Effective August 1, 2013 the State Stormwater program has been transferred from the Division
of Water Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All
previous references to DWQ will remain in older stormwater permits issued prior to August 1,
2013 until they are modified. Please note that any updated pages or addendums to this permit
will now reference DEMLR as the Division responsible for issuance of the permit.
On August 5, 2009. the Governor signed Session Law 2009-406. This law impacts any
development approval issued by the Division of Energy, Mineral and Land Resources under
Article 21 of Chapter 143 of the General Statutes, which is current and valid at any point
between January 1, 2008, and December 31, 2010. The law extends the effective period of any
stormwater permit that was set to expire during this time frame up to three (3) years from its
current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which
granted an extra year for an extension of up to four (4) years.
On August 13, 2013, the Wilmington Regional Office received a request to transfer the
ownership of the state stormwater management permit for the subject project. Staff of DEMLR
has inspected the project, determined that the documentation is in order, and that the project
has been accepted as is, which was requested in September 11, 2013 letter. As indicated on
the Name/Ownership Change form, you have acknowledged receipt of a copy of the permit,
which includes the application and supplement forms, a copy of the approved plans and a copy
of the required Operation and Maintenance agreement from the previous permittee. By
acknowledging receipt of the permit, and by signing the Name/Ownership Transfer form, you
have accepted the responsibility for complying with the terms and conditions outlined in this
permit. The Division is hereby notifying you that the subject permit has been transferred on
November 4, 2013 and to remind you that this permit shall be effective until May 7, 2018. For
your records, please find enclosed a copy of the updated page 2 of the permit a copy of the
inspection report, and a copy of the Name/Ownership Change form submitted on August 13,
2013. Please attach this cover letter and updated page 2 to your permit originally issued by the
Division of Water Quality on May 7, 2004.
Please be aware that the project's built -upon area and stormwater controls must be built and
maintained in compliance with the permit documents and the approved plans. Maintenance
of the approved system shall be performed in accordance with the signed Operation and
Maintenance agreement. Any modifications to this project must be submitted to the Division
of Water Quality and approved prior to construction. The issuance of this approval does not
preclude you from complying with all other applicable statutes, rules, regulations or
ordinances, which may have jurisdiction over the proposed activity, and obtaining a permit
or approval prior to construction.

construction, operation and maintenance of a wet detention pond in compliance with
the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules')
and the approved stormwater management plans and specifications and other
supporting data as attached and on file with and approved by the Division of Water
Quality and considered a part of this permit.
This permit shall be effective from the date of issuance until May 7, 2018 and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
This stormwater system has been approved for the management of stormwater
runoff as described on page 3 of this permit, the Project Data Sheet. The
stormwater control has been designed to handle the runoff from 121,188 square
feet of impervious area. This pond must be operated with a vegetated filter.
3. The tract will be limited to the amount of built -upon area indicated on page 3 of
this permit, and per approved plans.
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
5. The runoff from all built -upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system. A permit
modification must be submitted and approved prior to the construction of
additional built -upon area from outside of the approved drainage area.

A REQUIRED ITEMS
A request to transfer a permit will not be approved by the Division of Water Quality (DWQ) unless all of the
applicable required Items listed below are Included with the submittal. Failure to provide the
listed Items may result in processing delays or denial of the transfer.
1. This completed and signed form. This certification must be completed and signed by both the
current permit holder and the new applicant if this Is a change of ownership.
2. Legal documentation of the property transfer to a new owner.
3. A copy of any recorded deed restrictions, covenants, or easements, If required by the permit.
4. The designer's certification (DWQ Engineer and Designer Certification Forms are available from
each DWQ Regional office), if required by the permit and If not already submitted to DWQ.
6. If the proposed permittee is a firm, partnership, association, institution, corporation, limited liability
company, or other corporate entity, provide documentation showing the authority of the named
representative to act on behalf of the proposed permittee.
6. The $40.00 processing fee. If this Is an Initial transfer from the original permittee the processing fee Is
not required. Subsequent ownership transfers will require the $40.00 processing fee.

Hope you are doing well . Is there any way that you can put a little fire under Pike Electric to get started on fixing there
problem with the pond. There Lawyer has talked to Phil Norris about the problem with the pond and has indicated to him
that it is Pike's problem to fix. They are dragging there feet and trying to put the blame on me, so any help with this matter
will help. Like a dead line to have it fixed or they will have to start paying the $ 25,000.00 fine.

Please allow me to correct what may be the wrong impression from my sending you copies of proposals/invoices from Mr.
Phil Norris and Mr. Daniel Russ.
I asked Mr. Hamilton to obtain this information to get a sense of the magnitude of the non-compliance with the stormwater
permit in economic terms. Mr. Hamilton has not contracted with either Mr. Norris or Mr. Russ for these services and has
no plans to do so.

I hope you are well.
The current owner's counsel, Doug Baxley, (copied on this e-mail) has provided me with a copy of a contractor's cost
estimate for enlarging the existing storm water pond on the property and reconfiguring the outlet, and a copy of an
invoice for engineering services, specifically "storm water design and permitting." So it appears to me that Anglers
Marine is beginning to make arrangements for submittal of a permit application and for performance of work on the
transferred property.
I was not copied on any communication Anglers Marine may have been sent you in accordance with yesterday's
deadline in your August 28 letter.
I want to assure you I will continue to work on behalf of Pike Electric to reach agreement with Anglers Marine to
submitting appropriate storm water permitting documents for its property. The issues to be resolved in these
application(s) are dealing with the compliance issues raised in your letter, and obtaining approval for additional
changes to the property which Anglers Marine may propose to make for conducting its future business.
Please check with me and Mr. Baxley before taking any further action on your file, and I will continue to keep you
informed.

A plan of action should be submitted by either the current permittee or yourself (if you are accepting responsibility to
bring the site into compliance) by that Sept 30th date (or later if you ask for additional time to figure this out).
The timeframe and the actions identified in the plan of action will depend on the proposed solution. Somehow the
additional impervious area from the driveway needs to be addressed. If you can remove some existing impervious area
to make the numbers work out and ensure the site meets the permitted condition, then a modification isn't necessary
until you are ready to increase the amount of impervious area. If you are in need of the additional impervious now, then
a modification will be needed sooner.

Hi Christine,
I am writing on behalf of Pike Electric, Inc.
I just received from Pike a copy of your letter regarding your inspection and the need for work on Pike's former property
to come into compliance with the above permit. I was not involved in the sale of the property subject to the permit, but
I expect it will my job to contact the current owner on behalf of Pike.
To help me get up to speed, would you kindly scan me a copy of the permit? Also, were there any previous inspections?
If there were, I would appreciate copies of reports.
I will let you know what is agreed to between Pike and the current owner as soon as I can, and certainly before the
September 30 date in your letter.
