Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified. Please note that this permit references DEMLR as the Division responsible for issuance of the
permit.
Permit Extension
On August 5, 2009, the Governor signed Session Law 2009-406. This law impacted any development
approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General
Statutes, which was current and valid at any point between January 1, 2008, and December 31, 2010. The
law extended the effective period of any stormwater permit that was set to expire during this time frame
to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law
2010-177, which granted an extra year for a total of four (4) years extension. Accordingly, this permit
shall now be effective from the date of issuance until February 23, 2019, which includes all available
extensions.
Approved Plan Revision .
On January 13, 2016, the Wilmington Regional Office received a complete request to revise the approved
plans for Stormwater Management Permit Number SW8 050117. The revisions include the combination
of lots 21 and 22 to create lot 22A, the combination of lots 23 and 24 to create lot 24A, the change in
BUA allocation between lots 24A and 25, and to approve the built -upon area constructed on lots 11, 15,
17, 18, 22A, 24A, 25, 26, and 27 for which offsite permits have not been obtained. Please note that Lots
9, 16, 19, and 30 have obtained their own offsite permits. Attachment A to the permit attempts to clarify
the current approved status of the development.
It has been determined that a formal permit modification is not required for the proposed changes. We are
forwarding you an approved copy of the revised plans for your files. Please add the attached plans to the
previously approved plan set. Please replace the previously issued permit with the revised and updated
permit, dated February 10, 2016, attached. Please note that the revised and updated permit does not
impose new or different terms, it merely restates some of the previous terms to provide you with a better
understanding of your obligations under the permit.
Please be aware that all terms and conditions of the permit issued on February 23, 2005, remain in
full force and effect, including the requirement to revue or amend the recorded deed restrictions
with the updated built -upon area allocations. Please also understand that the approval of this
revision to the approved plans and to the permit for the subject State Stormwater project are done on a
case -by -case basis. Any other changes to this project must be approved through this Office prior to
construction. The issuance of this plan revision does not preclude the permittee from complying with
all other applicable statutes, rules, regulations or ordinances which may have jurisdiction over the
proposed activity, and obtaining a permit or approval prior to construction.

construction, operation and maintenance of one (1) wet detention pond in compliance with
the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules') and
the approved stormwater management plans and specifications and other supporting data as
attached and on file with and approved by the Division of Energy, Mineral and Land
Resources (hereafter referred to as the Division or DEMLR) and considered a part of this
permit.
This permit shall be effective from the date of issuance until February 23, 2019, and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. The subdivision is permitted for 20 lots, each limited to a maximum amount of built -
upon area as indicated in Attachment A of this permit.
3. This stormwater system has been approved for the management of stormwater runoff
as described in Section 1.8 of this permit. The stormwater control has been designed to
handle the runoff from 992,273 square feet of impervious area.
4. The tract will be limited to the amount of built -upon area indicated in Section 1.8 of this
permit, Attachment A of the Restrictive Covenants, the required amendment to the
recorded Declaration of Covenants, Conditions, and Restrictions as submitted on
January 13, 2016, and per the approved plans.
5. All stormwater collection and treatment systems must be located in either dedicated
common areas or recorded easements. The final plats for the project will be recorded
showing all such required easements, in accordance with the approved plans.
6. The runoff from all built -upon area within the permitted drainage area of this project
must be directed into the permitted stormwater control system.

7. Prior to the discharge of stormwater runoff from any lot into the approved stormwater
system, the permittee shall either ensure that the owner of the lot has obtained a
separate Offsite Stormwater Management Permit or, as required in Section 11.12 of this
permit, the permittee shall request a plan revision to this permit to document the
proposed improvements.

II. SCHEDULE OF COMPLIANCE
No person or entity, including the permittee, shall alter any component of the approved
stormwater system shown on the approved plans unless and until the Division has
approved of the revised plan.
2. The stormwater management system shall be constructed in its entirety, vegetated
and operational for its intended use prior to the construction of any built -upon surface.
During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
4. The permittee shall at all times provide the operation and maintenance necessary to
assure that all components of the permitted stormwater system function at design
condition. The approved Operation and Maintenance Agreement is incorporated by
reference into this permit and must be followed in its entirety and maintenance must
occur at the scheduled intervals.
5. Records of maintenance activities must be kept and made available upon request to
authorized personnel of the Division. The records will indicate the date, activity, name
of person performing the work and what actions were taken.
6. Decorative spray fountains will be allowed in the stormwater treatment system, subject
to the following criteria:
a. The fountain must draw its water from less than 2' below the permanent pool
surface.
b. Separated units, where the nozzle, pump and intake are connected by tubing,
may be used only if they draw water from the surface in the deepest part of the
pond.
c. The falling water from the fountain must be centered in the pond, away from the
shoreline.
d. The maximum horsepower for a fountain in this pond is 1.0 horsepower.

7. The facilities shall be constructed as shown on the approved plans. This permit shall
become voidable unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other supporting
d ata.
8. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that the permitted facility has
been installed in accordance with this permit, the approved plans and specifications,
and other supporting documentation. Any deviations from the approved plans and
specifications must be noted on the Certification. A modification may be required for
those deviations.
If the stormwater system was used as an Erosion Control device, it must be restored
to design condition prior to operation as a stormwater treatment device, and prior to
occupancy of the facility.
10. Access to the stormwater facilities shall be maintained via appropriate easements at
all times.
11. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below:
a. Any revision to any item shown on the approved plans, including the stormwater
management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project area.
The project area is defined as all property owned by the permittee, for which
Sedimentation and Erosion Control Plan approval or a CAMA Major permit was
sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
12. The permittee shall submit final site layout and grading plans for any permitted future
areas shown on the approved plans, prior to construction.
13. A copy of the approved plans and specifications shall be maintained on file by the
Permittee for a minimum of ten years from the date of the completion of construction.
14. Prior to transfer of the permit, the stormwater facilities will be inspected by Division
personnel. The project and the stormwater facility must be in substantial compliance
with all permit conditions. Any items not in substantial compliance must be repaired,
replaced or restored to design condition prior to the transfer. Records of maintenance
activities performed to date will be required.
15. The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of.the permit. Within the time frame specified in the
notice, the permittee shall submit a written time schedule to the Director for modifying
the site to meet minimum requirements. The permittee shall provide copies of revised
plans and certification in writing to the Director that the changes have been made.
III. GENERAL CONDITIONS
Any individual or entity found to be in noncompliance with the provisions of a
stormwater management permit or the Stormwater rules is subject to enforcement
procedures as set forth in NCGS 143 Article 21.

2. This permit is not transferable to any person or entity except after notice to and
approval by the Director. The permittee shall submit a completed and signed
Name/Ownership Change Form, accompanied by the supporting documentation as
listed on the form, to the Division at least 60 days prior to any one or more of the
following events:
a. An ownership change including the sale or conveyance of the project area in
whole or in part, except in the case of an individual lot sale that is made subject to
the recorded deed restrictions;
b. The sale or conveyance of the common areas to a Homeowner's or Property
Owner's Association, subject to the requirements of Session Law 2011-256;
c. Bankruptcy;
d. Foreclosure;
e. Dissolution of the partnership or corporate entity;
f. A name change of the current permittee;
g. A name change of the project;
h. A mailing address change of the permittee;
3. The permittee is responsible for compliance with all permit conditions until such time
as the Division approves the transfer request. Neither the sale of the project, in whole
or in part, nor the conveyance of common area to a third party constitutes an approved
transfer of the stormwater permit.
4. The issuance of this permit does not preclude the Permittee from complying with any
and all statutes, rules, regulations, or ordinances, which may be imposed by other
government agencies (local, state, and federal) having jurisdiction.
5. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including
those as may be required by this Division, such as the construction of additional or
replacement stormwater management systems. Additional or replacement stormwater
management systems shall receive a permit from the Division prior to construction.
6. The permittee grants DEMLR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
The permit may be modified, revoked and reissued or terminated for cause. The filing
of a request for a permit modification, revocation and reissuance or termination does
not stay any permit condition.
Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
Approved plans and specifications for this project are incorporated by reference and
are enforceable parts of the permit.
10. The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit as
allowed by the laws, rules and regulations contained in Session Law 2006-246, Title
15A NCAC 2H.1000, and NCGS 143-215.1 et.al.

11. The permittee shall submit a permit renewal application request at least 180 days prior
to the expiration date of this permit. The renewal request must include the appropriate
application, documentation and the processing fee.

Certification Requirements:
1. The drainage area to the system contains approximately the permitted acreage.
2. The drainage area to the system contains no more than the permitted amount
of built -upon area.
3. All the built -upon area associated with the project is graded such that the runoff
drains to the system.
4. All roof drains are located such that the runoff is directed into the system.
5. The outlet/bypass structure elevations are per the approved plan.
6. The outlet structure is located per the approved plans.
7. Trash rack is provided on the outlet/bypass structure.
8. All slopes are grassed with permanent vegetation.
9. Vegetated slopes are no steeper than 3:1.
10. The inlets are located per the approved plans and do not cause short-circuiting
of the system.
11. The permitted amounts of surface area and/or volume have been provided.
12. Required drawdown devices are correctly sized per the approved plans.
13. All required design depths are provided.
14. All required parts of the system are provided, such as a vegetated shelf, and a
forebay.
15. The required system dimensions are provided per the approved plans.

This agreement and amendment to the recorded Declaration of Covenants, Conditions and
Restrictions for Wayne See Business Park is made this the 8'h day of October, 2015, by and
between Notneb. LLC hereinafter referred to as Notneb 1 and Notneb 2.
Whereas Notneb, LLC is the owner of Lot 24A, of Wayne See Business Park, recorded in DB
1209 PG 44 and Notneb, LLC is the owner of Lot 25, recorded in DB 1296 PG 279 each of
which is subject to the Declaration of Covenants, Conditions and Restrictions for recorded on
May 30, 2006 in Deed Book 1174, Page 163 of the Carteret County Registry; and
Whereas, the Declaration of Covenants, Conditions and Restrictions sets forth a maximum
amount of built -upon area per lot, as required by Stormwater Management Permit No. SW8
050117, issued pursuant to the requirements of Title 15A NCAC 21-I.1000, the Coastal
Stormwater Management Regulations currently allows that Lot 24A is limited to a maximum of
76,074.96 square feet of built -upon area and Lot 25 is limited to a maximum of 34,291.53 square

Management Permit for the Wayne See Property on October 16, 2015. A preliminary in-depth review of
that information has determined that the application is not complete. The following information is needed
to continue the Stormwater review:

parking areas, buildings, etc. Please also ensure to provide documentation identifying the amount
of built -upon area located on Lot 26.
Please remember that a change to one number may have a domino effect on other numbers. Please check
all plans, calculations and forms to ensure that the numbers are consistent throughout.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received in this Office prior to January 21, 2016, or the application will
be returned as incomplete. The return of a project will necessitate resubmission of all required items,
including the application fee.

extension to the Division at the address and fax number at the bottom of this letter. The request must
indicate the date by which you expect to submit the required information, which shall be no later than 30

Stroud Engineering, P.A. is requesting to update the current Master Stormwater Permit, Permit 4:
SW8 050117 for Wayne See Business Park in Morehead City, NC. This request will address the following
changes from the original plan:
1. Combination of lots within the business park.
2. Trading of impervious allotment between two lots.
3. Updating the built upon areas per lot within the business park.
Since the approval of the original stormwater permit there has been the recombination of 4 original
lots into 2 new lots. The original lots 21 and 22 have been combined into Lot 22A. The original lots 23
and 24 have been combined into Lot 24A. The maximum allowable impervious of the original lots were
added together in creation of the new lots, respectively. These lot combinations are shown on the
attached 2436 Stormwater Plan.
®Of the current developed lots, Lot 24A exceeds its allotment of impervious BUA by 5,865.74 square
feet. As a result of this infringement a "BUA Trade Letter" is included in Appendix A of this submittal in
order to regain compliance with the master permit. The owner of Lots 24A and 25 is Notneb, LLC. Lot
25 has an excess of BUA in the amount of 21,516.53 square feet and the owner has agreed to trade
5,870.00 square feet of this excess to Lot 24A. This trade agreement is detailed and signed by the
owner, Notneb, LLC and the original permittee, Wayne See Subdivision.
3 The Master Permit provides a maximum allowable impervious built upon area for lots 9 through 30
within the business park. The intent for the master permit is to have the original permittee update
NCDENR with as -built BUA totals as the lots are developed. An alternative to this process is to have the
individual lot developer apply for an Off -site Stormwater Permit demonstrating they are under the
maximum allowable BUA and draining to the stormwater pond in the business park. There has been a
combination of these two strategies in trying to keep the permit up-to-date with NCDENR. Stroud
Engineering, P.A. is submitting this additional information in an attempt to update the master permit
status for Wayne See Business Park and to demonstrate compliance with the master permit.
At this point four different lot developers have filed for off -site stormwater permits within the
business park. These lots and their respective stormwater permit numbers are:

There are currently 7 lots that remain undeveloped at this time and Stroud Engineering is

remaining developed lots are in compliance with their maximum allowable impervious areas as detailed
in Appendix B of this package. The impervious areas were calculated utilizing aerial photography. They
are also denoted as developed on the 2436 map attached to this letter.

You will need a narrative or good description of what you are requesting. Based on one of my earlier a -mails
below, I suggested 3 different actions that should to be completed at the same time. Based on what you have
provided, it is unclear what the extent of the submittal will be.
• You might want to consider adding a column to the table on the plans (or separate document) to ID those lots
that obtained their own offsite permit and the ones who are to remain permitted under the master permit
through a plan revision. I have attached a pdf of the master table we have created in an attempt to keep up
with this master permit
• If you are looking to get the BUA constructed on the lots approved, we will need two copies of any plans
necessary to support those.

Hey christine, my memory says that I sent you all of the information on the existing sites and showed compliance for the
lots based on the plans submitted to the town etc, ( not compiled by Stroud). Where I think we are is for the new
association to initiate their first meeting and elect officers. I believe the association has been established by Mr. Goines,

I appreciate the status update on this project and am glad the majority is so amenable to cooperating. I might be able to
provide some good news. Do you recall a few years ago, the Governor gave up to a 4 year extension on all active
permits? This extension gave SW8 050117 a new expiration date of February 23, 2019. DEMLR is trying to relay this
information to the permittees as we can and I noticed a letter hasn't been sent yet for this project. I can certainly send
one out if you'd like an official notice of the new expiration date.
The combination of lots 24A and 25 can be noted as part of the plan revision submitted to document the final site design
(assuming they will not be submitting an application for an offsite permit).
As for lot 16, as long as the pond has been repaired and is functioning as intended, then there should be no problem
with submitting Lot 16. The rest is just getting the paperwork straightened out.

Please forgive the large typeface — it's getting more and more difficult to read that small type
as I get older.
We corresponded a little over a year ago regarding the stormwater compliance issues at this
site. Please bear with me as I summarize the events that have taken place to date:
A high density permit (copy attached) was issued to the Morehead City -Beaufort Elks Lodge
#1710 on May 19, 2004. The applicant was Samuel Lee Hughes, Trustee.
A few months later, in October 2004, staff of the Sediment and Erosion Control program
inspected the site and noted that the wet detention pond which was approved to act as the
required sediment basin had not been constructed.
About months later, in December 2004, the Division received an email from Chad Turner
with Stroud Engineering requesting some information about how to modify the Elks permit. It
seemed that a new commercial subdivision development, the Wayne See Property, had
included the Elks development in their own wet pond design, as offsite drainage area. Mr.
Turner desired information on how to eliminate the Elks pond now that the runoff would be
taken care of in another pond. I provided Mr. Turner with the information he needed to make
that happen. The biggest concern at the time was if the necessary legal agreements and
financial arrangements had been made between Mr. See and the Elks for the maintenance of
the pond.
I waited for the permit modification to be submitted, but after 30 days, a notice of Violation
was sent to the Elks Lodge on January 4, 2005 for failing to construct the required pond before
constructing the building. Ms. Ginger Turner with Stroud Engineering responded by letter on
February 1, 2005, that the stormwater runoff from the Elks Lodge would be treated in the
Wayne See Property pond and that a modification to the Elks Lodge permit would be
forthcoming within the "next couple of weeks". The modification would be to verify how the
built -upon areas of the Elks Lodge site are graded to drain to the Wayne See pond, and to
change the regulated activity from "High Density Wet Detention Pond" to "offsite." This

required modification was never received. I later learned that there might have been some--.
unresolved financial issues between the Elks and Mr. See regarding pond maintenance fees.
Based on the October 1, 2014 inspection that I did, the piped collection system was not
installed and runoff is allowed to sheet flow over the open grass areas to the surrounding
ditches where it is conveyed to the Wayne See pond. Can you please verify that?
The Wayne See permit was issued on February 23, 2005, and included the Elks Lodge as offsite
drainage. The only thing left to do was to modify the Elks Lodge permit to reflect this change.
Unfortunately, despite numerous emails to the consultant and to you, and letters to Mr.
Hughes, no one has submitted the necessary paperwork to request that the Elks Lodge permit
be modified. It remains as a high density permit and will expire on May 19, 2019. If you do not
modify the permit before that date, you will receive a request to renew the permit about a
year before it expires and you will have to pay a $505.00 renewal fee every 8 years. If you
modify the permit to offsite, you only have to pay the $505.00 fee once because the offsite
permit will not expire and does not require renewal. Furthermore, I will check with our staff in
Raleigh to see if a fee to change the regulated activity of your permit is even necessary.
In July 2013, you and I emailed each other regarding your desire to add a temporary RV park
with space for up to 10 units. My response to you was that because your permitted pond was
not built, and because your runoff was accounted for as offsite drainage in the Wayne See
permit, your ability to add more BUA to your site is limited by the capacity of the Wayne See
pond. The Wayne See pond permit allocates only 80,730 square feet of built -upon area to the
Elks Lodge. Adding built -upon area to your site beyond that amount will require that Mr. See
approve of it, and he will have to submit a modification to his permit to account for any
increases of BUA on your property. The pond's surface area and volume were designed based
on a maximum amount of built -upon area. If that maximum is exceeded, the function of the
pond may no longer meet the state requirements. Likewise, if.any of the permitted lots in the
Wayne See subdivision exceed their permitted maximum, Mr. See would have to apply for a
modification to address that increase as well. We are currently dealing with Mr. See and his
consultant, Ron Cullipher, P.E., with Stroud Engineering to address those issues.
You will only be able to add built -upon area to your site in excess of 80730 sf if you do one of
two things: 1) Build the pond that was permitted for your site; or 2) work with Mr. See to
modify his permit to account for more built -upon area on your property, and negotiate a fair
amount to contribute to the Property Owners Association toward the maintenance costs of
the pond.
I am very willing to discuss these matters in greater detail with you face to face, or to take
your phone call. For the benefit of the Elks members, who include my father and my husband,
at the Wilmington Lodge #532, 1 am reaching out to you to get this permit matter resolved so
we can all move forward. Please expect to receive a letter and inspection report from the

wDMsion of Energy, Mineral and Land Resources in the next few days. This letter will summarize
these events and will require a response by November 10, 2014, to avoid possible
enforcement action, fines and penalties.

I'm catching up on paperwork and had a chance to look at the items you have complied for the Wayne See Property
permit, SWS 050117. Typically in situations where offsite permits were not required by the original permit and offsite
permits are not sought by lot owners on their own, we ask that the permittee submit a plan revision as each lot is
developed in order to demonstrate that the lot BUA has not exceeded the allocated amount.
For this project, it looks like a plan revision is needed to document: a) the combination of a few lots, b) the amount of
built -upon area constructed on these lots, and c) the change in BUA allocation between the NOTNEB lots. I've attached
the trading BUA form and instructions that has been put together with residential lots in mind, but I think some of it can
be applicable to this situation as well.

I am helping Ron Cullipher at Stroud Engineering with correcting any deficiencies that may exist with regard to
the stormwater permit issued for the Wayne See property here in Carteret County — Permit No. SW8 050117.
I have attached the documents that I intend to use and want to briefly explain what has transpired and my
proposed steps of corrective action.
There was an original declaration of covenants and restrictions placed upon the property. In the event you do
not have it handy, I have attached it. It is recorded in Book 1174. at Page 163 of the Carteret County Registry. He
basically recorded the permit. Therefore, the impervious area requirements are already of record and are imposed
upon the property.
I intend to form a property owner's association. A copy of the proposed Articles of Incorporation is attached. I
have consulted with the gentlemen listed as directed, and they have agreed to serve. They are all experienced in these
matters and own property in the area.
I have also attached a proposed set of bylaws for the Property Owners Association.
I have attached a set of supplemental declarations that I intend to impose upon the property. The Declarant
still owns four lots. The supplemental declaration imposes upon those four lots the burden of being assessed for the
costs of maintaining the permit should the Property Owner's Association not have sufficient funds to do so from other
sources. Since the other lots have already been deeded out before the imposition of this burden of assessment, they
cannot be assessed. However, it is hoped and believed that many will financially contribute on a voluntary basis.
There are some discussions whereby the Declarant may actually deed one of his lots to the Property Owner's
Association so that it may be sold or leased in order to generate the funds to maintain the permit. Whether or not that
occurs, the Property Owner's Association has the right to assess the four listed lots pursuant to the supplemental
declaration.
At the appropriate time, Ron Cullipher intends to transfer the permit from Wayne See, the original Declarant, to
the Property Owner's Association. When that occurs, I will prepare a deed from the Declarant to the Property Owner's
Association for the detention pond and the corrective process should be complete. In addition, the mechanism to
maintain the permitted system should also be in place.
I will be happy to answer any questions that you may have. If my proposed corrective actions seem to be
adequate for your needs, please let me know. I will go ahead and organize the Property Owner's Association so that it
will be "in being' when Ron Cullipher wishes to transfer the permit.

Dear Christine and Brian,
As indicated in various emails, we have received a copy of the above referenced letter from Mr.
Wayne See. We have had the overflow structure repaired and the resulting wash out of the forebay has
been stabilized with rip rap. Mr. See continues to work on the grass around the pond that was disturbed
and the grass is starting to germinate. Mr. See, also re -sloped portions of the northern perimeter ditch
and has seeded those areas recently disturbed as well. Mr. See has had some opposition to do anymore
improvements and as such I asked him to stop until Brian has an opportunity to re -visit the site.
For the developed lots, the way the subdivision was designed, all of the external perimeter
ditches and the internal ditch and city street system drain to the existing stormwater pond. Thereby any
runoff from the developed sites properly gets into the treatment bmp. As I indicated in an earlier email,
I was able to obtain most of the site plans from the Town of Morehead City Planning Department for the
lots. Most were very simple plans and I have used them and goggle earth to estimate lot coverage.
(Much of the coverage is gravel and I am counting that as impervious even though I am not sure where
that legislation stands.) I will attach my findings and the drawings to this correspondence. In summary,
all of the lots appear to be compliant with one exception, which would be lot 24A which was combined
from the original lots 23 and 24 and is currently owned by NOTNEB, LLC. NOTNEB, LLC also owns lot 25.
The allowable impervious for lot 24A would total 76074.96 sf and I have estimated that it contains
81941 sf of coverage. However, their lot 25 has an allowable coverage of 34291.53 sf and contains
approximately 12775 sf of impervious. NOTNEB, LLC, via Mr. Warren Benton and I have discussed this
and he would like to basically combine all impervious allotments from the three original lots 23,24 and
25 into an allotment for the combination of 24A and 25, which would render him compliant. Can you
recommend the pathway to accomplish that through a permit modification or other appropriate means.
Lastly, an owners association had not been set up previously to allow for the future permit
transfer and to take over maintenance from Mr. See. That is now in process and the lot owners are
being involved in getting membership and due structures etc.

As you know, the goal of the forebay is to attempt to settle out the TSS. I would think a rip rap repaired forebay berm
would still allow the forebay to function in order to meet that goal. So that should be fine.

Good morning again, I have visited the town of morehead city and obtained fairly simply site plans for all of the lots
except one. I will compile them and submit additional information shortly.
As luck would have it , during the pump down of the pond while repairing the overflow structure, a thunderstorm came
during the night and breached the forebay wall. Is it acceptable to repair
That with rip rap?(It is about 15' wide and several feet deep) Getting soil back in place and getting enough compaction

fits in with the approved drainage areas. I don't have the drainage area map in front of me, but I am vaguely recalling a
drainage area map that also included multiple drainage areas for swales. I don't specifically remember if these swales
are a part of the collection system or another type of treatment for the runoff. If the provided collection system is set
up in such a way that the runoff has no choice but to enter the collection system (such as perimeter swales), then I
would say a grading plan is not required. But if the site is to be tipped a certain direction to get the runoff to the
collection system, some indication of grading would be needed but a full blown survey won't be required.

Good afternoon Brian, Mr. See met with me this morning after receiving the Notice of Inspection- Non- Compliant letter
dated May 20,2014. He is currently in the process of repairing the overflow structure as requested in
One of the items of deficiency. With respect to the drainage ditches, are all of the ditches on the site subdivision
ditches or were some of them existing. My plans have been archived and I do not recall. I know if they
Were part of the new construction they need to be at least 3:1 1 just was not sure if all of them were new project
ditches. The third item was bare soil, apparently Mr. See recently cleaned out the forebay and he will seed
That area right away.
The hardest item it, your item 4, Mr. See is in the process of obtaining copies of plans from the individuals. I assume
most Will have site plans where the impervious can be determined but many will not have grading plans.
Since the site is surrounded by ditches that drain to the approved pond are the grading plans absolutely necessary? This
may cause a true hardship if it is required. Please advise me on this one.
I intend on meeting Mr. See again this week to provide a better handle on what the lot owners can provide. I will update

Dear Mr. See:
On Ma yy 19, 2014, the Wilmington Regional Office of the Division of Energy Mineral and Land Resources
(DEMLR) inspected Wayne See Property in Carteret Counttyy to determine the status of compliance with the
SState Stormwater Management Permit Number SW8 0501 f7 issued on February 23, 2005. DEMLR file
review and site inspection revealed that the site is not compliant with the terms and conditions of this permit.
Please find a copy of the completed form entitled "Compliance Inspection Report' attached to this letter,
which summarizes the findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. The outlet structure is in need of repair. The side wall is collapsing inward. Two cracks are in the
front of the structure.
2. The drainage swales are not graded to plan of 3:1 side slope.
3. Provide groundcover on all bare and erosive soil.
4. It appears that Lots11, 15, 17 18, 21 22 23 24, 25, 26 and 27 have been built upon without
approval by the Division. Per $ectlon il.1' of the permit, the permittee shall submit final site layout
and grading plans for any permitted future areas shown on the approved plans, prior to construction.
Please either submit a ran revision for approval b the Division of the final individual lot layouts or
these lots may submit for and receive their own offsite permit.
Please inform this Office in writing before June 20 2014, of the specific actions that will be undertaken and
the time frame that will be required to correct the deficiencies. Failure to provide the requested information,
or to respond to this letter by the due date, may initiate enforcement action including the assessment of civil
penalties of up to $25,000 per day. If a written plan of action is not submitted to this office by June 20, 2014
then DEMLR staff will re -inspect the site and issue a Notice of Violation if the listed deficiencies have not
been addressed.
If the project haschanged its name, ownership, or mailing address, it is your responsibility to submit a
completed and signed Name/Ownership Change form to DEMLR at least 30 calendar days prior to making
the changes.Please include the name, mailing address and phone number of the person or entity that is
now responsible for this permit on the Name/Ownership Change form.

On February 23, 2005, the Wilmington Regional Office issued a Stormwater Management
Permit to you for the Wayne See Property. Per the requirements of the permit, a copy of the
recorded deed restrictions must be forwarded within 30 days of the date of recording. A review
of our files indicates that, as of this date, a copy of the recorded deed restrictions has not been
received in this Office.
Additionally, upon completion of construction, the permitted stormwater management system
must be certified by an appropriate design professional prior to the operation of the facility. A
review of our files indicates that, as of this date, the required Designer's Certification has not
been received in this Office.
Please be advised that failure to submit the required Designer's Certification, and failure to
record and/or provide a copy of the recorded deed restrictions prior to selling lots are violations
of your permit, and subject to enforcement action. Please forward the Designer's Certification
and a copy of the recorded deed restrictions to this Office at the address below by September
29, 2006, or enforcement action may be initiated and may include recommendations for civil
penalties and revocation of the permit.
