,as requested in the permittee’s application letter dated 11/17/14, including
the attached workplan drawings(9): 3 dated 5/23/14, 4 dated 11/10/14, and 2 dated 9/19/14.
This permit, issued on , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) Unless specifically altered herein, this minor modification and renewal authorizes the construction of
a sandblasting building and installation of sheet piling around the synchro lift, all as depicted on the
attached workplan drawings.
2)The fisheries moratorium contained within the original Permit No. 12-87 issued on 1/14/87 shall not
apply to the authorized installation of sheet piling around the synchro lift.
3)The installation of the sheet piling shall be accomplished by driving and/or the use of a vibratory
hammer. Should the permittee and/or its contractor propose to utilize another type of installation,
such as jetting, additional authorization from the N.C. Division of Coastal Management (DCM) shall
be required.
4)No non-water dependent structures shall be located within 30 feet of the normal water level.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the
other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
5)The authorized activities shall not result in any permanent or temporary impacts to wetlands, without
permit modification.
6)All reasonable efforts shall be made to contain all debris and excess materials associated with
construction activities with the intent that debris and excess materials do not enter wetlands or waters of
the State, even temporarily.
7)The permittee and/or his contractor shall contact the DCM Transportation Project Field Representative
in Elizabeth City at (252) 264-3901 to request a preconstruction conference prior to project initiation.
Maintenance Clause
8) DCM shall be notified in writing at least two (2) weeks in advance of any maintenance excavation work
authorized by this permit, and such notification shall include:
A. The number of the original permit.
B.A statement that no dimensional changes are proposed.
C.A copy of the original permit plans with cross-hatching indicating the area to be maintained, the
area to be used for spoil disposal, and the estimated amount of material to be removed.
D.The date of plan revision and the permittee’s signature shown anew on the original plan.
NOTE:
The location, design, and holding capacity of the spoil disposal site shall be approved by a
representative of DCM prior to the initiation of any maintenance dredging activities.
General
9)This project shall conform to all requirements of the N.C. Sedimentation Pollution Control Act and the
N.C. Department of Transportation’s (NCDOT’s) Memorandum of Agreement with the N.C. Division of
Energy, Mineral, and Land Resources.
NOTE:
This minor modification and renewal do not eliminate the need to obtain any additional permits,
approvals or authorizations that may be required.
10)This minor modification and renewal shall be attached to the original of Permit No. 12-87, which was
issued on 1/14/87, as well as all subsequent modifications and renewals, and copies of all documents
shall be readily available on site when a Division representative inspects the project for compliance.
11)All conditions and stipulations of the active permit remain in force under this minor modification and
renewal unless altered herein.
