I conduct my on -site delineation on October 27, 2014. The following are my preliminary findings: 1. Landis flagged the top of bank along each side of the stream channels using solid pink flagging. The main stream was classified as "Perennial" according to the NCDWR Stream Identification Form Version 4.11. A second stream was flagged and was classified as "Intermittent" according the form. 2. According to the Tar - Pamlico rules both of the stream channels are required to have a 50 -foot wide undisturbed buffer on each side of the stream as measured from the solid pink flagging along the top of the bank. Except that the stream in question does not show up on the USGS 7.5 -min. Topographic Map and does not show up on the Soil Survey of Granville County, NC dated July 1997. Attached is the ruling of a Neuse Basin stream buffer case in Wake County that also applies to the Tar Pamlico Basin. Based upon this ruling, the stream in question is not required to have a Tar Pamlico riparian stream buffer. 3. Attached is my hand drawn map of the streams and wetlands. If you are not planning to impact any of these areas over the stream buffers, you may not need to conduct a locational survey of the flagged boundaries. However, if you do survey the boundaries depicted on the map, I can assist irr properly connecting the points. 4. 1 recommend that you avoid crossing either of the stream channels because it appears that it can be avoided and due to all the permitting requirements if you disturbed the stream and buffer. If you need to cross the stream there is a location about midway where you could get a road crossing with no impact to 3908 Bentley Brook Dr. Raleigh, North Carolina 27612 telephone 919.696 6930 wetlands. Of course if you need to cross the stream, Landis will assist you in developing the permit submittal. 5. Landis flagged the boundary of jurisdictional wetlands in the bottomland using stripped pink and black flagging. Three small and one large wetland areas were found on the left bank of the stream adjacent to the hillside. These areas receive frequent overbank flooding. Landis also two large wetland areas on the right bank of the perennial stream and these areas also receive frequent overbank flooding. 6. 1 recommend that you avoid any of the wetlands because it would be difficult to prove a need for such impacts and second it would require permitting by the USCOE and NCDWR. If however, there is a need for work in these areas Landis can assist you in making the submittals. 7. It may be necessary to cross the stream and wetlands with a sewer line and this type of permit would be the easiest one to be approved. 8. Sewers are very different from stormwater pipes, soil erosion controls, and basins which are consider not to be water dependent structures, therefore it requires substantial proof that an impact to the streams and, or wetlands is necessary and that there is no reasonable alternative. Landis agrees to provide the following scope of services: Scope of Services - A 1. Landis will conduct a preliminary stream identification to determine if the channel is regulated as waters of North Carolina under the Tar Pamlico regulations. If wetland areas are present, Landis will flag the wetland area in the field and show the approximate location by a hand drawn map. 3. Landis will prepare a letter report explaining the findings plus the data sheets. Fee Cost for Above Services Landis agrees to provide the Scope of Services — A for a lump sum fee of seven hundred and fifty dollars ($750.00). Landis agrees to provide the Scope of Services — A +B for a lump sum fee of twelve hundred and fifty dollars ($1,250.00). The fee cost of A +B is based upon Landis making a field decision that Scope of Services — B is necessary for proper completion of the report. Landis will invoice you upon completion of work and payment will be due within 20 days of the invoice date. The issue before the Commission is which of the several neap forms produced over time by the Natural Resources Conservation Service (MRCS) did the Commission intend to be used to ideut:i fy the surface waters approximately shown on the most recent of the soil survey reap prepared by the MRCS for purposes of implementing riparian buffer protection in the Neuse River and Tar- Pa€r€lico River Basins. In consideration of the issue, the Commission finds the following: The Neuse and Tar-Pamlico Riparian Buffer Protection Rules, 15A NCAC 2B4O233 and .0259, respectively, protect 50 foot wide buffers along intermittent and perennial streams, lakes, ponds and estuaries in these river basins. These surface waters are identified as being present "if the fbature is proximately shown on either the most recent version of the soil survey Wrap prepared by the Natural Resources Conservation Service of the United States Department of Agriculture or the -2- most recent version of the 1:24,000 scale (7.5 minute) quadrangle topographic prepared by the Uinited States Geologic Survey (USGS)." 2. The buffer protection rules for the Neuse and Tar - Pamlico River Basins provide that riparian buffers adjacent to surface waters that appear on either of the maps are to be protected but riparian buffers are not protected if the adjacent surface waters do not appear on the snaps. 3. By making references to these: maps in the rules, the Commission intended to make land development and design predictable for the kgriculturai, silvicultural and development communities because the maps could be examined and an initial determination made concerning the presence of surface waters for design purposes. 4. The NRCS maps were (and are) paper -mound copies in county soil survey publications that depict soil polygons as well as surface waters in a particular county, 5. Electronic versions of the soil survey maps for several counties in lie Neuse and 1 ar- Pamlico River Basins recently have been made available for public use. However, these "Web Soil Survey" maps do not show surface waters that are depicted on the paper -bound or published copiers of the county soil surveys. The surface waters that are shown on these w eb maps are not intended to depict the actual network of streams. The nwnber and length of streams shown on the electronic NRCS maps is significantly reduced from those depicted on the paper -bound maps. fi. Thepublishedpaper- boundNRCS maps arethebest available foruseinidentification of surface waters present in the Neuse and Tar - Pamlico River Basins quid the adjacent riparian buffers. The published parper -bound MRCS maps are available in the counties or with assistance from DE NR. Based upon the foregoing findings, the Commission issues the following: -3- INTERPRETIVE RULING i The "most recent version of the soil survey map prepared by the Natural Resources Conservation Service of the (united States Department of Agriculture" referenced in 15A NCAC 2B .0233 and .0259 means the mast recent paper -bound versions of the NRCS soil surveys, or copies thereof, that were in place at the time that these reaps were first referenced in the Neuse Buffer Rule (1997) are to be used for implementing the Neuse and Tar - Pamlico Buffer Protection rules and any other Environmental Management Commission rules or programs that refer to the NR.CS maps for stream or surface water location and identification purpose unless an updated version of these maps is available that depicts, at a minimum, an equal or greater amount of linear feet of streams that was shown on the paper -bound version of the map that was in place; at the time the Neuse or Tar - Pamlico Buffer Rude was originally adopted.
