In response to your letter dated May 12, 2023, regarding the above referenced Notice of
Violation:
The sanitary sewer overflow (SSO) that occurred on April 28, 2023, was related to a sudden
large amount of rain that resulted in 1.37 inches over a period of just 8 hours. Although our lift
station was fully operational, staff was on site, and pump trucks quickly arrived, the quick large
spike in the amount of rain (see data included) was more than the pumps could handle.
Burke County has applied for financial assistance from the NCDEQ Division of Water
Infrastructure to increase the capacity of this lift station. In addition, Burke County has applied for
assistance through the Building Resilient Infrastructure and Communities (BRIC) grant program
offered by FEMA. If BRIC funding is received, it will be used to make the lift station more resilient
by raising the elevation of the critical equipment and the access road to above flood level.
Additionally, 2.4 million dollars has been included in the county's FY-24 recommended
budget to address collection system I & I and the issues with our Indian Hills pump Station.

The self -reported Sanitary Sewer Overflow (SSO) 5-Day Report submitted by Burke County General Services
indicates violations of permit conditions stipulated in the subject permit and North Carolina G.S. 143-215.1.
Violations include failing to effectively manage, maintain, and operate the subject collection system so that there is
no SSO to the land or surface waters and making an outlet to waters of the State for purposes of G.S.
143-215.1(a)(1), for which a permit is required.

a written response to this Notice of Violation. Your response is to be received by the regional office within 15
business days following receipt of this violation. Please include any additional documentation about this incident(s)
in the response. The submittal will be considered in determining whether the Division will assess a civil penalty for
the cited violations.
