PROJECT DESCRIPTION The applicant has requested that the attached application be processed under the Express Permit Review Program. The applicant's project is located along N.C. Highway 179, at the intersection of N.C. Highway 179 and Waterway Drive, adjacent to the Atlantic Intracoastal Waterway (AIWW), in Ocean Isle, Brunswick County. To find the property, take Highway 17 south from Wilmington. Turn left onto Ocean Isle Beach Road Southwest and travel approximately 3.5 miles. Turn right onto N.C. Highway 179 (Beach Road Southwest) at the intersection of Ocean Isle Beach Road Southwest and N.C. Highway 179. The property will be located on the left hand side of the road, approximately 0.75 miles from the intersection of N.C. Highway 179 and Ocean Isle Beach Road Southwest. The subj ect property is bordered to the north, east and west by residential properties, and the APNW borders the site to the south. The subject property is approximately 49 acres with roughly 9521inear feet of shoreline along the AIWW. The site is currently undeveloped and high ground vegetation consists primarily of Long Leaf Pine, Live Oak, Sweet Gum, Cedar, Bay, Cottonwood and Red Maple. Elevations at the site range from 1' to 28' above Normal High Water (NHW). The under story vegetation consists primarily of Wax Myrtle, Yaupon, Red Bay and Cat-briar. Transitional species, including: Sea Oxeye, Goldenrod and Grounsel-bush are located along the upper edge of the coastal wetlands. High coastal marsh vegetation, including, Black Needle Rush (Juncus roemarianus), Spike Grass (Distichlis spicata), Sea-lavender (Limonium) and Salt Meadow Grass (Spartina patens) complete the transition to the waters edge where Smooth Cordgrass Marsh (Spartina alterniflora) is the predominant species. The marsh area adjacent to the site ranges in width from approximately 10 to 200 feet. The waters of the AIWW, adjacent to the project site, are classified as SA by the North Carolina Division of Water Quality. The area is designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. According to the Division of Environmental Health, Shellfish Sanitation Section, the waters in this area of the AIWW are CLOSED to the harvesting of shellfish. PROPOSED PROJECT The applicant proposes to construct one hundred (100) townhome units, one hundred thirty-three (133) single-family lots, roads, parking areas, utilities, amenities, three earthen dams, stormwater collection system, retaining wall, community pier and docking facility. Additionally, the applicant proposes to fill approximately 8,360 sq. ft. of "404" wetlands and approximately 732 sq. ft. of open water within the fresh water ponds. It should be noted that the vast maj ority of upland development associated with the subdivision portion of this prof ect is located outside of the 75' Estuarine Shoreline Area of Environmental Concern (AEC). However, a section of the lower pond (including the dam outfall area which is labeled as Dam repair - C on the workplan drawings), a portion of the condominium development, retaining wall and the proposed pier structure, are all located in the southeast corner of the property, within the 75' AEC. Since the maj ority of the upland development is located outside of the 75' AEC, those activities will not be described in detail in this field investigation report. Furthermore, you may refer to the attached workplan drawings for a detailed description of the proposed upland development activities. Beginning at the intersection of N.C. Highway 179 and Heritage Marsh Boulevard (entrance/exit drive), and working south towards the AIWW, the applicant proposes to construct an entrance/exit drive that would lead to the centrally located Club House and pool facility. Two side streets, Heron Glen Way West and Heron Glen Way East, would split the property and provide access to the exterior areas within the subdivision as well as the proposed condominium development. Several other drives would provide access to the interior portion of the subdivision from this main drive (please refer to the attached workplan drawings for a detailed description of the road infrastructure). The proposed asphalt roads would be located within a 40-foot right-of--way and would consist of 20-foot wide paved asphalt travel lanes with 2-foot borders on each side of the road. Utilities for each of the lots would be located within the street right-of--way. ,. warQrooro viiiagelvtanagement,LLl. ~ Page Three According to the applicant, the construction of Heron Glen Way West would impact approximately 4,199 sq. ft. of isolated "404" wetlands. The U.S. Army Corp of Engineers has confirmed that this is indeed an isolated wetlands pocket, and as such, they have considered it non jurisdictional. Please refer to Sheet 12 of 13 for a detailed drawing illustrating the proposed fill activities within this area. In addition to the proposed "404" wetlands fill associated with the roadway construction, the applicant anticipates both permanent and temporary "404" wetland impacts, as well as open water impacts, as a result of the earthen dam repair/replacement. According to the application package, approximately 1,053 sq. ft. of "404" wetlands would be permanently impacted as a result of the dam repair to the upper dam (labeled as Dam repair - A) and approximately 111 sq. ft. of permanent open water impacts. Temporary wetland impacts for repair/replacement of the upper dam would be 746 sq. ft. and temporary open water impacts would be 3 83 sq. ft. Permanent "404" wetland impacts resulting from the repair of the middle dam (labeled as Dam repair - B) would be 2,212 sq. ft. and permanent open water impacts would be 156 sq. ft. Temporary impacts for this dam repair would be 667 sq. ft. and 1,3 54 sq. ft., respectively. Lastly, permanent impacts resulting from the repair/replacement of the lower dam (labeled as Dam repair - C) would be 896 sq. ft. within "404" wetlands and 465 sq. ft. within open water. Temporary impacts within the area would be 2,313 sq. ft. and 1,319 sq. ft. respectively. Outlet control structures, culverts, temporary coffer dams and emergency riprap spillways would be installed as each dam juncture to ensure adequate water flow and shoreline stabilization. The applicant states that efforts would be made to minimize the extent of temporary impacts within both the wetland and open waters. The applicant also indicates that the areas would be covered in woven geotextile fabric in order to minimize disturbance of the plant material and reduce intrusion of different soil types. Timber mats would be placed on top of the filter fabric in areas where heavy construction equipment would operate in order to reduce rutting and would be removed upon completion of the necessary improvements. Silt fence would be placed on the down hill side of each earthen dam prior to commencement of work to reduce sedimentation of the downstream ponds. The applicant states that once the slope of the adj acent earthen dam(s) are stabilized by vegetated cover, the geotextile fabric would be removed. The applicant anticipates that this work can be accomplished within thirty days. According to the application package, the remaining wetlands on site would be preserved through deed restrictions. As previously mentioned, construction activities associated with the repair/replacement of the lower dam (Dam repair - C) would be located within the 75' AEC, as well as the 30' Coastal Shoreline Buffer. Two, 18"culverts would be installed beneath the berm, and these culverts would directly discharge within the 30' Buffer. A 10' x 12' area of rip-rap would be installed within the buffer, directly beneath the outfall pipes, to dissipate the water flow. As proposed, none of the work associated with the dam repair(s) would impact any coastal wetlands or tidal waters. The remaining portion of upland development impacting the 75' AEC includes the construction of two, 4-unit condominium structures located between the lower pond and the AIWW. The structures would consist of 4-units, each measuring approximately 25' x 45'. These units would be part of a larger series of structures (100 total units) extending along the entire width of the southern property boundary. Access to each of the units would be provided by Tidewater Loop. As proposed, the height of each unit would be limited to 3 6' from grade to top of roof. A retaining wall (2101inear feet) would be installed along the waterward side of the condos, along the toe of the escarpment. The retaining wall would be located upland of both "404" and coastal wetlands. Lastly, the applicant proposes to construct a community pier and docking facility along the southern property line. The pier (6' x 224') would extend in a southerly direction towards the A1WW and terminate into a 16' x 16' covered gazebo. A fixed finger pier (spine) would extend toward the east from the access pier and would provide access to two, 4' x 24' fixed finger piers. Four boatlifts (12' x 13') would be installed on each side of the finger piers, providing dockage for residents of the subdivision. As proposed, the pier and docking structure would provide dockage for up to four vessels, be located within the applicant's riparian access corridor and within the established pier-head alignment. Additionally, the pier and docking facility would be located landward of the near shore edge of the federally maintained channel (COE's 80' setback). Water depths at the terminal end of the proposed docking facility range from -0.6' to -0.8', relative to Normal Low Water (NLW). yr a~et vui u V lllit~e 1V1AIlilgemen[, LLI. Page Four ~, The applicant has indicated that water and sewer would be provided by the local municipality. The applicant has received approval for the construction of aHigh-Density Stormwater system under Permit #SW8070544, issued by North Carolina Division of Water Quality on 7/03/07. The applicant has also submitted, and obtained approval of a Sedimentation and Erosion Control Plan (SECP) from the Division of Land Quality. The plan was approved on 8/06/07, and was issued under Bruns-2008- 031. 10. ANTICIPATED IMPACTS: The initial grading of the property would result in the disturbance of approximately 1,742,400 sq. ft. (40.0 acres) of high ground. The proposed driveway construction and dam repair, including culvert installation, would result in the filling of approximately 8,360 sq. ft. of Section "404 type" wetlands and approximately 732 sq. ft. of fresh water ponds. The construction of the buildings, parking areas, driveways and amenities would result in the creation of approximately 832,679 sq. ft. of impervious coverage. The construction of the pier and docking facility would incorporate approximately 2,020 sq. ft. of public trust and estuarine waters. No impacts are proposed within coastal wetlands or surface waters. This application includes the impacts to one isolated wetland pocket as well as non- isolated wetland/waters impacts as indicated on the plan. As proposed, total wetland impacts would be equal to 0.275 acres and total open water impacts would equal 0.084 acres. The open water (fresh) impacts are associated with the proposed dam repairs. Mitigation for the necessary impacts to 404 wetlands associated with the repair of the 3 existing dams will be the preservation of all remaining riparian and non-riparian wetlands including all coastal wetlands on the property. Wetland preservation will be accomplished through the recordation of restrictive covenants (see PCN attachment) referencing these wetlands while allowing for the maintenance of the dams and community pier. The project is located on the Intracoastal Waterway, Shallotte, Brunswick County, North Carolina.
