On ]December 8, 2016, the Wilmington Regional Office received a complete request to revise the
approved plans for Stormwater Management Permit Number SW8 050117. The revisions include the
construction of a building addition on Lot 22A. The development of Lot 22A had been previously
approved as a plan revision to this permit and at this time has not elected to make the changes necessary
to obtain an offsite permit. This addition will utilize 17,626.12 square feet of future built -upon area
allocated to Lot 22A which will reduce the amount of built -upon area available for future construction
within Lot 22A to 36,612.79 square feet as documented in the attached table. It has been detennined that
a formal permit modification is not required for the proposed changes. We are forwarding you an
approved copy of the revised plans for your files. Please replace the old approved plan sheets for Lot 22A
Nvith the new ones, attached.
Please be aware that all terns and conditions of the permit revised and updated on February 10, 2016,
remain in full force and effect. Please also understand that the approval of this revision to the
approved plans for the subject State Stormwater project is -done on a case -by -case basis. Any other
changes to this project must be approved through this Office prior to construction. The issuance of
this plan revision does not preclude the permirtee from complying with all other applicable statutes,
rules,, regulations or ordinances which may havejurisdiction over the proposed activity, and obtaining
a permit or approval prior to construction.

I. General Information
Stroud Engineering, P.A. is requesting an Express Review for a Permit Modification to the
"Richard Wayne See Property" Master Stormwater Permit #: SW8 05011.7. This proposed
modification is specific to Lot 22A (formerly Lots 21 & 22) which is owned by the Neal Foundation
Trust. Lot 22A within Richard Wayne See Property is located at 5038 Mattie St. in Morehead City,
NC. This property currently has an existing parking lot, PAWS adoption information building and
fenced in dog park for patrons. This Permit Modification request if for the expansion of the
adoption center to include veterinary services, viewing areas for pets to be adopted and the
associated infrastructure necessary to run the PAWS center. Lot 22A of Richard Wayne See
Property is 93,715.1.0 square feet (sf) with an allowable impervious area of 74,972.08 sf. This existing
parcel currently has 20,733.17 sf of impervious area. The proposed building, drive and sidewalk
additions will add 17,626.12 sf of impervious area. The remaining allowable impervious area of
36,612.79 sf will be permitted as "Future Impervious". All runoff from this development will sheet
flow into existing drainage ditches on the west, north and east sides of the property. Runoff that
sheetflows to the south enters Mattie St. and is picked up by a nearby catch basin. The ditches and
storm drain network convey the runoff to the existing master detention pond with all runoff from
impervious surfaces being captured and delivered to the forebay of the pond. The project is located
within the White Oak River basin and is closest to a tributary of the Newport River, Class C waters.
There are no wetlands on Lot 22A.
The proposed Erosion Control Plan will consist of perimeter silt fence and the disturbed area is
approximately 0.55 acres. Therefore an erosion control permit is not required.

Business Park development permit number is: SW8 050117. This proposed development
of an adopted pet facility within Wayne See Business Park is located at 5038 Mattie St. in
Morehead City, NC. Lot 22A of Wayne See Business Park is 93,715.10 square feet (sf) with
an allowable impervious area of 74,972.08 sf. This existing parcel currently has 20,561.40 sf
of impervious area. The proposed building, drive and sidewalk additions will add 19,457
sf of impervious area. The remaining allowable impervious area of 34,953.68 sf will be
permitted as "Future Impervious". All runoff from this development will sheet flow into
existing drainage ditches and be conveyed to the existing detention pond with all runoff
from impervious surfaces being captured and delivered to the forebay of the pond by the

Chase,
Cameron just approached me to schedule the submittal meeting for this project. In looking at the master permit, the
BUA constructed on this lot, Lot 22A, is already approved under the master permit. The property owner for Lot 22A may
elect to obtain their own offsite permit as you have requested, however, the master permit will also need to be revised
to remove the development of this lot. Alternatively, they can just revised the master permit to demonstrate how the
future BUA is being used on the lot. There are pros and cons both ways.
However, if you elect to obtain an offsite permit, the plan revision would have to be submitted for processing at the
same time through Express as well.

On June 30, 2016, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) inspected the subject project, located at on Mattie Street in Morehead City in
Carteret County to determine the status of compliance with the State Stormwater Management Permit
Number SW8 050117 issued most recently on February 10, 2016. 1 received a call from one of the
property owners in the subdivision who has concerns about maintenance, and so I did a follow file review
on August 15, 2016 in order to ensure that you are aware of the maintenance requirements.
Operation and Maintenance:
a. June 30, 2016 Inspection: This inspection was completed in response to a complaint that
a neighboring property was creating a ditch that would drain to this permit. However,
DEMLR staff found that this ditch did not appear to impact the permit. The remainder of
the subdivision was not inspected during this visit.
May 20, 2014 Inspection: Please see the enclosed Notice of Inspection from 2014. 1
understand that you intend to transfer this permit to the Property Owners' Association in
the near future. This project will be inspected during the transfer process, and it will need
to be in compliance to transfer. Please ensure that the items found in 2014 have been
addressed. I have enclosed a copy of the Operation and Maintenance Agreement (which
begins on page 2 of the "Wet Detention Pond Supplement"), which summarizes general
maintenance procedures.
Deed Restrictions: I have enclosed an agreement between Warren Benton and Richard Wayne
See to reallocate impervious area among lots in the subdivision. Please submit recorded deed
restrictions reflecting the revised impervious area per lot to match Attachment A of your February
10, 2016 permit.
3. PE Certification: The certification was completed on July 11, 2006.

signed Name/Ownership Change Form to the Division of Energy, Mineral and Land Resources 30-60
calendar days prior to making any of the below listed changes. These forms are available on our website

a. An ownership change including the sale or conveyance of the permitted project area in whole or
in part. This does not include the conveyance of subdivided residential lots to individuals which
are made subject to a recorded declaration of covenants and restrictions which contain the
statements required by the stormwater permit;
b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's
Association, subject to the requirements of Session Law 201 1-256;
c. Foreclosure proceedings;
d. Filing for Bankruptcy;
e. Dissolution of the partnership or corporate entity. Per NCGS 57D-6-07, a dissolved LLC shall
wind up, which may include continuing the business of the LLC for a period of time. The person
charged with winding up the LLC shall collect the LLC's assets [which include the stormwater
management permit], and distribute the assets as provided in NCGS 57D-6-08(2).
f. A name change of the owner / permittee;
g. A name change of the project;
h. A mailing address change of the permittee;
Please be advised that until you submit the required Name/Ownership Change Form to the Division and
receive approval from the Division to transfer the permit, you are required to comply with the terms,
conditions and limitations of the Stormwater Management Permit under Title 15A North Carolina
Administrative Code 2H .1003 and North Carolina General Statute 143-214.7, including the operation
and maintenance of the permitted stormwater system.
Please also note that any individual or entity found to be in noncompliance with the provisions of a
stormwater management permit or the stormwater rules is subject to enforcement action as set forth in
NCGS 143 Article 21, including the assessment of civil penalties of up to $25,000 per day.

I pulled the master permit, SW8 050117, and found that it has not yet applied to be transferred to the Property Owners'
Association. It looks like we did an inspection in June following a complaint that we received about a neighbor putting in
a ditch. The inspector who did that is out on other inspections, but I will check the status with him.
