The adjacent riparian parcel to the north has an existing single-family
residence with a bulkhead. The adjacent riparian parcel to the south has an existing single-family residence with a
bulkhead and a docking facility. The project site has approximately 50'of shoreline frontage,currently stabilized by a
bulkhead.
The applicant currently maintains a private docking facility with a fixed pier, measuring approximately 182' long x 6'
wide, and terminates to a fixed gazebo. The existing fixed gazebo, measuring approximately 20'long x 14'wide,
has a ramp that leads to an approximately 24' long x 8'wide floating dock.There is also an existing boat lift
adjacent to the north side of the fixed pier. This docking facility was previously permitted under CAMA General
Permit 69380D and issued to the applicant in 2017. The CAMA General Permit authorized approximately 432 ft2 of
maximum platform area. The current facility has a total platform area of approximately 472 ft2. We were unable to
locate previous permit history for the existing bulkhead.
The Town of Wrightsville Beach Land Use Plan classifies the adjacent waters as Conservation, and the adjacent high
ground portion of the project area as Residential. The adjacent waters of Banks Channel in the project area are
classified SB by the Division of Water Resources and this area is NOT designated as Primary Nursery Area (PNA)
by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish.
PROPOSED PROJECT
The applicant proposes to modify an existing docking facility by reducing the width of an existing floating dock and
constructing a new floating dock in line with the existing fixed pier. The modified docking facility would have a total of
4 boat slips.
In order to become compliant with the maximum allowed platform area established by CAMA General Permit 69380D,
the applicant proposes to reduce the width of the existing floating dock from 8'wide to 6'wide.The reduced width to
the existing floating dock will decrease the total platform area of the docking facility to approximately 424 ft2, which
will bring the facility's total platform area into compliance with CAMA General Permit 69380D. The applicant then
proposes to construct a new floating dock, measuring approximately 6'wide x 28' long, that would be built in line with
the existing fixed pier. The new floating dock would have the potential to accommodate 1 vessel on either side, for
the total of 2 new slips(See Pages 1 &2 of 3).The proposed floating dock would not exceed the Town of Wrightsville
Beach's established pier headline.

10. ANTICIPATED IMPACTS
The proposed modified docking facility would accommodate 4 boat slips and would result in the incorporation of a
maximum of approximately 424 ft2 of Estuarine Waters and Public Trust Area. The proposed structures would not
encroach into either 15' riparian corridor setback requirement, would not exceed the %width of the waterbody and
would not exceed the Town's Pierhead Line. Minor increases in turbidity can be expected during excavation and
construction.

On behalf of Chris Strickland, we are applying for a CAMA Major Permit to install an
additional floating dock to expand the docking facility from 2 slips to 4 slips for recreational
boating purposes. The proposed floating dock will be 6'x28' and positioned waterward of the
current gazebo. The existing 8'x24' floating dock will also be reduced to 6'x24' in order to
comply with square footage restrictions.
All proposed work is consistent with current DCM regulations and is within the riparian
corridor and will be constructed according to all current local and state building codes.

The Division of Coastal Management hereby acknowledges receipt of your application, as acting agent for Three
Auditorium Circle, LLC.,for State approval for development of the subject property located at 405 N.Lumina Avenue,
adjacent to Banks Channel, in the Town of Wrightsville Beach, New Hanover County. It was received as complete on
February 17, 2023 and appears to be adequate for processing at this time. The projected deadline for making a
decision is May 3, 2023.An additional 75-day review period is provided by law when such time is necessary to
complete the review, If you have not been notified of a final action by the initial deadline stated above,you should
consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from February 17, 2023, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project.Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a"Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your

The Department of Environmental Quality hereby gives public notice as required by NCGS
113A-119(b) that the following applications were submitted for development permits in Areas of
Environmental Concern as designated under the CAMA: On February 20, 2023, Christopher and
Deborah Strickland proposed to modify an existing docking facility, reducing the width of an
existing floating dock& construction of a new floating dock in line with the existing pier, creating
a total of four (4) boat slips at 405 N Lumina Ave., adj. to Banks Channel in Wrightsville Beach,
Ne►v Hanover County. Copies of these applications can be examined or copied at the office of Kelsey
Beachman N.C. Dept. of Environmental Quality, Division of Coastal Management, 127 Cardinal

I reviewed the application for 405 N Lumina and there are a few things that we still need to fix. I have listed them for you
below.
1. The neighbor notifications need to be sent again through the certified mail. I checked the tracking numbers that
you provided, and both had a status of"delivery attempted". I then checked the mailing addresses for each
property on New Hanover County GIS and it looks like the correct mailing addresses for the properties are as
follows:
a. Walter Love: PO Box 537,Wrightsville Beach
b. Penny Tillery: 2605 Mimosa Place,Wilmington 28403
Please send to the above addresses,we need at least two attempted deliveries in order to consider the
notifications complete
2. Please change the scale of the cross-section to 1 = 10
a. When I scaled everything out, it almost met the above scale, please adjust the drawing and the scale to
match the dimensions that you provided
3. Changing the location of the NHW line
a. I noticed that the NHW line was pulled from the survey that you provided in the application package. I
went out to the site today just to verify that this location was correct (as the survey identifies a "CAMA
line" but not a NHW line)and it looks like the NHW line is actually 45' waterward from the existing
bulkhead. Please adjust the NHW line on the 15S drawing to match what I got in the field today and you
can label the line as"NHW Line,verified by CAMA on 2/1/2023".
4. The last thing the application will need is the $250.00 check made out to NC DEQ

6'x24'to decrease the total square footage of their facility.This will allow them to move forward with adding the

DCM received your CAMA Major Application request for the installation of a new floating platform at the existing
docking facility on 1-10-2023 at the subject address. In reviewing your application,we have discovered
that additional information is needed for a complete application. Please provide the following:
• Modify drawings to match previously permitted platform area of existing docking facility(as Daniel and I have
previously discussed)
• By rule for major applications the adjacent riparian neighbors need to be notified of the proposed project by
certified mail. Please resend proposed application to the appropriate adjacent riparian property owners and
provide proof that the notifications were delivered.

Proposed Project: The applicant proposes to modify and existing docking facility by reducing the
width of an existing floating dock and constructing a new floating dock in line with
the existing fixed pier. The modified docking facility would have a total of four(4)
boat slips.
