Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references
to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified.
Please note that any updated pages or addendums to this permit will now reference DEMLR as the
Division responsible for issuance of the permit.
The Wilmington Regional Office received a complete 8 year Stormwater Management Permit Renewal
Application for Carolina Eye Associates on November 12, 2015. The Division is hereby notifying you that
permit SW8 010314 has been renewed on December 8, 2015, and shall be effective until August 10,
2023. The renewal and reissuance of this stormwater permit does not imply that the site is currently in
compliance with the terms and conditions of this state stormwater permit. The plans previously approved
on August 10, 2001 will remain in full force and effect in accordance with the regulations set forth in Title
15A NCAC 2H.1000 effective September 1, 1995, Please attach this cover letter and permit addendum
to your High Density Permit issued on August 1, 2001.
This permit is subject to the conditions and limitations as specified therein. Please pay special attention
to the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation
of deed restrictions, procedures for changes of ownership, transferring the permit, and renewing the
permit. Failure to establish an adequate system for operation and maintenance of the stormwater
management system, to record deed restrictions, to transfer the permit, or to renew the permit, will result
in future compliance problems. .
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings
(OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and
must be filed with the OAH within thirty (30) days of receipt of this permit. You should contact the OAH
with all questions regarding the filing fee (if a filing fee is required) and/or the details of the filing process
at 6714 Mail Service Center, Raleigh, NC 27699-6714, or via telephone at 919-431-3000, or visit their
website at www.NCOAH.com. Unless such demands are made this permit shall be final and binding.

provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules') and the
approved stormwater management plans and specifications and other supporting data as
attached and on file with and approved by the Division of Energy, Mineral and Land Resources
and considered a part of this permit.
The permit is hereby renewed subject to the following addendums, clarifications, conditions and
limitations:
The original permit conditions contained in the permit issued on August 10, 2001
remain in full force and effect, except as amended herein. (An additional copy of this
original permit can be obtained from the Division of Energy, Mineral and Land
Resources, Wilmington Regional Office.)
This permit shall be effective from the date of issuance until August 10, 2023.
The permittee shall submit a permit renewal application request at least 180 days
prior to the expiration date of this permit. The renewal request must include the
applicable documentation and the processing fee.
If the use of permeable pavement is desired, this permit must be modified to add the
permeable pavement conditions.

that stormwatter management permits, issued for projects that require the construction of engineered stormwater
control mean res (High Density Permits), shall be required to submit an application to renew the permit 180 days
prior to expiration of the permit. Renewed permits are valid for a period of 8 years per Session Law 2011-398 (SB
781) Section 60. (c).
I. SUBMITTAL REQUIREMENTS
Only complete application packages will be accepted and reviewed by the North Carolina Department of
Environment and Natural Resources (NCDENR) Division of Energy Mineral and Land Resources (DEMLR). A
complete package includes all of the items listed below. The complete application package should be
submitted to the appropriate DEMLR Regional Office. (The appropriate office may be f 9r,

Sorry, I was out of the office Monday and Tuesday. 1 looked at the document you sent me. I do not think this
shows that she can sign for the company. Number one this document is 13 years old. Number two, there is
nothing here that says she has legal authority to sign for the company.
I think the best thing to do is to have the registered agent listed on the secretary of state sign the second page of
the renewal document and send that to me. I can than proceed with the renewal.
Sorry; but this has to meet our rules. Since we received the original application on August 6, 2015 Carolina Eye
Associates are not out of compliance because you got the package in here before the 10`h. We accepted the
package and check. So all 1 need is the correct signature, which according to the SoS is .lames R Van Camp.

Physicians' Retreat - June 15, 2002

Board of Directors Present: Dr. Neil Griffin, Dr. Robert Martin; Dr. Daniel Messner,
Dr. John Miller, Dr. Gregory Mincey; Dr. Carson Cox; Dr. David Throneburg, Dr.
Shawn Riley & Dr. Scott Tunis.
Non -Board Members Present: Larry Newsome, Dawn Apple, Harvey Hoopes
Larry Newsome called the meeting to order at 4:00 pm.
Election of Officers
Larry Newsome informed the Board that the position of Secretary had been vacant and
that it should be filled. The Secretary's primary role is to witness the signature of the
President on company documents. Larry also expressed the desire and need to elect
Dawn Apple as an Assistant Secretary and Harvey Hoopes as an Assistant Treasurer. He
reported that this would allow additional company personnel the ability to sign
designated documents. Larry noted that he had previously been appointed an Assistant
Secretary and wanted to remain so.

The floor was then opened for discussion and nomination of candidates for the position of
Secretary. Motion was made by Dr. Mincey to nominate Dr. Fakedej for the position of
Secretary and to accept recommendations of Larry Newsome on nominations of Dawn
Apple for an Assistant Secretary and Harvey Hoopes as an Assistant Treasuer and to re-
affirm Larry Newsome as an Assistant Secretary. Dr. Messner seconded the motion made
by Dr. Mincey. Larry Newsome asked if there were any other nominations for the
positions. Dr. Cox made the motion to close the nominations and vote on those
recommended. Dr. Throneburg seconded this motion. A vote was called with all Board
of Directors supporting and affirming the nominations. Motion carried.
Larry Newsome recommended candidates to the Board for positions of Chief Operating
Officer and Chief Financial Officer. He recommended Dawn Apple for COO position
and Harvey Hoopes for CFO position. Dr. Martin made a motion to accept candidates
presented. Dr. Mincey seconded the motion. Motion carried with no dissenting votes or
abstentions.
With no further business, the meeting adjourned at 4:40 pm.

As requested — information from DENR is attached on the stormwater permit SW8010314 for a project John Tunstall was
engineer of record. Carolina Eye no longer owns the property, but they did not transfer the permit when the property
was sold. Carolina Eye has to renew the permit prior to transferring it to the current land owners. It is my
understanding that part of the renewal process is having the engineer of record recertify the basin. I will be in
Wilmington Monday reviewing the files at NCDENR. I will not be able to get copies of drawings next week due to
vacations at NCDENR office.
Carolina Eye has asked that I assist them in getting this completed. I plan to submit the renewal next week to get the
process started. NCDENR understands that the inspection probably will not be completed prior to the submittal.

Attached is a scanned copy of the permit information and permit renewal request for this property. As you discussed
with Georgette Scott, a permit transfer and renewal are needed for this site. As we discussed, Norris and Tunstall
Engineers here in Wilmington were the original Engineers of Record for this site and they should be able to give you
some information/guidance about the best way to undertake this. I am attaching a scanned copy of the signed permit
and the permit application that were in the file, as well as the Request for Permit Renewal that was sent to Carolina Eye
Associates back in 2010.
I am sorry that I will not be available on Monday to go with you to get copies of the plans for your records but my hope
is that you can get the plan files sent to you by Norris and Tunstall (910-343-9653). If that is not possible, I can take the
file to a local print shop here when I return to the office and they will then send you copies at your expense. I am
copying Georgette Scott (whom you spoke with earlier) and Jo Casmer (State Stormwater's Administrative Asst.) in case
you have questions when you are here. I've reserved the File Review area for you for 8:30 on Monday August 3 here at

We were contacted by the contractor (Chris Jordan) to help with the Engineer's Certification for the State SW Permit
Renewal. We do not have any files or plans on this job, as it was a 2000 job & we are only required to keep files for 10
years. John Tunstall, P.E. feels as if he certified the basin, but since we don't have any files, we can't confine that. Can
you confirm that you did not find John's certification in NC DENR files?
If there is no certification on file at NC DENR, John is willing to certify, but will need to obtain a copy of the approved NC
DENR SW plans in order to go visit the site to certify the basin. Is there any way we can pick up the approved DENR
plans, bring to our office, make the copies (we can sign our life away and list the sheets we are taking from your office) &
return to DENR the same day?
Please advise so we know how to respond to the contractor.

Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified. Please note that this letter (permit) references DEMLR as the Division responsible for
issuance of the permit.
On July 17, 2015 the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources
(DEMLR) conducted a file review of Coastal Stormwater Management Permit # SW8 010314 issued to
Carolina Eye Associates for a High Density - infiltration basin project on August 10, 2001. A renewal
was sent to you on June 23, 2010 which notified you that your permit was set to expire on August 10,
2011. On August 5, 2009, the Governor signed Session Law 2009-406. This law impacted any
development approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of
the General Statutes, which was current and valid at any point between January 1, 2008, and
December 31, 2010. The law extended the effective period of any stormwater permit that was set to
expire during this time frame to three (3) years from its current expiration date. On August 2, 2010, the
Governor signed Session Law 2010-177, which granted an extra year for a total of four (4) years
extension. Accordingly, this permit's expiration date was adjusted to include this four year extension.
This permit's new expiration date is now August 10, 2015.
Per 15A NCAC 2H.1003(h) (the stormwater rules), applications for permit renewals shall be submitted
180 days prior to the expiration of a permit and must be accompanied by a processing fee, which is
currently set at $505.00. If this is still an active project please complete and submit the enclosed
renewal application immediately and before August 10, 2015 or you will be out of compliance with
your permit and the stormwater rules.
Your permit requires that upon completion of construction and prior to operation of the permitted
stormwater treatment system, a certification of completion be submitted to the Division from an
appropriate designer for the type of system installed. This is to certify that the permitted facility has
been installed in accordance with the permit, the approved plans, specifications and supporting
documentation. If you have not already provided a Designer's Certification to our office, please include
a copy with your permit renewal request and processing fee. A copy of the certification form is enclosed
for your convenience.

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8 010314 to Carolina
Eye Associates for a High Density project on August 10, 2001, This permit expires on August 10, 2011. Per 15A
NCAC 2H.1003(h) (the stormwater rules), applications for permit renewals shall be submitted 180 days prior to the
expiration of a permit and must be accompanied by a processing fee, which is currently set at $505.00. If this is
still an active project please complete and submit the enclosed renewal application prior to February 10, 2011. If
this project has not been constructed and a permit is no longer needed, please submit a request to have the permit
rescinded. If you have sold the project, or are no longer the permittee, please provide the name, mailing address
and phone number of the person or entity that is now responsible for this permit. Enclosed is a form for change of
ownership, which should be completed and submitted if the property has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted stormwater
treatment system, a certification of completion be submitted to the Division from an appropriate designer for the
type of system installed. This is to certify that the permitted facility has been installed in accordance with the
