This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9,1994, or as subsequently amended. RENEWAL SUMMARY Phased Permit. Based on recent correspondence, the Division understands that the multiple treatment - train hardware located at this facility is only partially connected and in use. Moreover, your records show regular discharge flows averaging less than 0.200 MGD per month. The Division has therefore adjusted this permit to accommodate flow -in phases based on actual flow conditions. Phase I [Section A. (1.)] requires mostly 1/Week monitoring for a Class II facility with flow limited at 0.350 MGD, based on existing treatment hardware. Upon reaching a monthly average flow of 0.280 MGD (based on a calendar year annual average), or 80 % of permitted capacity, you must notify the Division of your intent to advance to Phase II [see permit Special Condition A. (3.)]. Phase H requires mostly 3/Week monitoring as Class III with a total permitted flow of 0.670 MGD [Section A. (2.)]. Please note that you must request the Mooresville Region Office to inspect any newly connected facilities prior to discharge under Phase II. Concerning Ammonia and Chlorine. The Division has also added Daily Maximum limits for ammonia (NH3 as N), as required by EPA. We have added a chlorine (TRC) limit in accordance with the new statewide standard; monitoring to be conducted only if you use chlorine to disinfect. This permit reflects your recent installation of ultra -violet (UV) disinfection facilities. Error Correction. Effluent monitoring for Temperature was inadvertently left out of the permit draft. The Division has therefore added 1/Day monitoring (water -quality limited) to both phases of this permit final. kFOM NCDENR N. C. Country Woods W WTP discharges to Goose Creek, an impaired stream. Goose Creek, from its source to the Rocky River, appears on the Division's 2003 Impaired Waters List [303(d) list] as a biologically impaired waterbody based on benthic macroinvertebrate data. Moreover, Goose Creek is considered environmentally sensitive due to the presence of a federally endangered freshwater mussel, the Carolina heelsplitter (Lasmigona decorata). Be advised that, if stream degradation can be attributed to point source dischargers, mitigative measures may include removing this discharge. Special Condition A. (4.). The Division received comments from the U.S. Fish and Wildlife Service and from the North Carolina Wildlife Resources Commission concerning potential impacts of ammonia (NH3) on aquatic life and endangered species. In response to these concerns, the Division intends to revise the Goose Creek Permitting Strategy (January 5, 2001) during this permit cycle. Following this revision, the Division may reopen all Goose Creek permits and adjust ammonia limits, as warranted, in keeping with revision conclusions and recommendations. If any parts, monitoring frequencies, or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing, upon written request, within thirty (30) days following receipt of this letter. You must submit this request in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and file it with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such a demand is made, this permit shall be final and binding. Please notice that this permit is not transferable except after notifying the Division of Water Quality. The Division may modify, or revoke and reissue this permit. TREATMENT WORKS RECLASSIFICATION -- Class II to Class III Upon reaching an average flow (based on a calendar year average) equal to or exceeding 0.280 MGD (80 % of permitted capacity), the Permittee shall: 1) notify the Division in writing; and 2) increase monitoring frequencies to 3/Week according to Section A. (2.). The Permittee shall thereafter maintain compliance required of a Class III facility permitted at 0.670 MGD, unless request is made and granted to modify this permit. A. (4.) This facility services a residential subdivision; therefore the waste stream is wholly domestic. This complex treatment system (0.670 MGD) consists of seven (7) parallel treatment trains (batch plants); a dual - train at 0.090 MGD, a dual -train at 0.100 MGD, and a triple -train at 0.480 MGD (three batch plants at 0.160 MGD each). Each treatment train has a discrete equalization basin, aeration basin, clarifier, post aeration, tertiary filters, and aerated sludge tanks. The Permittee has most recently added two 0.980 MGD ultra violate (UV) disinfection units (Authorization to Construct dated December 3, 2004). A backup power generator and a recording -type flow meter support all systems discharging to a common Outfall 001. Permit History. Country Woods W WTP was first permitted in 1994 when issued to Mid South Water Systems, Inc. who sold it to Heater Utilities in June 1999. Heater Utilities in turn sold it to Aqua of North Carolina, Inc. in 2005 (Table 1). The 2001 permit was issued following the Division's impaired -stream analysis and subsequent development of the Goose Creek NPDES Permitting Strategy dated January 3, 2001. At renewal, the Division denied Heater Utilities' request to expand from 0.670 MGD to 0.690 MGD because of impaired stream conditions. Moreover, the Division reclassified the plant from Class II to a Class III, based on the existing treatment system "as built." Following negotiations with no resolution, the Permittee adjudicated the permit arguing that the facility should remain a Class II based on actual flow (average less than 0.200 MGD), and thus, monitoring activities reverted to the previous permit (issued November 1994). Compliance monitoring in the 1994 permit specified weekly (Class II) rather than 3/week (Class P. Request to Renew. The Division received the permittee's Permit Renewal Application (Short Form D) on March 25, 2003. The issued permit expired on October 31, 2003, however because of the pending legal case, the Permittee's Fact Sheet NPDES NCO065684 Renewal Page 1 application to renew could not be processed. The Division has since received notice from the court that this case has been dismissed due to inactivity. This facility has since changed ownership again. Waste Load Allocation (WLA). The Division last prepared a WLA in September 1994 and developed effluent limits and monitoring requirements. The Division judges these limits and monitoring requirements to be appropriate for this renewal with the exception of the additions and deletions listed below (see RENEWALS Y). Existing Stream Conditions. The Division verified that this facility discharges to Goose Creek, a Class C stream within the Yadkin River Basin. Goose Creek is listed as an "impaired" waterbody [303(d) listed] due to "biological impairment based on benthic macroinvertebrate data," and also "excessive instream fecal coliform concentrations." In addition, Goose Creek is considered environmentally sensitive due to the presence of a federally endangered freshwater mussel, the Carolina heelsplitter (Lasmigona decorata). Impaired conditions have mandated subbasin-specific permitting guidance for Goose Creek and its tributaries. FILE REVIEW Correspondence. Mooresville Regional Office (MRO) generated a Staff Report dated July 17, 2003 following a facility inspection conducted by Samar Bou-Ghazale (MRO) on July 8, 2003. Mr.. Bou-Ghazale noted that the WWTP appeared in good working condition and recommended that the Division renew this permit. This facility was more recently inspected by MRO in March 2006. Compliance and DMR Review. Division records no violations or enforcements against this facility since 1999. DMRs were reviewed from January 2003 through February 2006. Monthly average flow ranged generally between 0.150 MGD and 0.200 MGD with isolated maximums approximating 0.500 MGD. Effluent fecal coliform counts were reported within permit limits and often below detection levels at <1/100 ml. Effluent dissolved oxygen generally averaged between 8 and 9 mg/L through critical summer seasons. Total Suspended Residue (TSR) averaged < 1.0 mg/L with a maximum of 8.3 mg/L detected in 2002 [This test method will be re - described as Total Suspended Solids (TSS) in the renewed permit]. Effluent chlorine (TRC) concentrations were reported below the permit limit of 19 µg/L. Instream Monitoring. Recorded dissolved oxygen (DO) and temperatures in the receiving stream, both upstream and downstream, appear normal and seasonally appropriate, with summer DO values averaging above 8.0 mg/L. Instream fecal coliform counts varied with no significant difference downstream when compared to upstream levels. These data therefore do not indicate a significant fecal contribution by this point source discharge. Whole Effluent Toxicity (WET) Testing. This facility does not conduct WET testing because it is 100 % domestic and discharges less than 1.0 MGD. RENEWAL SUNB4ARY This permit has been renewed as previously permitted, as Class III WWTP discharging into an impaired stream. Effluent limits and monitoring conditions have been applied in accordance with the Division's Goose Creek NPDES Permitting Strategy (January 3, 2001). The Division has added ammonia Weekly Average limits, as required statewide by EPA. The total treatment capacity of hardware in use is 0.350 MGD. Therefore, the current system in use qualifies as a Class lI facility (<0.500 MGD). Considering the Permittees excellent compliance history, (no violations within the last 30 months), the Division will adjust the permit accordingly. Reviewed data (Jan 2005 thru Jun 2006 — see attached database) Flow max = 0.478 MGD; ave = 0.177 MGD NH3 max = 1.5 mg/L; ave = 0.12 mg/L Total P max = 5.2 mg/L; ave = 4.1 mg/L Considering the above, the Division has included effluent pages to accommodate permitted flow as a "phased permit" for 0.350 MGD (as built) and 0.670 MGD (expansion to total permitted flow). Considering impaired stream conditions, it is the Divisions best professional judgment that, upon flow reaching 0.280 MGD (80% of 0.350 MGD), the Permittee shall comply with Class III limits and conditions including 3/Week monitoring. The permit cover letter will reflect the Permittee's need to notify the Division upon reaching 80 % of Phase I permitted capacity. They will further need to request the Mooresville Regional Office to inspect new treatment -train hardware installed to accommodate Phase H flow. Error Correction. But ... the other thing he brought up was that he was really commenting that we should include a more stringent ammonia limit in any permit where there were endangered mussels (and there are several areas across the state) not just the Goose Creek area. This is more problematic. So, I told him that you guys may want to discuss this when you talk about the strategy for Goose Creek. He knew we wouldn't want to approach this on a permit by permit basis. It appears the primary difference between each Phase is the monitoring frequency. Monitoring frequency for Phase I is 1/Week whereas it is 3/Week for Phase II. Both Phases require monitoring 3/Week for NH3 as N, Temperature, Dissolved Oxygen and Fecal Coliform during June, July, August, and September. Also included was information regarding ammonia and phosphorus. For ammonia (NH3), it appears there were 63 measurements over a 14 month period. The average NH3 was 0.21 mg/I and there were 2 measurements that exceeded 1.0 mg/I; the maximum value was 1.5 mg/l. For phosphorus, it appears there were 5 measurements over a 12 month period. The average phosphorus was 4.1 mg/1 and the maximum value was 5.2 mg/l. We have no objection to the proposed phasing of the permit or the proposed monitoring requirements for each of the phases. All effluent discharges through ultraviolet (UV) disinfection and a recording -type flow meter. Each treatment train has chlorine contact tanks with tablet chlorination and de -chlorination, although it appears chlorine disinfection may be used only as a backup to UV disinfection. Due to the presence of the Carolina heelsplitter, a Site Specific Water Quality Management Plan is being developed for Goose Creek and Duck Creek under provisions of the North Carolina Procedures for Assignment of Water Quality Standards (15A NCAC 2B .0100) section .0110 Considerations for Federally -listed Threatened or Endangered Species. The U.S. Fish and Wildlife Service, N.C. Wildlife Resources Commission, and N.C. Natural Heritage Program developed a Technical Support Document for this Site -Specific Management Plan. More specifically, water quality standards for ammonia, nitrate -nitrite and phosphorus and revisiting point source permit loads are of particular concern. Therefore, we recommend the following conditions be incorporated into the permit to reduce impacts to aquatic and terrestrial wildlife resources and in particular to listed species. 1. An acute water quality standard of 1.75 mg/1 total ammonia as N and chronic standard of 0.50 mg/l (based on the 90th percentile pH of 8 for Goose Creek). 2. While nitrate and phosphorus are not as important from a toxicity standpoint as ammonia, these are related to excessive nutrient loading, nuisance algal blooms and dissolved oxygen depletion. Therefore, we recommend nutrient targets of 0.4 mg/1 for nitrate -nitrite and a 0.1 mg/1 for total phosphorus. 3. Portions of Goose Creek do not have flow for significant periods, particularly during droughts, and the dilution potential at these times is non-existent.. Therefore, the low flow statistics used in the strategy for establishing the extent of expected dilution need to be revised. Accordingly, permit limits will need to be revised to reflect this lack of dilution. 4.
