Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The applicant contracted with S &EC to complete a wetland and Jordan Watershed Buffer evaluation for the entire property and the offsite areas in order to identify the natural resources so that the project designers could design a site plan that would minimize impacts to wetlands, streams and buffers to the maximum extent practicable. The proposed project includes nineteen (19) impact areas that include impacts to jurisdictional wetlands and /or jurisdictional streams. Impact 1 is a proposed road crossing to a perennial stream and wetland. This proposed crossing will result in 77 linear feet of permanent, 26 linear feet of permanent (no permanent loss) for the dissipater, 10 linear feet of temporary and 0.037 acres of wetland (permanent + temporary) impacts. The permanent impacts are necessary to provide access from Green Level Church Road. This crossing has been designed to be a perpendicular crossing and will utilize retaining walls and headwalls to minimize the stream and wetland impacts. Impact 2 is a proposed road crossing to a perennial stream. This proposed crossing will result in 115 linear feet of permanent, 40 linear feet of permanent (no permanent loss) for the dissipater, 14 linear feet of temporary impacts. The permanent impacts are necessary to provide access the eastern portions of the property. This crossing has been designed to utilize retaining walls and headwalls to minimize the stream impacts Impact 3 is a proposed road crossing to a perennial stream. This proposed crossing will result in 92 linear feet of permanent, 54 linear feet of permanent (no permanent loss) for the dissipater, 12 linear feet of temporary impacts. The permanent impacts are necessary to provide access the northeastern portions of the property. This crossing has been designed to be a perpendicular crossing and will utilize retaining walls and headwalls to minimize the stream impacts. For all three (3) road crossings, the temporary impacts are necessary for construction, these areas will be brought back to original stream bed elevation and the stream banks will be stabilized post construction of the culvert. The dissipaters will be constructed such that the top elevation of the riprap will not exceed that of the pre - construction elevation of the stream bed. Impact 10 -3 is a proposed road crossing on a jurisdictional wetland. This proposed crossing will result in 0.046 acres of wetland fill necessary to access lots and a pocket park for the development. Impacts 6, 7, 8, 9, 10 -1, 10 -4, 10 -5, 10 -6 & 11 are proposed wetland impacts associated with fill activities. Wetland impacts have been avoided and minimized where possible and retaining walls have been utilized where practicable. Impacts 4, 5, 10A, 10B, 10 -2, 12, 13, A, B, C, D, E, and F are all proposed sanitary sewer crossings located onsite and offsite. Four (4) areas are temporary impacts to perennial streams, three (3) areas are temporary impacts to intermittent streams and nine (9) areas are to junsdictional wetlands. All proposed utility crossings to streams have been designed to cross at a perpendicular angle. All temporary impacts will be brought back to original stream bed elevation and the stream banks will be stabilized post construction of the utility crossing. All temporary wetland impacts will be brought back to original contours and re- vegetated with native species. Furthermore, the applicant is aware of the regional conditions associated with the Nationwide Permits 12 & 29. With respect to residential development conditions (NWP 29- Regional Conditions section 4.0) there are no impact associated with single- family recreation facilities, there are no permanent wetland or stream fills proposed within the floodway/floodplain and the stream classification for this project is WS -IV, NSW (i.e. not Outstanding Resource Waters, High Quality Waters, Coastal Wetlands or wetland adjacent to these waters). Our company hereby confirms that the Credits are currently available for transfer from the Bank's Ledger to the Applicant at a cost of $9,000.00. As of today we are placing these credits on reservation for a period of forty -five (45) days, or until the permit is issued, whichever occurs first. If the Permit is not issued within forty -five (45) days of the date of this letter, we will require the Applicant to place a non - refundable deposit in the amount of twenty percent (20 %) (51.800.00) of the total purchase price of mitigation needed. This will extend the reservation of credits for another thirty (30) days. The Applicant will have ten (10) days from the date of Permit Issuance to tender full payment to the Bank. Following the expiration of this ten (10) day period, if full payment has not been received by the Bank the Credits will be released from reservation. We will then notify the US Army Corps (USACE) Project Manager triggering the requirement for a permit modification by the Applicant.
