It has been determined that a formal permit modification is not required for the proposed changes. We are forwarding

Permit Extension:
On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any development approval
issued by the Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which is current
and valid at any point between January 1, 2008, and December 31, 2010. The law extends the effective period
of any stormwater permit that was set to expire during this time frame up to three (3) years from its current
expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which granted an extra year

3, 2009. The current expiration date is October 19, 2014.
Please be aware that all terms and conditions of the permit issued on October 19, 2000, remain in full force and
effect. Please also understand that the approval of this revision to the approved plans for the subject State.
Stormwater Permit is done on a case -by -case basis. Any other changes to this project must be approved
through this Office prior to construction. The issuance of this plan revision does not preclude the permittee from
complying with all other applicable statutes, rules, regulations or ordinances which may have jurisdiction over the
proposed activity, and obtaining a permit or approval prior to construction.

This should be a pretty easy one, but I have two quick questions:
1.) The Secretary of State lists Harry Kraly but does not list his title (attached). Can you all send me
some sort of documentation that he is the VP? Also, did this used to be "Crown Box
Corporation" and it is now "Crown Box Corp'? It looks like they just shortened it when they
filled out the form, but the rules say that we are supposed to issue it to the way it appears with

the SoS. Which name is the "official' name for the permit? Please make sure that the "official'
name appears on the document from Mr. Kraly.
2.) FYI, I have drafted the attached PR. It allocates "future" impervious to be consistent with the
previous permit. It also grants a permit extension in compliance with the various extension laws
over the past few years.
Once I hear back from you I can get this out pretty quickly.

Dear Mr. Kraly:
On October 19,2000 the Division of Water Quality issued a Stormwater Management Permit for
Federal Express Ground. Per the terms and conditions of the permit, and Stormwater Regulation 15A
NCAC 2H.10080), which stipulates the following:
"Upon completion of construction, the designer for the type of Stormwater system
installed must.certify that the system was inspected during construction, was constructed
in substantial conformity with plans and specifications approved by the Division and
complies with the requirements of this Section prior to issuance of the certificate of
occupancy."
As of this date, our records indicate the required designer's certification has not been received.
Operation of the stormwater system prior to submission of the required certification is a violation of
NCAC 2H.10080) in accordance with NCGS 143-215.6. Construction is considered complete at the time
the project is occupied by an owner or tenant for its intended use. Please submit the required certification
by December 19,2002. Failure to submit the certification is considered a violation of the permit, and is
