Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). This final permit contains significant changes from the draft permit sent to you on July 16, 2008. Following public notice of the draft permit, the Division received comments from the U.S. Fish and Wildlife Service (USFWS) and the North Carolina Wildlife Resources Commission (NCWRC) regarding the discharge and its potential effects on water quality in Goose Creek, especially as it pertains to the viability of habitat for the Carolina heelsplitter (Lasmigona decorata), federally designated as a endangered freshwater mussel, and other protected species that are known to be present in Goose Creek. Additionally, during this same time period, the North Carolina Environmental Management Commission had taken unto its consideration rules establishing a water quality management plan for*the Goose Creek watershed. The Division considered the USFWS and NCWRC comments and applied the terms of the Goose Creek rules (15A NCAC 02B .0601 - .0609) before finalizing the content of the permit to be reissued. While the final permit does differ from the original draft, it contains one significant change from the updated draft permit sent to you in a February 25, 2011 e-mail (from John Hennessy, supervisor of the Division's Compliance & Expedited Permitting Unit). In the final permit, language has been added to Section A. (4), the Ammonia Toxicity Reopener condition, that states the permit may also be opened to address matters involving nutrient levels in the Goose Creek watershed. Stream sampling studies have indicated the watershed may experience elevated nutrient concentrations at times. The daily maximum effluent limit for ammonia nitrogen has been reduced to 2.90 mg/L during the summer months (April — October) and to 7.15 mg/L during the winter months (November — March). Please also note that Goose Creek is listed as an impaired waterbody on the North Carolina 303(d) Impaired Waters List. This means that the stream does not meet all water quality standards. Addressing impaired waters is a high priority for the Division, and instream data will continue to be evaluated. If there is noncompliance with permitted effluent limits and stream impairment can be attributed to your facility, then mitigative measures may be required. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. TS.} TREA IT-MENT WORKS+RECLASSIFICATION -- Class II to Class III Upon reaching an average flow (based on a calendar year average) equal to or exceeding 0.280 MGD (80 % of permitted capacity), the Permittee shall: 1) notify the Division in writing; and 2) increase effluent monitoring frequencies to 3/Week according to Section A. (2.). The Permittee shall thereafter maintain compliance required of a Class III facility permitted at 0.670 MGD, unless request is made and granted to modify this permit. A. (4.) PERMIT REOPENER: AMMONIA TOXICITY & NUTRIENTS This permit may be reopened to impose further controls or restrictions upon the discharge of ammonia and other nutrients to the receiving stream. Endangered species in the Goose Creek watershed exhibit a high degree of sensitivity to ammonia. Permit modification may be required in order to ensure viable aquatic habitat with regard to instream ammonia concentrations. Studies conducted within the Goose Creek watershed demonstrate episodic events of elevated concentrations of nutrients (nitrogen and phosphorous). High concentrations of nutrients have the potential create conditions detrimental to overall water quality and the health of aquatic life. Permit modification may be required to include monitoring that will help ascertain the impact of the discharge with respect to instream concentrations of nutrients and to require controls on effluent nutrient concentrations should the discharge be found to be a significant contributor to elevated nutrient levels within the receiving stream. Sent: Thursday, March 17, 2011 3:08 PM To: Sledge, Bob Subject: NPDES Permits for Goose Creek Bob, Thank you for talking with me and answering my questions regarding the NPDES draft permits for Country Woods, Oxford Glen, and Ashe Plantation. Below are the couple of comments I indicated I would send to you. The Technical Support Document (TSD) for the Goose Creek Watershed Site -Specific Management Plan developed by the U.S. Fish and Wildlife Service, N.C. Wildlife Resources Commission, and. N.C. Natural Heritage Program recommends an acute water quality standard of 1.75 mg/L total ammonia as N. The draft permits have daily maximum limits for ammonia of 2.9 mg/L (summer) and 7.15 mg/L (winter). 1 understand these daily maximums are derived from EPA's recent guidance on ammonia, but we are concerned these exceed those recommended in the TSD. I am not sure exactly how the 1.75 mg/L included in the TSD was derived and whether it is temperature dependent, but Tom Augspurger with USFWS probably could provide those details. We recognize there are no water quality standards for copper or nutrients as recommended in the TSD, or for endocrine disrupting compounds (EDC), and therefore will not be included in the permits. However, each of the permits includes a re -opener for ammonia, would it be possible to. include a re -opener clause for copper, nutrients or EDC stating if water quality standards are implemented then the permit can be re -opened and the new standards applied rather than waiting until permit renewal? As I discussed on the phone, the DWQ is preparing to issue NPDES permit renewals for the referenced WWTPs below located in the Goose Creek watershed: NC0063584 Oxford Glen WWTP NC0065684 Country Woods WWTP NC0065749 Ashe Plantation WWTP I apologize if this email is outside the normal process, but I had a couple of "do something even if it's wrong" parents. Seriously, I am new to my present position (Supervisor for the unit charged with processing these permits) and as part of getting up to speed I am trying to identify areas of workload backlog to process and complete. The permit renewals for these facilities fall into that category. At present, the attached permits have been reviewed, submitted for public comment, and the comments received and processed. Ordinarily, we would proceed to finalizing and completing a final permit. However, as you all also aware, Goose Creek is not an ordinary watershed and as such a number of issues have arisen over the past few years that potentially affect our final permit. I offer this up not as excuse as to why the issuance of these permits has been delayed, but rather as an explanation as to where we presently are in the process. It seemed to me that given the amount of time since these projects were last commented on, and trying to process them in the most efficient manner, sending an email with draft permit attached was best. For your convenience, I have attached copies of the draft permits for review. So you know what the Division's plan of action entails, it is our expectation that these permits will be approved by March 31't. I apologize if that seems like a quick turnaround time. However, these permits have been sitting for a significant amount of time and we are trying to get them processed and approved. These criteria are based on EPA's Guidelines for Deriving Numerical Biocriteria National Water Quality Criteria for the Protection of Aquatic Organisms and Their Uses (1985), EPA 822/R-85-100. EPA is publishing these draft criteria in order to receive scientific input from the Human Health public. Microbial (Pathogen) Nutrients What are aquatic life water quality criteria? Sediment Aquatic life water quality criteria are numeric values that protect aquatic life from the harmful effects of pollutants in surface water. Under section 304(a) of the Clean Water Act (CWA), water quality criteria are based solely on data and scientific judgments about the relationship between pollutant concentrations and environmental and human health effects; economic or social impacts do not influence criteria recommendations. EPA's national recommended water quality criteria provide guidance to states, territories and authorized tribes in adopting water quality criteria that meet the requirements of the CWA. They are not regulations themselves and do not impose legally binding requirements on EPA, states, territories, authorized tribes or the public. How were these water quality criteria for ammonia derived? EPA derived these aquatic life water quality criteria for ammonia based on the Agency's 1985 Aquatic Life Criteria Guidelines. These guidelines provide consistent, scientifically -based procedures for deriving ambient water quality criteria for the protection of aquatic organisms and their uses. Toxicity data and other information on the effects of ammonia were obtained from reliable sources and subjected to both internal and external peer review. The draft criteria update incorporates all toxicity data available since the last criteria update including new data on larval and juvenile freshwater mussels to reflect the latest science. What are the draft aquatic life water quality criteria for ammonia? Freshwater: Freshwater aquatic organisms and their uses should not be affected unacceptably if - 1. The one -hour average concentration of total ammonia nitrogen (in mg N/L) does not exceed, more than once every three years on the average, the CMC (acute criterion), which is dependent on the aquatic organisms present. 2A. The thirty -day average concentration of total ammonia nitrogen (in mg N/L) does not exceed, more than once every three years on the average, the CCC (chronic criterion), which is dependent on the aquatic organisms present. 2113. In addition, the highest four -day average within the 30-day period should not exceed 2.5 times the CCC. The acute and chronic criteria concentrations are expressed as functions of temperature and pH, such that values differ across sites, and differ over time within a site. See draft criteria document (pp. 34-38) for actual equations describing this function. Chronic Criteria: At pH=8, where freshwater mussels are present, irrespective of whether fish ELS are present or absent, the criterion ranges from 0.186 mg N/L at 300 C to 0.817 mg N/L at 0° C. When freshwater mussels are absent, the values range from 1.33 mg N/L at 300 C to 2.32 mg N/L at 0° C at times when fish ELS are present, and from 1.33 mg N/L at 300 C to 5.87 mg N/L at 0° C at times when fish ELS are absent. Maintenance and recovery of the water quality conditions required to sustain and recover the federally -listed endangered species thereby protects the biological integrity of the waters. The Goose Creek watershed, which includes Goose Creek (Index # 13-17-18), Stevens Creek (Index # 13-17-18-1), Paddle Branch (Index # 13-17-18-2), Duck Creek (Index # 13-17-18-3) and all tributaries, shall be protected by the site -specific management strategy described in Rules .0601 through .0609 of this Section. The purpose of the actions required by this site -specific management strategy is for the maintenance and recovery of the water quality conditions required to sustain and recover the federally endangered Carolina heelsplitter (Lasmigona decorata) species. Management of the streamside zones to stabilize streambanks and prevent sedimentation are critical measures to restore water quality to sustain and enable recovery of the federally endangered Carolina heelsplitter. Bryant, Piedmont Region Coordinator �. p Habitat Conservation Program °l DATE: 14 August 2008 SUBJECT: Draft National Pollutant Discharge Elimination System (NPDES) Permit Renewal for Country Woods Wastewater Treatment Plant (W WTP), Goose Creek, Union County, NPDES Permit No. NC0065684 Biologists with the North Carolina Wildlife Resources Commission have reviewed the public notice concerning re -issuance of the referenced NPDES permit. Our comments are provided in accordance with provisions of the Clean Water Act of 1977 (as amended), Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d), North Carolina General Statutes (G.S. 113-131 et seq.), and North Carolina Administrative Code 15A NCAC 10I.0102. Aqua North Carolina, Inc. has applied for a renewal of its NPDES permit to discharge treated wastewater into Goose Creek. The Public Notice indicates BOD5, ammonia, fecal coliform and total residual chlorine are water quality limited. There are records for the federal and state endangered Carolina heelsplitter (Lasmigona decorata) and the federal species of concern and state endangered Carolina creekshell (Villosa vaughaniana) and Atlantic pigtoe (Fusconaia mason) in Goose Creek. Portions of Goose Creek are federally designated critical habitat for the Carolina heelsplitter. In addition, Goose Creek is on the 303(d) list of impaired waters. Due to the presence of the Carolina heelsplitter, a Site Specific Water Quality Management Plan is being developed for Goose Creek and Duck Creek under provisions of the North Carolina Procedures for Assignment of Water Quality Standards (15A NCAC 2B .0100) section .0110 Considerations for Federally -listed Threatened or Endangered Species. The U.S. Fish and Wildlife Service, N.C. Wildlife Resources Commission, and N.C. Natural Heritage Program developed a Technical Support Document for this Site -Specific Management Plan. The Technical Support Document details the water quality concerns and provides recommendations for addressing these concerns to protect aquatic resources, particularly listed species, in the Goose Creek watershed. More specifically, water quality standards for ammonia, copper, nitrate -nitrite and phosphorus and revisiting point source permit loads are of particular concern. (9191707-007R Page 2 14 August 2008 Country Woods WWTP NPDES Permit NCO065684 Therefore, we recommend the following conditions be incorporated into the permit to reduce impacts to aquatic and terrestrial wildlife resources and in particular to listed species. 1. If the WWTP uses chlorine disinfection, the disinfection system should be replaced with an ultraviolet light or ozone system. In addition, there should be a permit condition that excludes Lny use of chlorine and possession of chlorine at the WWTP even for emergency wastewater discharge treatment or fecal coliform limit compliance. However, if chlorine is permitted for emergency wastewater discharge treatment, then when chlorine is used, the facility should report these instances and appropriate sampling regimes taken of the wastewater discharge to document full compliance of the facility with the permit limits for total residual chlorine and de -chlorination chemicals. Chlorine is acutely toxic to aquatic organisms and can form secondary compounds that are detrimental to aquatic life. Valenti (2006) concluded the impact of long term exposure to low doses of chlorine may impact juvenile mussels and reduce the chance of them being recruited to the reproducing population. 2. An acute water quality standard of 1.75 mg/l total ammonia as N and chronic standard of 0.50 mg/l (based on the 90th percentile pH of 8 for Goose Creek). 3. An acute water quality standard of 3.6 ug/1 copper and chronic standard of 2.2 ug/1. 4. Nutrient targets of 0.4 mg/1 for nitrate -nitrite and a 0.1 mg/1 for total phosphorus. While nitrate and phosphorus are not as important from a toxicity standpoint as ammonia, these are related to excessive nutrient loading, nuisance algal blooms and dissolved oxygen depletion. 5. Portions of Goose Creek do not have flow for significant periods, particularly during recent and ongoing droughts, and the dilution potential at these times is non-existent. Therefore, the low flow statistics used to establish the extent of expected dilution should be revised during permit issuance. Permit limits should reflect this lack of dilution during all low flow conditions. If necessary, limits should be effective at the "end of pipe" to protect aquatic species and habitats for listed species. 6. Evaluate alternatives to a surface wastewater discharge while retaining the water in the Goose Creek system (e.g., land application). Although connecting to sanitary sewer service is an alternative, this would remove the water from the system and reduced base flows in Goose Creek are having a significant adverse affect on the Carolina heelsplitter and its host species. 7. Recent studies have shown that endocrine disrupting chemicals (EDC) in treated wastewater can inhibit reproduction and cause feminization of mussels and fish. We recommend studies be conducted to document the levels of EDCs in this wastewater discharge through NPDES permit and N.C. Division of Water Quality ambient studies. Should either monitoring or studies document the presence of EDCs at levels that can affect aquatic species, treatment train measures should be implemented without delay to reduce or eliminate EDCs from wastewater prior to discharge. State University has been studying the effects of these compounds in wastewater discharges on aquatic species and may be contacted to discuss past studies and study designs.
