SUBJECT: Stormwater Management Plan Clarification
Ogden Business Park
Dear Mr. Regan:
This letter is to serve as a clarification to the stormwater management plan requirements for your
project on U.S. 17 North at Ogden, North Carolina. As you are aware your 401 Water Quality certification
(dated March 4, 1994) required that a "written stormwater management plan must be approved by DEM
before construction begins". In a recent phone conversation you noted that construction on this site has not
occurred and that only land clearing has taken place. As a result you contended that the need for a
stormwater management plan was not necessary since no actual "construction" has taken place.
According to our records, an 11/12/93 site plan prepared by the Land Management Group and
submitted to DWQ as part of the 401 application package (site plan copy enclosed) clearly shows that
portions of this property have been constructed. Specifically, it appears that the property on which "Super
Sod" and the expanded portion of "Furniture Choices" now reside was part of the original site plan. -
Therefore, DWQ concludes that construction has occurred on this site and that the approved stormwater
management plan is required as per the 401 Water Quality Certification. Please forward a plan showing
how the stormwater on this site will be handled. As John Dorney discussed with Rob Moul the simplest
process may be to direct the stormwater into the remaining wetlands on site at non-erosive velocities.
