A review of the file and delivery logs indicates that, as of this date, the information requested on September 7, 2022 has not been received in this Office within the stipulated timeframe. Per the requirements of Title 15A NCAC 02H.1045(4)(a)(ii) of the Stormwater Management Rules, this Office is hereby returning the subject application as incomplete. The $505.00 application fee submitted with the subject application package has been forfeited and a new fee will need to be provided if you choose to resubmit this application in the future. If you wish to pursue transferring this project, you must reapply to the Division. Your application package must include a completed and signed application form; signed O&M agreement; application fee; and any supporting documentation necessary to address the items identified in the latest request for additional information. Please note that Permit Number 090339, issued on February 11, 2022, remains in full force and effect until modified, renewed or transferred. Please be aware that the construction of any changes to the originally approved and permitted plans prior to the receipt of a modified permit is a violation of NCGS 143-215.1 and is subject to enforcement action pursuant to NCGS 143-215.6A. A preliminary in-depth review of the documentation submitted with the transfer request determined that the application is incomplete, and that additional information is needed. Operation and Maintenance (O&M) Agreements [15A NCAC 02H .1056, .1059 and .1051]: There are three stormwater systems permitted for this facility. They are 1.) A sand filter, 2,) An Infiltration Basin, and 3.) A Filter Strip and Level Spreader. 1 have enclosed copies of the current O&M Agreements signed by the current petmittee as well as blank copies of the O&M Agreements to be signed by an individual with signature authority for BBC Apex One Carolina Cove, LLC. Please submit the three signature pages signed by the new owner. Please ensure that original signatures are submitted as opposed to copies. Notice of Inspection On June 21, 2022, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR) inspected the subject project to determine the status of compliance with this permit, most recently issued on February 11, 2022. DEMLR file review and site inspection revealed that the site is not in compliance with the terms and conditions of this permit. A copy of the completed form entitled "Compliance Inspection Report" summarizing the findings of the recent inspection is attached to this letter. Please either address the following items to demonstrate compliance with the permit or sign and submit the enclosed drafted Schedule of Compliance. Ifvou choose the Schedule ofComnliance please choose and insert a due e sinkhole in the infiltration basin needs to be repaired. It may be in line with an underground pipe. All of the requested information listed above should be received in this Office by September 22, 2022, or the application will be returned as incomplete. If additional time is needed to submit the requested information, please email your extension request prior to this due date to the email address provided below with ajustification and a date of when the requested information will be submitted, which shall be no later than 15 days past the original due date. Please note that only two letters requesting additional information is allowed in the State Stormwater Program for a total of 30 days to submit the requested additional information. If the information is not satisfactorily provided after either the second request or 30 days, the project will be returned. If the project is returned and you wish to re -submit later, you will need to resubmit all required items at that time, including the application fee. Please note that if, upon review of the submitted information or upon a deficient compliance inspection of the project, it is determined that a maior modification to the permit is required to resolve the compliance issues, the transfer application will be returned as incomplete. Upon the issuance of the modified permit, and the successful completion of any work required by the modified permit and/or the restoration of the site to design condition, the applicant will need to submit an updated transfer application and a new fee to the Division to start the transfer process over again. It sounds like Jeff's company is the current/outgoing permittee and Victoria is the proposed/incoming permittee. The transfer form has areas for both of you to sign. Jeff will sign Section D for the current permittee. Victoria will sign Section E as the proposed permittee. Victoria, there are several types of proposed permittees (see below); property owner, HOA, lessee, purchaser with a pending sales agreement, or a developer. You just choose the appropriate one and then fill out the parts of the form noted below. Victoria, I will also need the attached Operation and Maintenance Agreement from you. (Please note that the Excel file has three tabs. All three make up the O&M Agreement.) I will need documentation from the NC Secretary of State for both companies showing that the corporations are active and in good standing. Please submit the most recent annual report. The person signing for each company needs to have signature authority it do so as listed in the NC SoS's Annual Report (Manager, etc). We will also need the deed and a sales agreement if the project has not yet been sold. We need original signatures as opposed to copies for all of the documents. Please work together to ensure that the package arrives in one piece with both signatures together along with the supporting documentation. For the renewal application, Section C are the submittal requirements. I am not currently seeing any deed restriction language in the current permit, so deed striction language and recorded covenants are most likely not needed for submission. Number 4 is asking if you would like a copy of the current operation and maintenance agreement. We have these recorded already, but please answer that question as box 1 if you already have a copy of the agreement, or box 2, if you do not have a copy of the agreement and I will send one with the permit in the mail as an attachment once the permit is renewed. Number 5 is asking about a designer certification. I believe we already have one on file for this permit. Box 1 is confirming the project was built in accordance with the approved plans and the certification was already provided to our Division. Numbers 6 and 7 are not yet required for the renewal of this permit, they will be in the future but currently are not. If you have the information for 6 and 7 please do submit. If not, the renewal process will not be held. These items can be listed as NA on the form. I handle all renewals for the state stormwater permits. I have attached some helpful documentation to get this state stormwater permit back into compliance. As discussed on the phone this afternoon, this permit needs a renewal and a transfer to become back to an active, compliant status. Per 15A NCAC 02H. 1045(3) and Section 111.12 of the issued permit dated September 21, 2009, state stormwater permits, must be renewed by the current permit holder and applications are due 180 days prior to expiration date. This permit expired December 30, 2021. The current holder of this permit is University Housing Group, Inc. Per permit condition Section 111.2 University Housing Group, Inc. is responsible for the permit and its conditions until otherwise approved by the Division. As stated in the letter you received and the permit issued dated September 21, 2009 Section 111.1, permits do not automatically transfer with the sale of property, so this permit is then going to need a transfer. Section 111.11 states the permittee should have notified the Division in writing at least 30 days prior to making ownership changes. Both the current permit holder, and the new property owners are required to sign the transfer application. I did some quick research online and found an address and phone number for the current property owners to begin to assist you with this. Please direct any renewal questions to me. Evidently she has already processed the Renewal and now you all want to transfer the permit. It sounds like Jeff's company is the current/outgoing permittee and Victoria is the proposed/incoming permittee. The transfer form has areas for both of you to sign. Jeff will sign Section D for the current permittee. Victoria will sign Section E as the proposed permittee. Victoria, there are several types of proposed permittees (see below); property owner, HOA, lessee, purchaser with a pending sales agreement, or a developer. You just choose the appropriate one and then fill out the parts of the form noted below. Victoria, I will also need the attached Operation and Maintenance Agreement from you. (Please note that the Excel file has three tabs. All three make up the 0&M Agreement.) I will need documentation from the INC Secretary of State for both companies showing that the corporations are active and in good standing. Please submit the most recent annual report. The person signing for each company needs to have signature authority it do so as listed in the NC SoS's Annual Report (Manager, etc). We will also need the deed and a sales agreement if the project has not yet been sold. We need original signatures as opposed to copies for all of the documents. Please work together to ensure that the package arrives in one piece with both signatures together along with the supporting documentation. I have been contacted by Victoria Reese, who I have cc'ed in this email for correspondence for the new property owners of this site. For the renewal application, Section C are the submittal requirements. I am not currently seeing any deed restriction language in the current permit, so deed striction language and recorded covenants are most likely not needed for submission. Number 4 is asking if you would like a copy of the current operation and maintenance agreement. We have these recorded already, but please answer that question as box 1 if you already have a copy of the agreement, or box 2, if you do not have a copy of the agreement and I will send one with the permit in the mail as an attachment once the permit is renewed. 23 Number 5 is asking about a designer certification. I believe we already have one on file for this permit. Box 1 is confirming the project was built in accordance with the approved plans and the certification was already provided to our Division. Numbers 6 and 7 are not yet required for the renewal of this permit, they will be in the future but currently are not. If you have the information for 6 and 7 please do submit. If not, the renewal process will not be held. These items can be listed as NA on the form. I handle all renewals for the state stormwater permits. I have attached some helpful documentation to get this state stormwater permit back into compliance. As discussed on the phone this afternoon, this permit needs a renewal and a transfer to become back to an active, compliant status. Per 15A NCAC 02H. 1045(3) and Section 111.12 of the issued permit dated September 21, 2009, state stormwater permits must be renewed by the current permit holder and applications are due 180 days prior to expiration date. This permit expired December 30, 2021. The current holder of this permit is University Housing Group, Inc. Per permit condition Section 111.2 University Housing Group, Inc. is responsible for the permit and its conditions until otherwise approved by the Division. As stated in the letter you received and the permit issued dated September 21, 2009 25 Section 111.1, permits do not automatically transfer with the sale of property, so this permit is then going to need a transfer. Section 111.11 states the permittee should have notified the Division in writing at least 30 days prior to making ownership changes. Both the current permit holder, and the new property owners are required to sign the transfer application. I did some quick research online and found an address and phone number for the current property owners to begin to assist you with this. Please direct any renewal questions to me. Evidently she has already processed the Renewal and now you all want to transfer the permit. It sounds like Jeff's company is the current/outgoing permittee and Victoria is the proposed/incoming permittee. The transfer form has areas for both of you to sign. Jeff will sign Section D for the current permittee. Victoria will sign Section E as the proposed permittee. Victoria, there are several types of proposed permittees (see below); property owner, HOA, lessee, purchaser with a pending sales agreement, or a developer. You just choose the appropriate one and then fill out the parts of the form noted below. Victoria, I will also need the attached Operation and Maintenance Agreement from you. (Please note that the Excel file has three tabs. All three make up the 0&M Agreement.) I will need documentation from the NC Secretary of State for both companies showing that the corporations are active and in good standing. Please submit the most recent annual report. The person signing for each company needs to have signature authority it do so as listed in the NC SoS's Annual Report (Manager, etc). We will also need the deed and a sales agreement if the project has not yet been sold. We need original signatures as opposed to copies for all of the documents. Please work together to ensure that the package arrives in one piece with both signatures together along with the supporting documentation. When it arrives, it will be assigned to an engineer in our group and that person will review the details and be in touch with any additional items that are needed. For the renewal application, Section C are the submittal requirements. I am not currently seeing any deed restriction language in the current permit, so deed striction language and recorded covenants are most likely not needed for submission. Number 4 is asking if you would like a copy of the current operation and maintenance agreement. We have these recorded already, but please answer that question as box 1 if you already have a copy of the agreement, or box 2, if you do not have a copy of the agreement and I will send one with the permit in the mail as an attachment once the permit is renewed. 23 Number 5 is asking about a designer certification. I believe we already have one on file forth is permit. Box 1 is confirming the project was built in accordance with the approved plans and the certification was already provided to our Division. Numbers 6 and 7 are not yet required for the renewal of this permit, they will be in the future but currently are not. If you have the information for 6 and 7 please do submit. If not, the renewal process will not be held. These items can be listed as NA on the form. I handle all renewals for the state stormwater permits. I have attached some helpful documentation to get this state stormwater permit back into compliance. As discussed on the phone this afternoon, this permit needs a renewal and a transfer to become back to an active, compliant status. Per 15A NCAC 02H. 1045(3) and Section 111.12 of the issued permit dated September 21, 2009, state stormwater permits must be renewed by the current permit holder and applications are due 180 days prior to expiration date. This permit expired December 30, 2021. The current holder of this permit is University Housing Group, Inc. Per permit condition Section 111.2 University Housing Group, Inc. is responsible for the permit and its conditions until otherwise approved by the Division. As stated in the letter you received and the permit issued dated September 21, 2009 25 Section 111.1, permits do not automatically transfer with the sale of property, so this permit is then going to need a transfer. Section 111.11 states the permittee should have notified the Division in writing at least 30 days prior to making ownership changes. Both the current permit holder, and the new property owners are required to sign the transfer application. I did some quick research online and found an address and phone number for the current property owners to begin to assist you with this. Please direct any renewal questions to me.
