Stewart Land Design Engineering Services, Inc. 1700 East Boulevard Charlotte NC 28203 Dear Mr. Stewart: Subject: NPDES NCO065684 Mid -South Water Systems Country Woods Subdivision Union County This is in response to your letter of July 15, 1993, regarding the subject facility relinquishing rights to a portion of their permitted capacity to Union County for a new facility. This scenario would be allowed with the requirement that the limits in both permits would contain the same limits currently required for the 0.7 MGD flow. The existing discharge pipe to Goose Creek could be utilized by both facilities provided that effluent monitoring could be performed prior to mixing of the two discharge flows, and provided that the responsibility for the maintenance of the outfall pipe is defined To fully assess the request, an application must be submitted by Mid -South to modify/reduce the permitted flow for the existing facility and an application must be submitted by Union County. A complete application package must be submitted by each party, including the engineering alternatives analysis, forms and fees ($400.00 each), along with the justification described below. The applicant should also be made aware that species in this area have recently been put oil -the Federal endangered species list and that more stringent requirements, especially regarding chlorination/dechlorination, may be imposed to protect these species. While this proposal is approvable, the Division questions the need for two wastewater treatment facilities directly adjacent to each other and would require justification in the application for this proposal. Wilso4iA TE-IROUGH: Ruth Swanek Carla Sanderson SUBJECT: MSWS/ Country Woods Subdivision (NPDES No. NCO065684) Goose Creek, Yadkin River Basin Union County Country Woods Subdivision currently has a permit to discharge to Goose Creek in the Yadkin River Basin. A WLA was performed for this facility in 1990 with three separate flows: 0.09 MGD, 0.21 MGD, 0.7 MGD. The facility has an A to C for 0.21 MGD, but is currently designed for 0.09 MGD. Based on the USGS publication for Low Flow Characteristics of NC Streams, the estimated 7Q10s stream flow will remain as it was in the previous WLA (DA=9.47 mi2, 7QIOs=O.1 cfs). The applicant for Country Woods Subdivision wishes to relinquish approximately 0.45 MGD of its 0.7 MGD permitted flow to another applicant Should P&E agree to let Country Woods Subdivision "donate" its flow for the separate plant, the Rapid Assessment Group suggests that both facilities receive the same limits designated for the 0.7 MGD plant This would ensure that water quality was protected when the two plants combined pipes to the final discharge point. Otherwise, it may be more feasible to have one permittee responsible for the final outfall. The applicant should also be aware that the Carolina heelsplitter, which exists in this area, was recently listed as Federally endangered (6/30/93). As I explained, there is a desire by L. C. Tyson Construction, developer of Country Woods to proceed with additional development across Lawyers Road, which will require increased plant capacity. The existing plant in Country Woods is a 90,000 gpd facility (the NPDES permit capacity is 700,000 gpd) and is operated by Mid -south Water Systems. An Authorization to Construct has been approved to expand this plant to 210,000 gpd. However, after evaluation and negotiations and agreement from Mid -South, the developer proposed to construct an independent adjacent to the existing plant (see attached figure) to serve the additional development which would be owned and operated by Union County. Mid -South has agreed to relinquish rights to 450,000 gpd of the permit capacity to Union County for this new facility, while retaining 250,000 gpd of capacity.
