(formerly Heater Utilities, Inc.) has agreed that the two (2) banks of ultraviolet disinfection units will be kept in operation at all times. Therefore, in the event of any failure in one bank, the second bank will already be on line and will not need the use of the originally proposed, automatic switching equipment to bring the second unit on line. This matter was discussed with Mr. Sergei Chemikov (NC DENR) and Ms. Donna Hood (NC DENR) on August 9, 2006 and it was agreed that, with this operational modification, and the existing back-up chlorine disinfection system, the automatic switching system is not needed for the UV system to be in substantial conformity with the approved plans and specifications. Authorization is hereby granted for construction of ultraviolet disinfection system at the Country Woods East Subdivision WWTP. Specifically, this ATC allows: • Installation of two 980,000 gpd ultraviolet disinfection units • Installation of an autodialer and audible/visual alarm to notify the operator of power failures • Installation of a two new effluent pumps • Installation of an automatic control system that will automatically switch to the second bank in the event of any failure or malfunction in the lead bank Once construction under this ATC has been completed and an Engineer's Certificate has been submitted, the permittee is authorized to operate the units listed above, with permitted limits as specified in the NPDES permit issued November 14, 1994. The permit issued in 2001 has been adjudicated and currently unresolved. The Division of Water Quality approves this project in terms of compliance with NPDES limits; we defer to Heater Utilities and their consultants for approval of distribution system, adequate mechanical design, structural integrity, etc. of the entire disinfection treatment system. Heater Utilities must install the third 980,000 gpd UV unit prior to bringing either of the remaining two 160,000 gpd (each) treatment trains online. This Authorization to Construct is issued in accordance with NPDES Permit No. NCO065684 issued November 14,1994, and shall be subject to revocation unless the treatment system is constructed in accordance with the conditions and limitations specified in the permit. The sludge generated from these treatment facilities must be disposed of in accordance with G.S. 143-215.1 and in a manner approved by the North Carolina Division of Water Quality. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement wastewater treatment or disposal facilities. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. Upon classification of the facility by the Certification Commission, the Permittee shall employ a certified water pollution control treatment system operator to be in responsible charge (ORC) of the water pollution control treatment system. The operator must hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the water pollution control treatment system by the Certification Commission. The Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with the conditions of Title 15A, Chapter 8G, .0202. The ORC of the facility must visit each Class I facility at least weekly and each Class II, III, and IV facility at least daily, excluding weekends and holidays, and must properly manage and document daily operation and maintenance of the facility and must comply with all other conditions outlined in Title 15A, Chapter 8G, .0204. Once the facility is classified, the Permittee must submit a letter to the Certification Commission which designates the operator in responsible charge within: (A) Sixty calendar days prior to wastewater being introduced into a new system or (B) within 120 calendar days of the following, (i) after receiving notification of a change in the classification of the system requiring the designation of a new ORC and back-up ORC or (ii) a vacancy in the position of ORC or back-up ORC. A copy of the approved plans and specifications shall be maintained on file by the Permittee for the life of the facility. The Operational Agreement between the Permittee and the Environmental Management Commission is incorporated herein by reference and is a condition of this Permit. Noncompliance with the terms of the Operational Agreement shall subject the Permittee to all sanctions provided by G. S. 143-215.6 for violation of or failure to act in accordance with the terms and conditions of this Permit. Failure to abide by the requirements contained in this Authorization to Construct may subject the Permittee to an enforcement action by the Division of Water Quality in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. The issuance of this Authorization to Construct does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with the NPDES Permit, this Authorization to Construct and the approved plans and specifications. It causes great confusion but she usually does forward me messages (sometimes a bit later), so I did finally receive it. Good question - what is the status on this. I thought it was on hold as they were still trying to decide what to do. Are they set on trying to still do the UV system in phases as specified in your letter dated 10/ 16/03? I will proceed forward if that is still the case (I know there has been much confusion over this because the last thing I forwarded down to Mooresville they decided to change). So, give me the word on what final version I am to look at (and if the one with your letter dated 10/ 16/03 is the correct version) and I'll try and get to it within the next couple of weeks if not sooner. This version discusses doing the UV system in phases (and what is to be put in now would be based on the current flow - not final design flow). Please accept this as a revision to the request for ATC for these revised design facilities. This request does not substantially alter the design as submitted, other than to embody the option to phase the installation of the UV disinfection units to correspond with the phased utilization of the existing individual package wastewater treatment plants (WWTPs.) Heater is currently utilizing all of the old portion of the treatment facilities (This being the older package systems that combine to make a 190,000 gpd system) and one of the three (3) newer treatment trains which are designed for 160,000 gpd each. This brings the current treatment capacity that is in active use to a total capacity of 000 gp Eventually, when the remaining two (2) 160,000 gpd trains are brought on line, the total p capacity of 670,000 gpd will be reached. At that time, all three (3) UV disinfection units of the design submitted will be required to meet the state requirements. The design submitted specifies the installation of three l,3) Trojan Model TJ 3700K-PTP - isinfecrion units which are each rated for a flow of 980,000 gpd. The design is or t e units to be Installed in series. With any one UV unit out of service, the remaining two (2) units have the combined capacity to disinfect a flow of 1,960,000 gpd which is well in excess of the state required peak design now (2.5 x 670,000 average daily flow = 1,675,000 gpd.) Whereas, the treatment capacity currently being utilized is only 350,000 gpd, the required disinfection capacity can be achieved at this stage with only two (2) of the proposed units. With one of the two (2) units out of service, the remaining disinfection unit will have the capacity to disinfect a flow of 980,000 gpd which is well in excess of the state required peak design flow (2.5 x 350,000 average daily flow = 875,000 gpd-) Therefore, Heater wishes to amend the submitted request to allow for a phased installation of the proposed UV disinfection system. The first phase will be to install the first two (2) UV disinfection units (UV Bank IA and UV Bank 1B as shown on sheets 3 and 4 of the plans. All other elements of the design will remain unchanged with the exception of the natural shifting of the UV outlet chamber and effluent piping to accommodate the installation of two (2) rather than three (3) units. The second phase of installation of the UV units will occur prior to utilization of any of the additional treatment trains. In short, prior to bringing either of the remaining two (2), 160,000 gpd (each) treatment trains on line, Heater will be required to install the third UV unit. At this point, with the installation of the third UV unit, Heater will have adequate disinfection for the total facility design and permitted flow (670,000 gpd.) Please note that the system will have an auto dialer to alert the operator in case of any emergency condition and the system will automatically switch to the second or lag bank in the event of any failure or malfunction in the lead bank.
