Dear Mr. Highley:
Division personnel have reviewed and approved your application for
renewal of subject permit. Accordingly, we are forwarding the attached NPDES
discharge permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U.S. Environmental Protection Agency dated
May 9, 1994 (or as subsequently amended).
The final permit authorizes Bradfield Farms Water Company to discharge
up to 0.700 MGD of treated domestic wastewater from the Bradfield Farms
current WWTP to McKee Creek, a class C water in the Yadkin -Pee Dee River
Basin. The permit includes discharge limitations and/or monitoring for flow,
biochemical oxygen demand (BOD), total suspended solids (TSS), ammonia,
dissolved oxygen, fecal coliform bacteria, pH, and total residual chlorine.
The following modifications have been made to the Bradfield Farms WWTP
NPDES permit:
All references to Carolina Water Service hic. of NC have been
removed from the permit.
The increased instream monitoring frequency for dissolved oxygen,
temperature and fecal colifonn during the summer months of June
through September is a minimum requirement for domestic
wastewater treatment dischargers based on North Carolina
Administrative Code 15A NCAC 2B .0508 (d). In addition, North
Carolina Administrative Code 15A NCAC 2B .0508 (b) (2), allows "...
additional tests and measurements at such sampling points and

with such frequency as are determined by the Director to be
necessary to adequately monitor constituents of the waste
discharge and their effect upon the receiving waters." Because
McKees Creek has been determined by the "impaired" rating to
have water quality below the State standards, the Division has the
authority to require additional monitoring of wastewater
dischargers.
• The addition of instream monitoring for fecal coliform in the permit.
The receiving stream for the facility has been placed on the 2002
303 (d) list for impaired streams for the parameter of fecal coliform.
Fecal coliform data collected instream will be useful in the
development of water quality management strategy for McKee
Creek. If it is determined that Bradfield Farms' discharge is not
contributing to the impairment, it is possible that instream
monitoring for fecal coliform could be removed.
• The addition of a total residual chlorine limit for 21 ug/1 at 0.460
MGD. A compliance schedule has now been included in the
permit. The Bradfield Farms WWTP has eighteen months from
the effective date of the permit to be in compliance with the
total residual chlorine limit. This time period is allowed in order
for the facility to budget and design/construct the dechlorination
and /or alternative disinfection system(s).
• The addition of summer and winter weekly average NH3-N limits at
0.460 MGD and 0.700 MGD to reflect the Division's current policy.
According to the Code of Federal Regulations [40 CFR 122.45
(d)(2)], "continuous discharges ...shall unless impractical be stated
as... maximum daily and average monthly discharge limitations for
all dischargers other than publicly owned treatment works". The
maximum daily limit is established based on a ratio of 5:1
(maximum daily: monthly average) for non -municipal dischargers.
The corresponding daily maximum limits for ammonia nitrogen at
the flows of 0.460 MGD and 0.700 MGD are 10.0 mg/l for the
summer and 20.0 mg/1 for the winter.
The modification of the effluent monitoring frequency for BOD5,
NH3-N, TSS, dissolved oxygen, total residual chlorine, pH and fecal
coliform from weekly to three times per week upon expansion to
0.700 MGD. This change is based on the VAVTP's rating as a
Grade III facility per North Carolina regulation 15A NCAC 08G.

If any parts, measurement frequencies or sampling requirements
contained in this permit are unacceptable to you, you have the right to an
adjudicatory hearing upon written request within thirty (30) days following
receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed
with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh,

be final and binding.
Please take notice that this permit is not transferable. Part II, EA.
addresses the requirements to be followed in case of change in ownership or
control of this discharge. This permit does not affect the legal requirements to
obtain other permits which may be required by the Division of Water Quality or
permits required by the Division of Land Resources, Coastal Area Management
Act, or any other Federal or Local governmental permits may be required.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or
discharge are hereby revoked, and as of this issuance, any previously issued
permit bearing this number is no longer effective. Therefore, the exclusive
authority to operate and discharge from this facility arises under the permit
conditions, requirements, terms, and provisions included herein.
Bradfield Farms Water Company
is hereby authorized to:
1. Continue operation of an existing 0.46 MGD wastewater treatment
facility consisting of:
• an influent lift station
• bar screen and flow splitter box
• dual surge tanks
• aeration basins
• secondary clarifiers
• sludge holding tanks
• chlorine contact tanks with gas chlorination
• traveling bridge tertiary filters
• post aeration tanks
The facility is located at Bradfield Farms Subdivision off of NCSR 2951,
southeast of Pine Ridge, Cabarrus County;
2. After receiving an Authorization to Construct from the Division of Water
Quality, construct and operate additional wastewater treatment facilities
making the build -out treatment capacity 0.7 MGD; and
3. Discharge from said treatment works at the location specified on the
attached map into McKee Creek, a class C water in the Yadkin Pee -Dee
River Basin.

We are in receipt of your February 4, 2004 letter and draft permit. There are some issues we would
like to have addressed.
1) Bradfield Farms Water Company is the owner and Permittee of this facility. Carolina Water
Service, Inc. of NC (CWS) is a sister company. Other than a common owner, the two companies
should not be linked and it would be best to leave off CWS from permit language.
2) We must object to the requirement of increased instream sampling during June - September. We
are not aware of any requirement for Permittees to supply increased stream monitoring data for
water quality strategy. This is above the requirements for the facility itself below 0.46 mgd,
which are only once per week and increases operational cost. The Permittee should not have to
bear undue extra burden of stream sampling for the division or other agencies.
3) The permit states a TRC limit of 21 ug/L with no provision for implementation. We can not
comply with this limit without dechlorination or alternative disinfection methods. Other permits
have allowed 18 months from the time of issue to become compliant. No such language was
found in the draft that we could locate. We will need time to comply.

SUMMARY OF FACILITY AND WASTELOAD ALLOCATION
The facility is requesting renewal of its existing NPDES permit. The design capacity is 0.460 MGD with an
additional effluent page for 0.7 MGD. The wastewater from the plant is 100% domestic from 1180 residential

Receiving Stream: McKee Creek since the last renewal has been added to the 2002 303d list. A Category 5 (water
for which a TMDL is required) 6.5 mile segment listed "from source to Reedy Creek" with causes of impairment
being fecal coliform and sediment. The impaired use is O. It is a low priority with potential sources as minor
nonmunicipal, agriculture, land development, and urban runoff/stormwater.
TOXICITY TESTING:

COMPLIANCE SUMMARY:
A review of the facility's compliance history indicates that there have been no problems meeting the existing limits.
Effluent levels of BOD, ammonia, TSS, and fecal coliform are all quite low. The monthly average flow through Oct.
2003 is approximately 0.152 MGD much less than the lowest permitted flow of 0.460 MGD.

INSTREAM MONITORING:

The facility is currently required to monitor temperature and dissolved oxygen at the locations above. The
requirement to monitor fecal coliform and conductivity was deleted in the 2000 renewal. This recommendation was
made before McKee Creek was placed on the 303d list for fecal coliform impairment. Based on this updated
information, it is recommended that instream monitoring for fecal coliform be placed back in the Bradfield Farms
permit. The monitoring frequency will be weekly to coincide with the instream monitoring frequency for temperature
and DO.
PROPOSED CHANGES:
• The addition of a weekly instream monitoring for fecal coliform to the permit based on the listing of the
receiving stream, McKee Creek, on the 2002 303(d) list of impaired streams.
• The addition of a daily maximum limit for total residual chlorine of 21 ug/l at 0.460 MGD based on new
DWQ procedure for new and existing dischargers.
• The addition of summer and winter daily maximum NH3 limits of 10 mg/I and 20 mg/l, respectively, at
0.460 MGD and 0.700 MGD.

tablet chlorination/disinfection, chlorine contact tank, traveling bridge tertiary
filter, post aeration tank and flow measurement device.

The Bradfield Farms W WTP serves approximately 1300 homes and has one pump station
(Peacock Pump Station) located on Peacock Road. The W WTP and the collection system seemed
to be adequately maintained and operated at the time of the field visit. This office recommends
renewal of this permit.
