This letter provides speculative effluent limits for 0.4 MGD and 0.5 MGD at the Cleveland WWTP. The
Division received the speculative limits request in a letter dated September 7, 2017 from Danny Gabriel,
Mayor of the City of Cleveland. Please recognize that speculative limits may change based on future water
quality initiatives, and it is highly recommended that the applicant verify the speculative limits with the
Division's NPDES Unit prior to any engineering design work.
Receiving Stream. Third Creek is located within the Yadkin River Basin. Third Creek has a stream
classification of C, and waters with this classification have a best usage for aquatic life propagation and
maintenance of biological integrity, wildlife, secondary recreation and agriculture. Third Creek has a
summer 7Q 10 flow of 14.0 cfs, a winter 7Q 10 flow of 24.1 cfs, and an annual average flow of 89.1 cfs.
There is a Total Maximum Daily Load (TMDL) on Third Creek for turbidity. The TMDL applies to non -
point sources and the NC DOT. WWTP point sources contribute negligible loading to the turbidity
impairment and secondary treatment standards for TSS remain. Third Creek ultimately drains into High
Rock Lake, which is listed on the 303(d) list as impaired for chlorophyll -a, and there is an impending TMDL
to address the chlorophyll -a impairment.
Based upon a review of information available from the North Carolina Natural Heritage Program Online
Map Viewer, there are not any Federally Listed threatened or endangered aquatic species identified within
a five -mile radius of the proposed discharge location. If there are any identified threatened/endangered
species, it is recommended that the applicant discuss the proposed project with the US Fish and Wildlife
Service to determine whether the proposed discharge location might impact such species.
Speculative Effluent Limits. Based on Division review of receiving stream conditions and water quality
modeling results, speculative limits for the proposed expansion to 0.4 MGD and 0.5 MGD are presented in
Tables 1 and 2, respectively. A complete evaluation of these limits and monitoring requirements for metals
and other toxicants, as well as potential instream monitoring requirements, will be addressed upon receipt
of a formal NPDES permit application. Some features of the speculative limit development include the
following:

BOD/NH3 Limits. These speculative limits are based on freezing current permitted BOD
ultimate loading (i.e., facility will not be allowed to discharge oxygen -consuming waste above
what is currently permitted). The resultant limits at expanded flows are considered
technologically -feasible.
Nutrient Limits. A TMDL to address nutrient loading to High Rock Lake is currently in
progress. In this interim period prior to TMDL finalization, these speculative nutrient limits
are based on EPA guidance for impaired waters: 1) for total phosphorus (TP), freeze the current
permitted TP mass load at expanded flows; and 2) for total nitrogen (TN) which has no limits
in the current permit, freeze the actual TN mass load based on the historical loading from
January 2016 through December 2017. The final TMDL results will ultimately override these
speculative limits, and may result in more stringent nutrient requirements.

En ' eering Alternatives Analysis (EM. Please note that the Division cannot guarantee that an
NPDES permit for a new or expanding discharge will be issued with these speculative limits. Final
decisions can only be made after the Division receives and evaluates a formal permit application for
the new/expanded discharge. In accordance with North Carolina Administrative Code 15A NCAC
2H.0105( c), the most environmentally sound alternative should be selected from all reasonably cost
effective options. Therefore, as a component of all NPDES permit applications for new or expanding
flow, a detailed engineering alternatives analysis (EAA) must be prepared. The EAA must justify
requested flows and provide an analysis of potential wastewater treatment alternatives. A copy of the
Division guidance for preparing EAA documents is attached.
State Environmental Policy Act (SEPA) EA/EIS Requirements A SEPA EA/EIS document may be
required for projects that: 1) involve $10 Million or more of state funds; or 2) will significantly and
permanently impact 10 or more acres of public lands. Please check with the DWR SEPA coordinator
(David Wainwright, 919-807-6442) as to whether your project requires SEPA review. For projects that
are subject to SEPA, the EAA requirements discussed above will need to be folded into the SEPA
document. Additionally, if subject to SEPA, the NPDES Unit will not accept an NPDES permit
application for a new/expanding discharge until the Division has approved the SEPA document and
sent a Finding of No Significant Impact (FONSI) to the State Clearinghouse for review and comment.

The Town of Cleveland has requested speculative effluent limits for proposed flows of 0.4 & 0.5 MGD in
a letter dated September 7, 2017. The facility discharges to Third Creek, class C, in the Yadkin Pee -Dee
river basin. Statesville's Third Creek W WTP and Seven Cedars MHP also discharge to Third Creek and
are accounted for in the modeling. The stream is subject to a TMDL for turbidity impairment, with
W WTPs contributing negligible loading to the impairment at secondary standards. The Town submitted
s7Q 10 flow for USGS stream gauge 02120500 located just upstream of the facility's outfall as published
in the USGS' Low flow characteristics and flow -duration statistics for selected USGS continuous -record
streamgaging stations in North Carolina through 2012. However, the station was only active from 1940-
1971 and the published s7Q10 is 2 cfs greater than that used in previous models for this and other
facilities on Third Creek. The more conservative 14 cfs as originally used was maintained for this model
run.
The original Level B input file for the 1994 model could not be located so model conditions were
recreated using input parameters from the model's hardcopy in the files. The recreated model closely
matched the original model outputs with a DO minimum of 3.95 mg/L at mile -point 17.5 versus a DO
minimum of 3.97 mg/L at mile -point 17.27 in the original model.
The model was reran using the current permitted limits for all dischargers along Third Creek. Since the
1994 model, Statesville's Third Creek plant has upgraded from 4.0 MGD to 6.0 MGD with an additional
8.0 MGD expansion tier. BODu and nutrient loads were frozen at the 4.0 MGD permit limits for the 6.0
and 8.0 MGD expansions. Running the model at the current operating configurations removed the <5
mg/L DO sags in the original (1994) configuration. Freezing Cleveland's current BODu load, the model
was ran comparing all possible flows for Cleveland at 0.27, 0.4, and 0.5 MGD versus Statesville at 6.0
and 8.0 MGD respectively. No combination of current or projected flows caused the stream to drop below
5.0 mg/L with the worst -case scenario being a DO minimum of 5.73 mg/L with Cleveland discharging
0.27 MGD and Statesville at 8.0 MGD.
Third Creek drains to High Rock Lake which is currently impaired for chlorophyll -a. Until the
implementation of a TMDL or nutrient criteria, nutrient loads for total nitrogen and phosphorous for
Cleveland will be frozen at 2016-2017 levels. The plant was discharging less nitrogen prior to mid 2015
due to operating conditions where aeration was not sufficiently maintained in the oxidation ditch. The
facility switched operators in mid 2015 which improved operations in the oxidation ditch causing
ammonia levels to consistently approach non -detection levels with the side effect of increasing total
nitrogen.
It is recommended that the Town of Cleveland be given speculative limits for 0.4 and 0.5 MGD
expansions freezing the current BODu load, and freezing TN and TP at 2016-2017 annual averages.

The Town of Cleveland, North Carolina in Rowan County is assessing its wastewater
treatment plant (WWTP) as part of a process to prepare for the potential addition of new
local industries and the consolidation of two elementary schools in the area. The WWTP
plant operates under NPDES permit No. NC NC0049867.
The existing permitted monthly average WWTP discharge is 0.27 MGD and the effluent limits
are summarized below in Table 1. Please also see the attached Quadrangle maps showing
the location of the WWTP site, Third Creek, and the general surrounding area. The purpose
of this letter is to request speculative limits for an NPDES discharge of 0.40 MGD and 0.50
MGD.

It is anticipated that the discharge point into Third Creek for the expanded WWTP will remain at
or near the current permitted location. A United States Geological Survey (USGS) streamgage
(Station Number 02120500) is located just upstream of the discharge point for the Cleveland
WWTP at approximately 35.74875 N, 80.68375 W. Refer to the attached Quadrangle and Street
maps for the streamgage's location relative to the Cleveland WWTP. Unfortunately, this
streamgage was only active between April,1940 and September,1971, and is the only
streamgage with data for Third Creek. There are three active streamgages on other streams
near the site that have been active since 2012, however, the data from these gages may not be
used exclusively to estimate low -flow data for the WWTP discharge point at Third Creek. Based
on counsel from USGS scientists we are providing the published low flow characteristics from
the discontinued streamgage on Third Creek. Low -flow characteristics for Third Creek are
summarized in Table 2 Below.
