Located in the Forest Hills Subdivision,Wilmington,New Hanover County,North Carolina. Please reference those items outlined from your correspondence below. For each item I have included a response in italics: - Regarding avoidance and minimization, what is preventing the house to be pushed forward south and west on the lot and the garage pushed east on the lot resulting in a single crossing since the garage is detached by design? Understanding there is a 30-foot front setback, you would need to exhaust all variance options from the City before this could be considered not feasible. Also, the design could have the garage forward and house on the rear of the property just opposite of the current design. See drawing below: The Front Setback is actually 50'per the covenants and there is not a variance process within the community to appeal to. The Engineer did lay out the structures with the minimum setbacks and it was notpossible to do so and avoid impacting the stream.See revised plans depicting Options I and 2. If you can demonstrate that the above minimization alternative is not practicable, please consider moving the stream feature along the property line to maintain an open channel that retains some of its functionality. - The Engineer attempted to locate the structures to allow the stream to be relocated along the property line. However, this caused grading conflicts with the house and stream channel and thus, eliminated this as a practicable alternative. See Option 3. If the original plan can be justified,the drawing provided needs to be updated. a. north arrow b. The proposed 30" pipe does not appear to outlet into a channel depicted on the drawing. c. Must provide simple cross section of the pipe, see example below. d. Show all permanent and temporary impacts. e. Will there be any headwall installed for the pipe inlet or outlet, if not please show how this stabilization will take place. Plans Updated with Items "a-d". CROSS SECTION DRAWING FOR STREAM CROSSING �se.^rac:a— me�ccasr JF The proposed impact is to a perennial stream with wetland floodplain that drains approximately 345 acres in this watershed. Despite the impact being less than 0.02 of an acre discussed in the regional conditions, this field office will typically require stream mitigation for such features that fall in a natural crenulation in the coastal plain, see lidar image below. If you believe this stream channel does not warrant mitigation you will at minimum need to provide a stream assessment describing the stream's current condition. If it rates as a medium quality or better, mitigation would be presumed. There are several instances along this same channel where the Corps has required avoidance despite pressures to do otherwise. I do understand how the feature presents on LiDAR and the size of the original watershed.However,due to modifications to the drainage system in the past,the existing Watershed is currently 25.5 Acres+/-. This is due to a Lawsuit against City, which resulted in the old existing ditches that come into South Churchill Dr, Gillette Dr from the East and South being intercepted with a large storm drainpipe that runs within Gillette Dr and exits at the West of the Boney Lot(big pipe that empties into the canal directly adjacent to Mr.Boney's lot).Please see Watershed Map. - Additionally,we did conduct an NC SAM survey of the stream which yielded a "low"overall stream designation. I believe this is a component of the lower hydrologic input due to the pipe mentioned above.Please see attached SAM Forms - I do concur that at one time this stream was likely a healthy coastal stream system that provided several aquatic functions.However,due to the reduction of the overall watershed and urbanization of the surrounding area, those functions have been greatly reduced.Based on this,we prefer to not propose mitigation. - If the pipe is ultimately installed, how will it be installed below the sanitary sewer, and do you have permission to extend the project through City of Wilmington property? The proposed 48"Storm Drainpipe would go over the 10"Sewer Pipe. Foundations would be installed under storm pipe at crossing. Based on the information outlined in Options 1-3,I believe that the proposed plan is justified as the least damaging, practicable alternative.
