PERMIT
In 1974,the North Carolina General Assembly passed
the Coastal Area Management Act and set the stage for
guiding development in the fragile and productive areas
which border the state's sounds and oceanfront. Along
with requiring special care by those who build and
develop, the General Assembly directed the Coastal
Resources Commission(CRC)to implement clear regula-
tions which minimize the burden on the applicant.
This application for a minor development permit under
CAMA is part of the Commission's effort to meet the
spirit and intent of the General Assembly. It has been.
designed to be straightforward and.require no:more
time or effort necessary from the applicant. Please go.
over this folder with the Local Permit Officer(LPO)for
the locality in which you plan to build to be certain that
you understand what information he or she needs.
Under CAMA regulations, the minor permit is to be
issued within 25 days once a complete application is in
hand. Often less time is needed if the project is simple.
The process generally takes about 18 days. You can
speed the approval process by making certain that your
application is complete and signed, that your drawing
meets the specifications given inside and that your
application fee is attached.
Other permits are sometimes required for development
in the coastal area. While these are not CAMA-related,
we urge you to check with the Local Permit Officer to
determine which of these you may need. A listing is
included on page 2 of this folder.
We appreciate your cooperation with the North
Carolina Coastal Management Program and your
willingness to build in a way which protects the
resources of our beautiful and productive coast.

APPROVAL of 401 Water Quality Cer
Dear Mr.Blackwell: — —
You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.004
acre (188 square feet) of wetlands and to dredge 1,36 acres (59,380 square feet) of bottom material in order to develop a
commercial marina and residential development at Gallant's Channel at Broad Street in Beaufort, Carteret County, as
described in your application dated 21 July 2000 and in a permit modification request received on March 15, 2001. After
reviewing your application, we have determined that this work is covered by General Water Quality Certification Number
3274. This Certification allows you to use your CAMA Permit when the NC Division of Coastal Management issues it. In
addition, you should get any other federal, state or local permits before you go ahead with your project including (but not
limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations.
Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General
Certification. This Certification replaces the one issued to you on July 24, 2000, filed under DWQ Project No. 99-1446. This
Certification replaces the one issued to you on August 24, 2000.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application for a new certification. If the property is
sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying
with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may
be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in
the attached certification and the additional conditions listed below:
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or
areas within 50 feet of all streams and ponds. These mechanisms shall be put in place within 30 days of the date of this
letter or the issuance of the 404 Permit (whichever is later). A sample deed notification format can be downloaded from
the 401/Wetlands Unit web site at http://h2o.enr.state.nc.us/ncwetlands ;
2. A sediment/turbidlty curtain must be in place in Gallant's Channel during all dredging activities;
3. If return water is to be sent from the upland ditched disposal area, then a two-setting basin design must be used and
receive additional written DWQ approval.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C.27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have
any questions, please telephone John Domey at 919-733-9646.
