The Wilmington Regional Office received and accepted a Post -Construction Stormwater Management Transfer
Permit Application for the subject project on June 15, 2022 and requested additional information on September 7,
2022. A review of the file and delivery logs indicates that, as of this date, the information requested on September
7, 2022 has not been received in this Office within the stipulated timeframe.
Per the requirements of Title 15A NCAC 02H.1045(4)(a)(ii) of the Stormwater Management Rules, this Office is
hereby returning the subject application as incomplete. The $505.00 application fee submitted with the subject
application package has been forfeited and a new fee will need to be provided if you choose to resubmit this
application in the future.
If you wish to pursue transferring this project, you must reapply to the Division. Your application package must
include a completed and signed application form; signed O&M agreement; application fee; and any supporting
documentation necessary to address the items identified in the latest request for additional information.
Please note that Permit Number 090339, issued on February 11, 2022, remains in full force and effect until
modified, renewed or transferred. Please be aware that the construction of any changes to the originally approved
and permitted plans prior to the receipt of a modified permit is a violation of NCGS 143-215.1 and is subject to
enforcement action pursuant to NCGS 143-215.6A.

The Wilmington Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR) received and
accepted a signed Permit Transfer Application Form for the subject project on June 15, 2022. The current and
proposed permittees have requested to transfer the permit in accordance with 15A NCAC 02H.1045(1)(a). A
preliminary in-depth review of the documentation submitted with the transfer request determined that the
application is incomplete, and that additional information is needed.
Since this transfer was submitted under the requirements of 15A NCAC 02H.1045(1)(a), please provide the
following documentation in a single, hard copy submittal package to complete the application:
1. Signature Authority [15A NCAC 02H .1040]: The application lists BBX Apex One Carolina Cove, LLC
as the proposed permittee. However, the deed for the property shows that Carolina Cove (Wilmington)
Owner, LLC owns the property. That entity is managed by BBC Apex One Carolina Cove, LLC per the
North Carolina Secretary of State (NC SoS).
a. Application:
i. Proposed Permittee: Please update the application to list Carolina Cove (Wilmington)
Owner, LLC as the proposed permittee.
ii. Mailing Address: The NC SoS lists the Principal Mailing Address of the proposed
permittee to be as listed at the top of this letter. Please update the application to match
the mailing address on file with the NC SoS.
b. Application Signature: Since BBC Apex One Carolina Cove. LLC is not registered with the NC
SoS as an active corporation the NC SoS does not have record of the manager(s) of this
organization.

3. Clarifications:
a. Options:
i. If Ms. Bitto is listed as a manager of BBC Apex One Carolina
Cove, LLC on the documentation requested by this letter, then
she has signature authority to sign the permitting documents.
ii. If Ms. Bitto is not listed as a manager, then please ensure the
permitting documents (transfer application and Operation and
Maintenance Agreements) are signed by a manager as listed in
the documentation requested.
iii. If a manager intends to transfer signature authority to Ms. Reese
to sign the application documents on their behalf, then please
submit a letter from that manger indicating that Ms. Reese can
sign on his/her behalf.
b. Paperwork: Please ensure the transfer application and O&M agreements
are updated with the correct names, titles, and company names. Please
ensure that original signatures are submitted as opposed to copies.
2. Operation and Maintenance (O&M) Agreements [15A NCAC 02H .1056, .1059 and .1051]: There are
three stormwater systems permitted for this facility. They are 1.) A sand filter, 2,) An Infiltration Basin,
and 3.) A Filter Strip and Level Spreader. 1 have enclosed copies of the current O&M Agreements signed
by the current petmittee as well as blank copies of the O&M Agreements to be signed by an individual
with signature authority for BBC Apex One Carolina Cove, LLC. Please submit the three signature pages
signed by the new owner. Please ensure that original signatures are submitted as opposed to copies.
Notice of Inspection
On June 21, 2022, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources
(DEMLR) inspected the subject project to determine the status of compliance with this permit, most recently
issued on February 11, 2022. DEMLR file review and site inspection revealed that the site is not in compliance
with the terms and conditions of this permit. A copy of the completed form entitled "Compliance Inspection
Report" summarizing the findings of the recent inspection is attached to this letter. Please either address the
following items to demonstrate compliance with the permit or sign and submit the enclosed drafted
Schedule of Compliance. Ifvou choose the Schedule ofComnliance please choose and insert a due
e sinkhole in the infiltration basin needs to be repaired. It may be in line with an underground
pipe. Investigation is needed.
2. Vegetation needs to be cleared from the infiltration basin inlets.
All of the requested information listed above should be received in this Office by September 22, 2022, or the
application will be returned as incomplete. If additional time is needed to submit the requested information,
please email your extension request prior to this due date to the email address provided below with ajustification
and a date of when the requested information will be submitted, which shall be no later than 15 days past the
original due date. Please note that only two letters requesting additional information is allowed in the State
Stormwater Program for a total of 30 days to submit the requested additional information. If the information is
not satisfactorily provided after either the second request or 30 days, the project will be returned. If the project is
returned and you wish to re -submit later, you will need to resubmit all required items at that time, including the
application fee.
Please note that if, upon review of the submitted information or upon a deficient compliance inspection of the
project, it is determined that a maior modification to the permit is required to resolve the compliance issues, the
transfer application will be returned as incomplete. Upon the issuance of the modified permit, and the successful
completion of any work required by the modified permit and/or the restoration of the site to design condition, the
applicant will need to submit an updated transfer application and a new fee to the Division to start the transfer
process over again.

I will keep a maintenance record on this BMP. This maintenance record will be kept in a
log in a known set location. Any deficient BMP elements noted in the inspection will be

— Two to three times a year, grass filter strips will be mowed and the clippings
harvested to promote the growth of thick vegetation with optimum pollutant
removal efficiency. Turf grass should not be cut shorter than 3 to 5 inches and
may be allowed to grow as tall as 12 inches depending on aesthetic requirements
(NIPC, 1993). Forested filter strips do not require this type of maintenance.
— Once a year, the soil will be aerated if necessary.
— Once a year, soil pH will be tested and lime will be added if necessary.
After the filter strip is established, it will be inspected quarterly and within 24 hours
after every storm event greater than 1.0 inch (or 1.5 inches if in a Coastal County).

Pursuant to 15A NCAC 02H.1045 and other applicable statues as reference within
Only complete applications packages will be accepted and reviewed. This form and the required items (with
original signatures) must be sent to the appropriate DEMLR Regional Office, which can be determined by locating
the project on the interactive online map at: http.11deg.nc.gov/contactlregional-offices.
After this application is accepted, DEMLR will conduct a compliance inspection and report any deficiencies to the
current permittee and/or the proposed permittee. Per the state stormwater rules and the state stormwater permit
conditions, the permit shall not be transferred until:
1. the current permittee resolves all non-compliance issues identified in the inspection report,
2. the current permittee negotiates a resolution with the proposed permittee (in writing and signed by both
entities. The negotiated resolution must identify the necessary actions, the responsible party(ies), and the
timelines to correct the deficiencies. The site must either be found in compliance or a copy of the
negotiated resolution must be submitted prior to the transfer of the permit.); or
3. in the case where a transfer falls under G. S. 143-214.7(c2) (see also SL 2011-256), the proposed
permittee resolves all non-compliance issues upon acquiring the permit.
Signature requirements for the named signing official (for current and proposed permittee) most meet the following:
• Corporation - a principal executive officer of at least the level of vice-president,
• Limited Liability Company (LLC) - the designated manager. (Documentation from the NC Secretary of
State or other official documentation must be provided that states the titles and positions held by the
person who signed the application (pursuant to 02H.1040) that shows they have legal authority to sign for
the LLC)
• Municipality - a ranking official or duly authorized employee;
• Partnership or limited partnership - the general partner,
• Sole proprietor,
• The signature of the consultant or other agent shall be accepted on this permit transfer application only if
accompanied by a letter of authorization signed by one of the signatories noted in a-e above, as
applicable.

In accordance with G. S. 143-214.7(c2) (see also SL 2011-256), this type of transfer is allowed only
when all of the following items can be truthfully checked:

system have been conveyed to the unit owners' association or owners' association in
accordance with the declaration;
❑ The declarant has conveyed at least fifty percent (50%) of the units or lots to owners other than
a declarant (provide documentation per submittal requirements below),
❑ The stormwater management system is in compliance with the stormwater permit.
NOTE: If subdivision was built prior to 1999, the Declarant's Attorney can make a determination that
the elements of the Planned Community Act (see §47F) have been met by the Declarant for the
subdivision. If the Declarant chooses to use this type of transfer, the determination must be in
writing, signed by the attorney, and submitted to DEMLR with this form.

when all of the following items can be truthfully checked:

1. A processing fee of five hundred and five dollars ($505.00) per G.S. 143-215.3D(e)(2).
2. Two hard copies (with original signatures) and one electronic copy of this completed form and the

3. For proposed permittees that are corporations or LLC's, documentation from the NC Secretary of
State demonstrating that the proposed permittee is a legal and viable entity able to conduct
business in North Carolina.
4. If Part B, Items 1 or 3 of this form is selected, the signed and notarized
applicable O&M agreement(s) from the proposed permittee, as required by the permit.
5. Legal documentation that the property has transferred to the proposed permittee (such as a
recorded deed for the property, uncompleted development and/or common areas) or legal
documentation demonstrating that the proposed permittee is the sole claimant of the right to
engage in the permitted activity.
6. If required by the permit and if the project has been built, a signed, sealed and dated certification
document from a licensed professional stating that the stormwater management system has been
inspected and that it has been built and maintained in accordance with the approved plans.
7. A copy of the recorded covenants and deed restrictions, if required by the permit. If the project has
been built, documentation that the maximum allowed per lot built -upon area or the maximum
allowed total built -upon area has not been exceeded. If the project has not been built, the new
owner shall provide a signed agreement to submit final recorded deed restrictions and protective
covenants.
8. If transferring under G. S. 143-214.7(c2) (i.e., Part B, Item 2 of this form is selected),
documentation verifying that 50% or more of the lots have been conveyed to individuals (not
builders). Copies of the deeds of conveyance or a chart listing the lot number, lot address,
owner's name, conveyance date and deed book and page number are acceptable.

Ashley just stopped by my office. Evidently she has already processed the Renewal and now you all want to transfer the
permit. It sounds like Jeff's company is the current/outgoing permittee and Victoria is the proposed/incoming
permittee. The transfer form has areas for both of you to sign. Jeff will sign Section D for the current
permittee. Victoria will sign Section E as the proposed permittee. Victoria, there are several types of proposed
permittees (see below); property owner, HOA, lessee, purchaser with a pending sales agreement, or a developer. You
just choose the appropriate one and then fill out the parts of the form noted below. Victoria, I will also need the
attached Operation and Maintenance Agreement from you. (Please note that the Excel file has three tabs. All three
make up the O&M Agreement.) I will need documentation from the NC Secretary of State for both companies showing
that the corporations are active and in good standing. Please submit the most recent annual report. The person signing
for each company needs to have signature authority it do so as listed in the NC SoS's Annual Report (Manager, etc). We
will also need the deed and a sales agreement if the project has not yet been sold. We need original signatures as
opposed to copies for all of the documents.
Please work together to ensure that the package arrives in one piece with both signatures together along with the
supporting documentation. When it arrives, it will be assigned to an engineer in our group and that person will review
the details and be in touch with any additional items that are needed.

Thank you for working to get the renewal and transfer complete for this state stormwater permit. I have been contacted
by Victoria Reese, who I have cc'ed in this email for correspondence for the new property owners of this site.
For the renewal application, Section C are the submittal requirements. I am not currently seeing any deed restriction
language in the current permit, so deed striction language and recorded covenants are most likely not needed for
submission. Number 4 is asking if you would like a copy of the current operation and maintenance agreement. We have
these recorded already, but please answer that question as box 1 if you already have a copy of the agreement, or box 2,
if you do not have a copy of the agreement and I will send one with the permit in the mail as an attachment once the
permit is renewed. Number 5 is asking about a designer certification. I believe we already have one on file for this
permit. Box 1 is confirming the project was built in accordance with the approved plans and the certification was already
provided to our Division. Numbers 6 and 7 are not yet required for the renewal of this permit, they will be in the future
but currently are not. If you have the information for 6 and 7 please do submit. If not, the renewal process will not be
held. These items can be listed as NA on the form.
I handle all renewals for the state stormwater permits. Transfer questions would be best directed to Kelly Johnson at

It seems the first order of business is to complete the renewal application as we work to follow up with new ownership
of the project, agree? I need to confirm exactly what you need with the renewal application. Wes Bradley, developer of
the project, passed away in 2019 so I can work with his father to sign the application on behalf of University Housing
Group, Inc. In addition to the certification on page 3, the check and copy included with the original application
addressed on page 2 in the submittal requirements (#1 and #2) do you need? Unfortunately, I do not have answers for
items #3 - #7 if anything is needed for these items. If this is all you need I should be able to run this down in the next
couple of weeks.
Also, fyi, I have an email of someone who is supposed to be tied to the current ownership group and will cc you on my
email to work through the transfer.

Thank you for contacting me about the renewal request letter received by University Housing Group, Inc. I have
attached some helpful documentation to get this state stormwater permit back into compliance.
As discussed on the phone this afternoon, this permit needs a renewal and a transfer to become back to an active,
compliant status. Per 15A NCAC 02H. 1045(3) and Section 111.12 of the issued permit dated September 21, 2009, state
stormwater permits, must be renewed by the current permit holder and applications are due 180 days prior to expiration
date. This permit expired December 30, 2021. The current holder of this permit is University Housing Group, Inc. Per
permit condition Section 111.2 University Housing Group, Inc. is responsible for the permit and its conditions until
otherwise approved by the Division. As stated in the letter you received and the permit issued dated September 21,
2009 Section 111.1, permits do not automatically transfer with the sale of property, so this permit is then going to need a
transfer. Section 111.11 states the permittee should have notified the Division in writing at least 30 days prior to making
ownership changes.
Both the current permit holder, and the new property owners are required to sign the transfer application. I did some
quick research online and found an address and phone number for the current property owners to begin to assist you
with this.

name, or was it mailed to the Central Office in Raleigh. Did it include the permit number, SW8 090339

Ashley just stopped by my office. Evidently she has already processed the Renewal and now you all
want to transfer the permit. It sounds like Jeff's company is the current/outgoing permittee and Victoria
is the proposed/incoming permittee. The transfer form has areas for both of you to sign. Jeff will sign
Section D for the current permittee. Victoria will sign Section E as the proposed permittee. Victoria,
there are several types of proposed permittees (see below); property owner, HOA, lessee, purchaser
with a pending sales agreement, or a developer. You just choose the appropriate one and then fill out
the parts of the form noted below. Victoria, I will also need the attached Operation and Maintenance
Agreement from you. (Please note that the Excel file has three tabs. All three make up the 0&M
Agreement.) I will need documentation from the INC Secretary of State for both companies showing that
the corporations are active and in good standing. Please submit the most recent annual report. The
person signing for each company needs to have signature authority it do so as listed in the NC SoS's
Annual Report (Manager, etc). We will also need the deed and a sales agreement if the project has not
yet been sold. We need original signatures as opposed to copies for all of the documents.
Please work together to ensure that the package arrives in one piece with both signatures together
along with the supporting documentation. When it arrives, it will be assigned to an engineer in our
group and that person will review the details and be in touch with any additional items that are needed.

Thank you for working to get the renewal and transfer complete for this state stormwater permit. I have
been contacted by Victoria Reese, who I have cc'ed in this email for correspondence for the new
property owners of this site.
For the renewal application, Section C are the submittal requirements. I am not currently seeing any
deed restriction language in the current permit, so deed striction language and recorded covenants are
most likely not needed for submission. Number 4 is asking if you would like a copy of the current
operation and maintenance agreement. We have these recorded already, but please answer that
question as box 1 if you already have a copy of the agreement, or box 2, if you do not have a copy of the
agreement and I will send one with the permit in the mail as an attachment once the permit is renewed.

Number 5 is asking about a designer certification. I believe we already have one on file for this permit.
Box 1 is confirming the project was built in accordance with the approved plans and the certification was
already provided to our Division. Numbers 6 and 7 are not yet required for the renewal of this permit,
they will be in the future but currently are not. If you have the information for 6 and 7 please do submit.
If not, the renewal process will not be held. These items can be listed as NA on the form.
I handle all renewals for the state stormwater permits. Transfer questions would be best directed to

It seems the first order of business is to complete the renewal application as we work to follow up with
new ownership of the project, agree? I need to confirm exactly what you need with the renewal
application. Wes Bradley, developer of the project, passed away in 2019 so I can work with his father to
sign the application on behalf of University Housing Group, Inc. In addition to the certification on page 3,
the check and copy included with the original application addressed on page 2 in the submittal
requirements (#1 and #2) do you need? Unfortunately, I do not have answers for items #3 - #7 if
anything is needed for these items. If this is all you need I should be able to run this down in the next
couple of weeks.

Thank you for contacting me about the renewal request letter received by University Housing Group,
Inc. I have attached some helpful documentation to get this state stormwater permit back into
compliance.
As discussed on the phone this afternoon, this permit needs a renewal and a transfer to become back to
an active, compliant status. Per 15A NCAC 02H. 1045(3) and Section 111.12 of the issued permit dated
September 21, 2009, state stormwater permits must be renewed by the current permit holder and
applications are due 180 days prior to expiration date. This permit expired December 30, 2021. The
current holder of this permit is University Housing Group, Inc. Per permit condition Section 111.2
University Housing Group, Inc. is responsible for the permit and its conditions until otherwise approved
by the Division. As stated in the letter you received and the permit issued dated September 21, 2009

Section 111.1, permits do not automatically transfer with the sale of property, so this permit is then going
to need a transfer. Section 111.11 states the permittee should have notified the Division in writing at least
30 days prior to making ownership changes.
Both the current permit holder, and the new property owners are required to sign the transfer
application. I did some quick research online and found an address and phone number for the current
property owners to begin to assist you with this.

Ashley just stopped by my office. Evidently she has already processed the Renewal and now you all
want to transfer the permit. It sounds like Jeff's company is the current/outgoing permittee and Victoria
is the proposed/incoming permittee. The transfer form has areas for both of you to sign. Jeff will sign
Section D for the current permittee. Victoria will sign Section E as the proposed permittee. Victoria,
there are several types of proposed permittees (see below); property owner, HOA, lessee, purchaser
with a pending sales agreement, or a developer. You just choose the appropriate one and then fill out
the parts of the form noted below. Victoria, I will also need the attached Operation and Maintenance
Agreement from you. (Please note that the Excel file has three tabs. All three make up the 0&M
Agreement.) I will need documentation from the NC Secretary of State for both companies showing that
the corporations are active and in good standing. Please submit the most recent annual report. The
person signing for each company needs to have signature authority it do so as listed in the NC SoS's
Annual Report (Manager, etc). We will also need the deed and a sales agreement if the project has not
yet been sold. We need original signatures as opposed to copies for all of the documents.
Please work together to ensure that the package arrives in one piece with both signatures together
along with the supporting documentation. When it arrives, it will be assigned to an engineer in our
group and that person will review the details and be in touch with any additional items that are needed.

Thank you for working to get the renewal and transfer complete for this state stormwater permit. I have
been contacted by Victoria Reese, who I have cc'ed in this email for correspondence for the new
property owners of this site.
For the renewal application, Section C are the submittal requirements. I am not currently seeing any
deed restriction language in the current permit, so deed striction language and recorded covenants are
most likely not needed for submission. Number 4 is asking if you would like a copy of the current
operation and maintenance agreement. We have these recorded already, but please answer that
question as box 1 if you already have a copy of the agreement, or box 2, if you do not have a copy of the
agreement and I will send one with the permit in the mail as an attachment once the permit is renewed.

Number 5 is asking about a designer certification. I believe we already have one on file forth is permit.
Box 1 is confirming the project was built in accordance with the approved plans and the certification was
already provided to our Division. Numbers 6 and 7 are not yet required for the renewal of this permit,
they will be in the future but currently are not. If you have the information for 6 and 7 please do submit.
If not, the renewal process will not be held. These items can be listed as NA on the form.
I handle all renewals for the state stormwater permits. Transfer questions would be best directed to

It seems the first order of business is to complete the renewal application as we work to follow up with
new ownership of the project, agree? I need to confirm exactly what you need with the renewal
application. Wes Bradley, developer of the project, passed away in 2019 so I can work with his father to
sign the application on behalf of University Housing Group, Inc. In addition to the certification on page 3,
the check and copy included with the original application addressed on page 2 in the submittal
requirements (#1 and 42) do you need? Unfortunately, I do not have answers for items #3 - #7 if
anything is needed for these items. If this is all you need I should be able to run this down in the next
couple of weeks.
Also, fyi, I have an email of someone who is supposed to be tied to the current ownership group and will
cc you on my email to work through the transfer.

Thank you for contacting me about the renewal request letter received by University Housing Group,
Inc. I have attached some helpful documentation to get this state stormwater permit back into
compliance.
As discussed on the phone this afternoon, this permit needs a renewal and a transfer to become back to
an active, compliant status. Per 15A NCAC 02H. 1045(3) and Section 111.12 of the issued permit dated
September 21, 2009, state stormwater permits must be renewed by the current permit holder and
applications are due 180 days prior to expiration date. This permit expired December 30, 2021. The
current holder of this permit is University Housing Group, Inc. Per permit condition Section 111.2
University Housing Group, Inc. is responsible for the permit and its conditions until otherwise approved
by the Division. As stated in the letter you received and the permit issued dated September 21, 2009

Section 111.1, permits do not automatically transfer with the sale of property, so this permit is then going
to need a transfer. Section 111.11 states the permittee should have notified the Division in writing at least
30 days prior to making ownership changes.
Both the current permit holder, and the new property owners are required to sign the transfer
application. I did some quick research online and found an address and phone number for the current
property owners to begin to assist you with this.
