VAN DER VAART Secretary TRACY DAVIS Director On ]December 8, 2016, the Wilmington Regional Office received a complete request to revise the approved plans for Stormwater Management Permit Number SW8 050117. The revisions include the construction of a building addition on Lot 22A. The development of Lot 22A had been previously approved as a plan revision to this permit and at this time has not elected to make the changes necessary to obtain an offsite permit. This addition will utilize 17,626.12 square feet of future built -upon area allocated to Lot 22A which will reduce the amount of built -upon area available for future construction within Lot 22A to 36,612.79 square feet as documented in the attached table. It has been detennined that a formal permit modification is not required for the proposed changes. We are forwarding you an approved copy of the revised plans for your files. Please replace the old approved plan sheets for Lot 22A Nvith the new ones, attached. Please be aware that all terns and conditions of the permit revised and updated on February 10, 2016, remain in full force and effect. Please also understand that the approval of this revision to the approved plans for the subject State Stormwater project is -done on a case -by -case basis. Any other changes to this project must be approved through this Office prior to construction. The issuance of this plan revision does not preclude the permirtee from complying with all other applicable statutes, rules,, regulations or ordinances which may havejurisdiction over the proposed activity, and obtaining a permit or approval prior to construction. All runoff from this development will sheet flow into existing drainage ditches on the west, north and east sides of the property. Runoff that sheetflows to the south enters Mattie St. and is picked up by a nearby catch basin. The ditches and storm drain network convey the runoff to the existing master detention pond with all runoff from impervious surfaces being captured and delivered to the forebay of the pond. The project is located within the White Oak River basin and is closest to a tributary of the Newport River, Class C waters. There are no wetlands on Lot 22A. The proposed Erosion Control Plan will consist of perimeter silt fence and the disturbed area is approximately 0.55 acres. Therefore an erosion control permit is not required. In looking at the master permit, the BUA constructed on this lot, Lot 22A, is already approved under the master permit. The property owner for Lot 22A may elect to obtain their own offsite permit as you have requested, however, the master permit will also need to be revised to remove the development of this lot. Alternatively, they can just revised the master permit to demonstrate how the future BUA is being used on the lot. There are pros and cons both ways. However, if you elect to obtain an offsite permit, the plan revision would have to be submitted for processing at the same time through Express as well. Let us know what works best for your client. Operation and Maintenance: a. June 30, 2016 Inspection: This inspection was completed in response to a complaint that a neighboring property was creating a ditch that would drain to this permit. However, DEMLR staff found that this ditch did not appear to impact the permit. The remainder of the subdivision was not inspected during this visit. May 20, 2014 Inspection: Please see the enclosed Notice of Inspection from 2014. 1 understand that you intend to transfer this permit to the Property Owners' Association in the near future. This project will be inspected during the transfer process, and it will need to be in compliance to transfer. Please ensure that the items found in 2014 have been addressed. I have enclosed a copy of the Operation and Maintenance Agreement (which begins on page 2 of the "Wet Detention Pond Supplement"), which summarizes general maintenance procedures. Deed Restrictions: I have enclosed an agreement between Warren Benton and Richard Wayne See to reallocate impervious area among lots in the subdivision. Please submit recorded deed restrictions reflecting the revised impervious area per lot to match Attachment A of your February 10, 2016 permit. 3.
