Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
This final permit includes no major changes from the draft permit sent to you on January 23, 2002. Be aware
that the Wastewater Management Plan required by this permit must be submitted by October 28, 2002.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of
this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina
General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain
other permits which may be required by the Division of Water Quality or permits required by the Division of Land
Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be
required.

1. The flow limit applies to domestic wastewater only. Stormwater flow (or the combined flow) shall be recorded (or
estimated) and reported separately.
2. The daily average dissolved oxygen effluent concentration shall not be less than 5.0 mg/L
3. The pH shall not be less than 6.8 standard units nor greater than 8.5 standard units.
There shall be no discharge of floating solids or visible foam in other than trace amounts.
A. (2.) WASTEWATER MANAGEMENT PLAN
No later than 180 days after the effective date of this permit, the Permittee shall submit to the Division a
wastewater management plan. The plan shall include, at a minimum, the following elements:
• Alternatives analysis. Conduct a technical and economic evaluation of connection to the
nearest municipal wastewater collection system. The analysis and report should be
consistent with the EAA guidance document provided by the Division.
• Facilities assessment. Describe deficiencies and operational difficulties in the existing
collection and treatment systems that inhibit performance and/or permit compliance.
Identify potential improvements to correct those deficiencies. At a minimum, evaluate the
following considerations:
• equipment repairs and preventative maintenance,
• removal of accumulated solids, wastes, other debris

• Optimization plan. Develop a plan for optimization, rehabilitation and/or replacement
of any system components necessary to achieve optimum performance. Identify specific
measures and key tasks, including those in the above facilities assessment, and provide an
estimated schedule for completion of each.
• Biosolids management plan. Develop an operations plan to be used (and describe the
procedures currently used) for managing septage / biomass in the treatment system,
` e including associated solids wasting and disposal, to promote optimum treatment system
performance. Identify operating parameters to be used and target values or ranges of
values where appropriate.

the land in the vicinity is low lying and poorly drained.

Subsurface: Soils are not suitable.

PART IV - EVALUATION AND RECOMMNDATIONS
The facility has a history of noncompliance and insufficient
attention to maintenance and operation. Numerous civil penalties
have failed to get the attention of the permittee in the past and
the noncompliant conditions continued for an extended period. The
writer visited the plant August 7, 2001, and discussed the problems
with the operator, who had recently been contracted. It was
determined that the pump station was only being activated every two
days sending a large volume through the plant and washing out the
solids. The plant could not function under these conditions. The
operator was advised to lower the floats so the pumps would be
activated more frequently sending smaller increments of flow to the
plant. It was also determined that many of the water fixtures in
the restrooms and showers in the building were leaking, sending
excessive flows to the system. The operator agreed to try to get
this problem resolved. He was also advised that the clarifier weir
had required replacement for many years. He agreed to try to
resolve this issue also.
The writer visited the facility September 5, 2001, and found
that it looked remarkably better. The clarifier weir had been
replaced with a unit fabricated from stainless steel. The color in
the aeration basin was better and the effluent looked clear.
Similar conditions were observed when the plant was visited on
January 28, 2002, although there were floating solids in the
clarifier. The plant does not support a very healthy biomass,
probably due to the nature of the wastewater and the somewhat
intermittent nature of the input of flow. Treatment plants are
very difficult to operate with this type of wastewater. It is,
however, operating much better than in the past.
It is recommended that the permit be reissued for a period of
five years.

The subject permit expires on December 31, 2001. North Carolina Administrative Code (15A NCAC 2H.0105(e))
requires that an application for permit renewal be filed at least 180 days prior to expiration of the current permit. To satisfy this
requirement, your renewal package should have been sent to the Division postmarked no later than July 4, 2001.
As of this date, the Division has not received a renewal request for the subject permit This is a violation of Part II,
Section B. 10. of your permit, which states "Any permittee that has not requested renewal at least 180 days prior to
expiration... will subject the permittee to enforcement procedures as provided in NCGS 143-215.6 and 33 USC 1251 et. seq.".
In order to prevent an assessment of civil penalties you must submit a completed permit application (see enclosed forms)
within 10 days of your receipt of this letter. Submit the completed application package to the address listed at the bottom of this
page.
If all wastewater discharge from your facility has ceased and you wish to rescind this permit, contact Bob Sledge of the
Division's Compliance Enforcement Unit at (919) 733-5083, extension 547. You may also contact the Wilmington Regional
Office at (910) 395-3900 to begin the rescission process.

Dear Mr. Quinn:
The Division is beginning the cycle of permit renewals for the Cape Fear river basin. An examination of the Cape
Fear basin plan and the NPDES permit schedule has revealed that the existing expiration dates in Cape Fear NPDES
permits do not coincide with the revised permit expiration dates for the basin. This discrepancy could create unnecessary
delays in the processing of over 200 permit renewals. Accordingly, the Division is changing the permit expiration dates for
NPDES permits in the Cape Fear river basin.
This permit modification changes the expiration date of the subject permit in subbasin 30617 to December 31, 2001.
Please find enclosed the revised permit cover page. Insert the new cover page into your permit and discard the old page.
All other terms and conditions contained in the original permit remain unchanged and in full effect. This permit
modification is issued under the requirements of North Carolina General Statutes 143-215.1 and the Memorandum of
Agreement between North Carolina and the U. S. Environmental Protection Agency.
In accordance with the modification of the permit expiration date, the new due date for your renewal application is
July 4, 2001. Renewal application forms will be sent to you approximately 6-8 weeks in advance of the new due date or
you may download the forms from the NPDES web site at http://h2o.enr.state.nc.us/NPDES/documents.html. You
will need to download Short Form C. If you have already submitted a permit renewal form, there is no need to submit
any other forms to the Division; the application will be processed during the renewal period for your subbasin.
If any part of this permit modification are unacceptable to you, you have the right to an adjudicatory hearing upon
written request within thirty (30) days following receipt of this letter. This request must be a written petition conforming
to Chapter 150B of the North Carolina General Statutes, filed with the Office of Administrative Hearings (6714 Mail
Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
