Box 2259 Asheville, NC 28802 Subject: REQUEST FOR ADDITIONAL INFORMATION Pond Repair — Highlands Basha, LLC Dear Mr. Ferguson and Mr. Hoffman: Donald R. van der Vaart Secretary D W R # 15 -0496 Macon County On May 18, 2015, the Division of Water Resources (Division) received your application requesting a.401 Water Quality Certification from the Division for the subject project. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. Provide Agent Authorization form. 2. Provide detail for outfall for the proposed 78 LF 36 °. DIP. 3. The applicant, Highlands Basha, LLC, is a corporate entity not registered with the North Carolina Secretary of States Corporation database. Please provide proof of certification of authority from the NC Secretary of State. 4. Provide a narrative to explain and justify how the cold water release design will meet the surface water quality temperature standard for class C waters (15A NCAC 02B .0211). Temperature: not to exceed 2.8 degrees C (5.04 degrees F) above the natural water temperature, and in no case to exceed 29 degrees C (84.2 degrees F) for mountain and upper piedmont waters and 32 degrees C (89.6 degrees F) for lower Piedmont and coastal plain Waters. If all of the requested information is not received by July 25, 2015, the Division will be unable to approve the application and it will be returned. The return of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please respond in writing by July 25, 2015 by sending three copies of all of the above requested information to the 401 & Buffer Permitting Unit, 1617 Mail Service Center, . Raleigh, NC 27699- 1617. Please be aware that you have no authorization under the Section 401 of the Clean Water Act for this activity and any work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
