construction, operation and maintenance of a wet detention pond in compliance with
the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules')
and the approved stormwater management plans and specifications and other
supporting data as attached and on file with and approved by the Division of Water
Quality and considered a part of this permit.
This permit shall be effective from the date of issuance until February 23, 2015, and
shall be subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.6 on page 3 of this permit. The stormwater
control has been designed to handle the runoff from 992,273 square feet of
impervious area.
3. The tract will be limited to the amount of built -upon area indicated on page 3 of
this permit, Attachment A of the Restrictive Covenants, and per the approved
plans.
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
5. The runoff from all built -upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system.

II. SCHEDULE OF COMPLIANCE
1. The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency. The approved Operation and Maintenance Plan must be followed in
its entirety and maintenance must occur at the scheduled intervals including, but
not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow
spreader, catch basins and piping.
g. Access to the outlet structure must be available at all times.

4. Records of maintenance activities must be kept and made available upon

activity, name of person performing the work and what actions were taken.
5. Decorative spray fountains will be allowed in the stormwater treatment system,
subject to the following criteria:
a. The fountain must draw its water from less than 2' below the permanent
pool surface.
b. Separated units, where the nozzle, pump and intake are connected by
tubing, may be used only if they draw water from the surface in the
deepest part of the pond.
c. The falling water from the fountain must be centered in the pond, away
from the shoreline.
d. The maximum horsepower for a fountain in this pond is 1.0 horsepower.
6. The facilities shall be constructed as shown on the approved plans. This permit
shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other
supporting data.
Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations.
8. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
9. Access to the stormwater facilities shall be maintained via appropriate
easements at all times.
10. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project
area. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
11. The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction.
12. A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction.

13. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame

Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
III. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director.
In the event of a change of ownership, or a name change, the permittee must
submit a formal permit transfer request to the Division of Water Quality,
accompanied by a completed name/ownership change form, documentation
from the parties involved, and other supporting materials as may be appropriate.
The approval of this request will be considered on its merits and may or may not
be approved. The permittee is responsible for compliance with all permit
conditions until such time as the Division approves the transfer request.
2. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
8. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
9. The permittee shall notify the Division any name, ownership or mailing address
changes within 30 days.

Certification Requirements:
1. The drainage area to the system contains approximately the permitted
acreage.
2. The drainage area to the system contains no more than the permitted
amount of built -upon area.
3. All the built -upon area associated with the project is graded such that the
runoff drains to the system.
4. All roof drains are located such that the runoff is directed into the system.
5. The outlet/bypass structure. elevations are per the approved plan.
6. The outlet structure is located per the approved plans.
7. Trash rack is provided on the outlet/bypass structure.
8. All slopes are grassed with permanent vegetation.
9. Vegetated slopes are no steeper than 3:1.
10. The inlets are located per the approved plans and do not cause short-
circuiting of the system.
11. The permitted amounts of surface area and/or volume have been
provided.
12. Required drawdown devices are correctly sized per the approved plans.
13. All required design depths are provided.
14. All required parts of the system are provided, such as a vegetated shelf,
and a forebay.
15. The required system dimensions are provided per the approved plans.

1 When using the Division SA/DA tables, the correct SA/DA ratio for permanent pool sizing should be computed based upon the
actual impervious % and permanent pool depth. Linear interpolation should be employed to determine the correct value for non-
standard table entries.
2 In the 20 coastal counties, the requirement for a vegetative filter may be waived if the wet detention basin is designed to provide
90% TSS removal. The NCDENR BMP manual provides design tables for both 85% TSS removal and 90% TSS removal.
H. REQUIRED ITEMS CHECKLIST
The following checklist outlines design requirements per the Stormwater Best Management Practices Manual
(N.C. Department of Environment, Health and Natural Resources, February 1999) and Administrative Code
Section: 15 A NCAC 2H .1008.

III. WET DETENTION BASIN OPERATION AND MAINTENANCE AGREEMENT

Maintenance activities shall be performed as follows:
After every significant runoff producing rainfall event and at least monthly:
a. Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation,
vegetated cover, and general condition.
b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs within
2 to 5 days as designed.
2. Repair eroded areas immediately, re -seed as necessary to maintain good vegetative cover, mow vegetative
cover to maintain a maximum height of six inches, and remove trash as needed.
3. Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain
proper functioning.
4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is
reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed of
in an appropriate manner and shall be handled in a manner that will not adversely impact water quality (i.e.
stockpiling near a wet detention basin or stream, etc.).
The measuring device used to determine the sediment elevation shall be such that it will give an accurate
depth reading and not readily penetrate into accumulated sediments.
When the permanent pool depth reads 5.25 feet in the main pond, the sediment shall be removed.
When the permanent pool depth reads 3.00 feet in the forebay, the sediment shall be removed.

Remove cattails and other indigenous wetland plants when they cover 50% of the basin surface. These
plants shall be encouraged to grow along the vegetated shelf and forebay berm.

5. The covenants pertaining to stormwater management may not be altered or
rescinded without the express written consent of the State of North Carolina, Division of Water
Quality.
6: Alteration of the drainage as shown on the approved plan may not take place
without the concurrence of the Division of Water Quality.
7. The maximum allowable built -upon area per lot is shown on the attached
Exhibit A. These allotted amounts include any built -upon area constructed within the lot proeprty
boundaries, and that portion of the right-of-way between the front lot line and the edge of the
pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel,
brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or
the water surface of swimming pools.
8. All runoff from the built -upon areas in the lot must drain into the permitted
system. This may be accomplished through a variety of means including: a piped collection
system, which ultimately discharges into the stormwater facility; appropriate grading of the lot
such that the built -upon surfaces drain into the stormwater facility; or graded swales which
collect runoff and direct it into the stormwater facility; no means used shall destroy the integrity
and performance of the system as permitted.
9. Swales shall not be filled in, piped, or altered except as necessary to provide
driveway crossings.
10. Built -upon area in excess of the permitted amount requires a state stormwater
management permit modification prior to construction.
11. THIS DECLARATION prohibits any noxious or offensive activity from
being carried on upon any lot, nor annoyance or nuisance to the area. All lots shall be kept cut
and neatly trimmed; no junk automobiles or debris are allowed in any lots.
12. THIS DECLARATION provides that if any individual item or portion hereof
shall deemed invalid by a court of law, then the remaining items and portions hereof shall
continue in full force and effect.
13. THIS DECLARATION may be enforced by an individual lot owner.
Enforcement under this DECLARATION includes, but is not necessarily limited to, the right to
seek removal or relocation of any violating structure or portion thereof.
14. THIS DECLARATION provides that all of the covenants, restrictions,
reservations, easements, and privileges contained herein shall run with the land and the Grantees,
by accepting any deed to such land within the herein described premises, accepts the same
subject to this DECLARATION and its terms and conditions and agrees for himself, his heirs,
successors and assigns, to be fully bound by each and all of the terms and conditions of this

We are in receipt of your letter dated February 8, 2005, requesting for additional information to continue
your review. The additional information requested has been addressed as follows:
1. Please provide dimensions on the Site Plan for the existing buildings on Lot #30.
Dimensions for the existing buildings on lot #30 have been added to the plans, sheet 1 of 4.
2. Please clarify drainage area and built upon area. The revised drainage map (McMannen to
Lewis 213105) and calculations stamped 115105 list 1,609,533 .sq ft (36.95 sq ft) of drainage
area and the application and supplement forms list 37.32 ac (1,625,758 sq ft) for drainage
area. The application list 997,566 sq ft of built upon area and the strapped calculations list
992,273 sq ft of built upon area.
The areas on the application were not accurate and have been adjusted to show the correct
information. The drainage area of 1,609,533 SF and the built upon area of 992,273 SF are
correct on the stormwater plan (sh 2 of 4), drainage area map and calculation pages.
3. Please indicate on Plan how lot #30 will drain into theforebaP of the pond.
Lot #30 is an existing lot that will remain as is. The lot currently sheds water away from the
pond. We included the lot in our pond sizing in case Mr. Wayne See decides in the future to
sell the property and redevelop it. In the case of redeveloping the property, the stormwater
from this lot will be directed into the forebay of the pond.
4. Please label the four drainage areas used for the swalc calculations on the Drainage Plan or
on a separate document. For the four drainage areas, please list the square feet of drainage
area and the built upon area.
On a separate sheet, attached, the four drainage areas for each swale are shown. The drainage
area for each swale is provided in a different color and labeled. For each swale, the size of the
drainage area and the built upon area are provided.

5. Please provide the status of Lots #/ through Lots #8. Are thcv previously platted or part of
this subdivision? lfthev are part of this subdivision, please include the built upon area that
may be associated with these lots in the pond design.
The lots # 1 though 48 are existing lots that have previously been platted.
6. Please re -label the 362' dimension on the Pond Details Plan to not include the radius and re-
do the calculations to reflect the corrected dimension. The surface area at the permanent
pond is deficient based on the correct dimension. Please label each of the contour details on
the Plan for elevation.
The dimension of the pond has been edited to show the correct length of 302'. With the
change of size, the surface area was deficient, but with the lowering of the SA/DA, the
allowable required surface area was decreased and making the ponds surface area greater than
the required.

INFORMATION PERTAINING TO DEED RESTRICTIONS
AND PROTECTIVE COVENANTS
In accordance with Title 15 NCAC 2H. 1000, the Coastal Stormwater Management Regulations,
deed restrictions and protective covenants are required for certain developments where lots will
be subdivided and sold. Deed restrictions and protective covenants are necessary to ensure that
the development maintains a "built upon" surface area consistent with the applicable regulation
limiting built -upon area. The following deed restrictions and covenants must be recorded prior to
issuing the Stormwater Management Permit:
For All Projects:
1. The following covenants are intended to ensure ongoing compliance with State
Stormwater Management Permit Number as issued by the Division of Water
Quality under NCAC 21-1.1000.
2. The State of North Carolina is made a beneficiary of these covenants to the extent
necessary to maintain compliance with the stormwater management permit.
These covenants are to run with the land and be binding on all persons and parties
claiming under them.
4. The covenants pertaining to stormwater may not be altered or rescinded without the
express written consent of the State of North Carolina, Division of Water Quality.
5. Alteration of the drainage as shown on the approved plan may not take place without the
concurrence of the Division of Water Quality.
VI For High Density Commercial Subdivisions: (In addition to all others that apply)
The maximum allowable built -upon area per lot is (See Attached Table) square feet. This
allotted amount includes any built -upon area constructed within the lot property
boundaries, and that portion of the right-of-way between the front lot line and the edge of

These allotted amounts include any built -upon area constructed within the lot property
boundaries, and that portion of the right-of-way between the front lot line and the edge of
the pavement. Built upon are includes, but is not limited to, structures, asphalt, concrete,

wood decking, or the water surface of swimming pools.
All runoff from the built -upon areas on the lot must drain into the permitted system. This
may be accomplished through providing roof drain gutters which drain to the street,
grading the lot to drain toward the street, or grading perimeter swales to collect lot runoff
and directing them into the stormwater system or into the street. Lots that will naturally
drain into the system are not required to provide these additional measures.
3. Each lot whose ownership is not retained by the permittee, shall submit a separate
stormwater permit application to the Division of Water Quality and receive a permit prior
to construction.

A. Description of Project
Wayne See Property is a planned commercial subdivision, located in Carteret County. The project
consists of 30 commercial lots on 37.72 acres.
The site presently drains to the north into The Narrows (Newport River), which is classified as
"SC" waters. The project is being proposed as high density with impervious surfaces totaling 62% of
the tract (see plans for allotments). The project is proposing curb outlets and drainage ditches for the
treatment of stormwater.
The project will be constructed in two phases. The right of ways within each phase will limit
initial construction to one hundred feet. Once the utilities and roads are constructed and this area
stabilized, the lots will then be disturbed on a lot by lot basis by others. The proposed land disturbance
will not occur at one time. Prior to initiating a subsequent phase, the previous phase shall be
stabilized.
B. Erosion and Sedimentation Control Measures
The following measures are proposed for the site. If it becomes evident that additional erosion and
sedimentation control measures are needed, they shall be installed immediately. It is intended that all
grading and excavation activities within a certain area will be protected as soon as that activity is
complete.
I. Sediment Fence — Sediment fence will be utilized as necessary in locations as shown on plans or
as deemed necessary by the engineer to insure that off -site sedimentation is controlled.
2. Seeding — All disturbed areas will be seeded within 14 days following construction in accordance
with the seeding schedule shown on the plans.
3. Stone Construction Entrance — Stone construction entrance will be used to reduce transport of
sediment off site.
4. Temporary Sediment Traps — Sediment traps will be constructed as shown on plans and serve to
trap sediment and prevent from the sediment moving off site.
Maintenance Plan
All erosion and sediment control measures shall be checked for stability and effective operations
following every runoff producing rainfall event or at least once per week. Repairs required shall
be completed immediately to the dimension and functions indicated on the plans.
Sediment shall be removed form behind the sediment fencing when it becomes 0.5 feet deep at the
fence. The fence shall be replaced or repaired as necessary to maintain a barrier.

All seeded areas shall be fertilized, seeded and mulched within 15 days of disturbance. Disturbed
areas shall be fertilized, reseeded and mulched as necessary according to the Contract documents
to establish and maintain a dense vegetative cover.
Construction Sequence
1. Clear and grub areas within right of way, drainage and utility easements as shown with land
disturbance limits line.
2. Install stone construction entrance. -
3. Install silt fencing where specified on plans within area of construction.
4. Construct drainage ditches and temporary'sediment'traps, where specified. Install Excelsior
erosion control blanket within all swales. Seed constructed drainage swales within 14 days of land
disturbance.
5. Construct pond.
6. Rough grade area within right-of-way
7. Install utilities.
8. Pine grade street areas and seed areas to remain outside of paved area.
9. Install curb and gutter, drainage features and place CABC.
10. Pave streets.
11. Perform final seeding and mulching.
12. Remove temporary sediment traps within drainage area once all lots within said drainage area
have been developed and drainage swales are stabilized are stabilized.
13. Remove accumulated sediment from stormwater pond upon completion of project.
C. Design Assumptions
1. Design storm is ten years.
2. The rational method was used for the design.
D. Coastal Stormwater Regulations
The NorthCarolina Division of Environmental Management implemented coastal stormwater
regulations in coastal counties on January 1, 1988. These regulations are detailed in 15 NCAC
21-1.1000 Stormwater Management. These rules allow for a development to be considered under
various options. This project is submitted for approval consideration under Section .1003(d)(1) low
density development.

A. Description of Project
Wayne See Property is a planned commercial subdivision, located in Carteret County. The project
consists of 30 commercial lots on f37.72 acres.
The site presently drains to the, orth into The Narrows (Newport River), which is classified as
"SC" waters. The project is being proposed as high density with impervious surfaces totaling 62% of
the tract (see plans for allotments). The project is proposing curb outlets and drainage ditches for the
treatment of stormwater.
The project will be constructed in two phases. The right of ways within each phase will limit
initial construction to one hundred feet. Once the utilities and roads are constructed and this area
stabilized, the lots will then be disturbed on a lot by lot basis by others. The proposed land disturbance
will not occur at one time. Prior to initialing a subsequent phase, the previous phase shall be
stabilized.
B. Erosion and Sedimentation Control Measures
The following measures are proposed for the site. If it becomes evident that additional erosion and
sedimentation control measures are needed, they shall be installed immediately. It is intended that all
grading and excavation activities within a certain area will be protected as soon as that activity is
complete.
1. Sediment Fence — Sediment fence will be utilized as necessary in locations as shown on plans or
as deemed necessary by the engineer to insure that off -site sedimentation is controlled.
2. Seeding — All disturbed areas will be seeded within 14 days following construction in accordance
with the seeding schedule shown on the plans.
3. Stone Construction Entrance — Stone construction entrance will be used to reduce transport of
sediment off site.
4. Temporary Sediment Traps — Sediment traps will be constructed as shown on plans and serve to
trap sediment and prevent from the sediment moving off -site.
Maintenance Plan
I. All erosion and sediment control measures shall be checked for stability and effective operations
following every runoff producing rainfall event or at least once per week. Repairs required shall
be completed immediately to the dimension and functions indicated on the plans.
2. Sediment shall be removed form behind the sediment fencing when it becomes 0.5 feet deep at the
fence. The fence shall be replaced or repaired as necessary to maintain a barrier.

3. All seeded areas shall be fertilized, seeded and mulched within 15 days of disturbance. Disturbed
areas shall be fertilized, reseeded and mulched as necessary according to the Contract documents
to establish and maintain a dense vegetative cover.
Construction Sequence
I. Clear and grub areas within right of way, drainage and utility casements as shown with land
disturbance limits line.
2. Install stone construction entrance.
3. Install silt fencing where specified on plans within area of construction.
4. Construct drainage ditches and temporary sediment traps, where specified. Install Excelsior
erosion control blanket within all swales. Seed constructed drainage swales within 14 days of land
disturbance.
5. Construct pond.
6. Rough grade area within right-of-way
7. Install utilities.
8. Fine grade street areas and seed areas to remain outside of paved area.
9. Install curb and gutter, drainage features and place CABC.
10. Pave streets.
11. Perform final seeding and mulching.
12. Remove temporary sediment traps within drainage area once all lots within said drainage area
have been developed and drainage swales are stabilized are stabilized.
13. Remove accumulated sediment from stormwater pond upon completion of project.
C. Design Assumptions
I_ Design storm is ten years.
2. The rational method was used for the design.
D. Coastal Stormwater Regulations
The North Carolina Division of Environmental Management implemented coastal stonmwater
regulations in coastal counties on January 1, 1988. These regulations are detailed in 15 NCAC
21-1.1000 Stormwater Management. These rules allow for a development to be considered under
various options. This project is submitted for approval consideration under Section .1003(d)Q) } am
