O nbehalf of the Huntersville Park and Recreation, M o4dam shas subcontracted Carolina Wetland Services, Inc. (CWS)to provide Section 404/401 perm iting services for this project. An executed Agent Authorization Form is attached (Attachment B). The purpose of the project is to construct a greenway trail. (CWS) to provide a protected species assessment for the Huntersville G leenway site. The Huntersville G leenway site is an approximately 0.9 m le long, 30-foot wide corridor located southwest of the Sam Furr Road and O 11 Statesville Road intersection in Huntersville, North Carolina (Figure 1, attached). M ethods In-office Desktop Review To determ he which protected species are listed as occurring or potentially occurring within the project vicinity and prior to conducting the on-site field investigation, CWS consulted the United States Fish and Wildlife Service (USFWS) Endangered and Threatened Species and Species of Concern by County for North Carolina online database for Mecklenburg County'. Field Survey CWS scientists M egan Bollero, WPIT' and Am ie Hoy, WPIT, conducted a pedestrian habitat assessment of the project area on M ay 23, 2022. Potential habitats for potentially occurring federally-protected species that were identified during the desktop review were assessed in the field for the quality of physical and/or biological features essential to the conservation of the applicable species. Additionally, during the pedestrian habitat assessment, areas were reviewed for applicable federally protected species. Identification references for natural communities include the National Land Cover Database (2011)8. An intensive targeted survey for Schw anitz's sunflow er w a; conducted on August 30, 2022. Results Based on the NCNHP data explorer review, there are no current occurrences of federally protected species within a one-m le radius of the project Iim is (Attachm eit A). They can reach heights of five feet. Populations are lim ted to the piedm cnt of North and South Carolina. It has been listed as an Endangered species under the ESA since 1991.9 The typical habitat for this plant includes roadsides, old pastures, transm'ssion line right-of-ways, open areas, either natural or hum an-m antained habitats, or edges of upland woods. M ajor characteristics of soils associated with suitable Schweinitz's sunflower habitat include thin soils, soils on upland interstream flats or gentle slopes, soils that are clay like in both composition and texture (and often with substantial rock fragm ents), soils that have a high shrinkage swell capacity, and those which vary over the course of the year from very wet to very dry. Biological Analysis: A desktop review of the site was conducted on M air 23, 2022, and determ hed that the Cecil soil series that have known Schweinitz's sunflower populations cover a sm all portion of the project lim ts. The m ajority of the site is on a sewerline or powerline right-of-way which is infrequently m antained and is suitable habitat for Schweinitz's sunflower (Photographs 1-3). The forested areas within the project lim is do not provide adequate sunlight to support Schweinitz's sunflower (Photograph 4). An intensive targeted survey for Schweinitz's sunflower was conducted on August 30, 2022 and no individuals of this species were found. Since no individuals of Schw anitz's sunflow e- were observed w khin the project lim its during the targeted survey, but suitable habitat is present, CWS concludes that the project may affect, but is not likely to adversely affect Schw eiitz's sunflow e-. Sm coth coneflower (Echinacea laevigata) Habitat Description: Sm coth coneflower is a tall, perennial herbaceous plant found in areas with abundant sunlight where com petition in the herbaceous layer is m him al. It has been federally listed as Endangered under the ESA since 1992.10 Typical habitat for this plant includes meadows, open woodlands, the ecotonal regions between m eadows and woodlands, cedar barrens, dry limestone bluffs, clear cuts, and roadside and utility rights-of-way. In North Carolina, the species norm ally grows in m agnesium-and calcium-rich soils associated with gabbro and diabase parent material, and typically occurs in Iredell, Misenheim er, and Picture soil series. It grows best where there is abundant sunlight, little com petition in the herbaceous layer, and periodic disturbances (e.g., regular fire regim e, well-tim ed m owing, careful clearing) that prevents encroachm ent of shade-producing woody shrubs and trees. M ichaux's sum ac (Rhus m chauxii) Habitat Description: Michaux's sum ac is a rhizom atous shrub. It is densely hairy with com pound leaves exhibiting evenly-serrated leaflets. Flowers are sm all, greenish to white, in term hal clusters. Fruits are red drupes produced from August to O dober. It has been listed as an Endangered species under the Endangered Species Act (ESA) since 1989.12 It is found on the coastal plains of Virginia to Florida, with m ost populations occurring in North Carolina. It prefers sandy or rocky open woods with basic soils, as well as, highway right-of-ways, roadsides, or edges of artificially-m antained clearings. Biological Analysis: A NCNHP data record review revealed that there are no current occurrences for this species within the project lim is (Attachm ent A). Disturbed open areas conducive to early-successional species are not present in the project area. The on-site soil series are slightly acidic which is not suitable habitat for M ichaux's sum ac. Additionally, there are no current records of this species within Mecklenburg County13. Due to the lack of habitat and known occurrences, CWS concludes that this project w it have no effect on M ichaux's sumac. Tricolored bat (Perim Wtis subflavus� O nSeptem ber 14, 2022, the U.S. Fish and Wildlife Service (Service) published a proposal in the Federal Register to list the tricolored bat (Perim), tis subflavus) as endangered under the Act.14 The Service has up to 12-m cnths from the date the proposal published to m ake a final determ hation, either to list the tricolored bat under the Act or to withdraw the proposal. The Service determ Ned the bat faces extinction prim Drily due to the range-wide im pacts of white-nose syndrome(WNS), a deadly fungal disease affecting cave-dwelling bats across North America. Because tricolored bat populations have been greatly reduced due to WNS, surviving bat populations are now m cre vulnerable to other stressors such as hum an disturbance and habitat loss. Species proposed for listing are not afforded protection under the Act; however, as soon as a listing becom es effective (typically 30 days after publication of the final rule in the Federal Register), the prohibitions against jeopardizing its continued existence and "take" will apply. Bald eagle (Haliaeetus leucocephalus) The Bald and G dden Eagle Protection Act,15 enacted in 1940, prohibits anyone without a perm t issued, from "taking" bald eagles, including their parts, nests, or eggs. Habitat for the bald eagle includes cliffs and forested areas typically within 1.0 m le of estuaries, large lakes, reservoirs, rivers, seacoast, and as they become m cre abundant, stands of undisturbed forest. A desktop-G 5 assessm Ent of the project study area, as well as, the area within a 1 m le radius of the project lim its, was performed on M ay 24, 2022, using 2021 color aerials. There are no water bodies located within 1 m le of the Huntersville G ieenway site that are potentially large enough or sufficiently open to be considered a potential feeding source. According to the NCNHP database, there are no current occurrences of this species within 1.0 m le of the project study area. Additionally, no bald eagles or bald eagle nests were observed within the study area at the tim eof the site visit. Due to the lack of optim al habitat within the project lim is and lack of observations, CWS concludes that this project w it have no effect on this species.
