Dear Mr. Turpin:
The Division of Water Quality (DWQ or the Division) hereby issues this permit pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the
U.S. Environmental Protection Agency dated October 10, 2007, or as subsequently amended.
Please note that DWQ has included new monitoring requirements and permit limits for new Outfall 002 (stormwater
runoff) and Outfall 003 (RO reject water). You must monitor these separately from your existing W WTP effluent
(Outfall 001). The permit provides you with a compliance grace period to establish Outfall 003 (RO). Compliance
will begin one (1) year from the permit effective date.
If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable, you
have the right to an adjudicatory hearing upon written request within thirty (30) days after receiving this letter.
Your request must take the form of a written petition conforming to Chapter 150B of the North Carolina General
Statutes, and must be filed with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North
Carolina 27699-6714. Unless such demand is made, this permit remains final and binding.
This permit is not transferable except after notifying the Division of Water Quality. The Division may modify and
re -issue, or revoke this permit. Please notice that this permit does not affect your legal obligation to obtain other
permits required by the Division of Water Quality, the Division of Land Resources, the Coastal Area Management
Act, or other federal or local governments.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the
permit conditions, requirements, terms, and provisions included herein.
The Worsley Operating Company
is hereby authorized to:
1. continue to operate an existing 0.004 MGD wastewater treatment facility consisting of

located west of Wilmington on U.S. Highway 421 at the Scotchman #303 [Truck Stop] WWTP in
New Hanover County, and
2. begin to operate a stormwater pump and force main with oil /water separator, and
3. begin to operate a reverse -osmosis (RO) potable -water treatment system and generate RO
wastewater from the treatment of local well water, and
4. discharge from said wastewater treatment facility (Outfall 001); discharge from said stormwater
disposal system (Outfall 002); and discharge from said RO potable water -treatment system (Outfall
003), at the locations specified on the attached map, into the Northeast Cape Fear River, a
waterbody classified SC -Swamp waters within the Cape Fear River Basin.

1. The Permittee shall sample Total Residual Chlorine (TRC) only if chlorine is used to disinfect. Because of difficulties
quantifying TRC in a wastewater matrix, the Division will consider values below 50 µg/L to be compliant with this
permit. However, the Permittee shall continue to submit all values reported by North Carolina -certified laboratory
methods, even if these values fall below 50 µg/L.
2. Dissolved oxygen daily average effluent concentration shall fall below 5.0 mg/L.
The Permittee shall discharge no floating solids or foam visible in other than trace amounts.

A. (4.) PERMIT RE -OPENER: TMDL IMPLEMENTATION
The Division may, upon written notification to the permittee, re -open this permit in order to
incorporate or modify effluent limitations, monitoring and reporting requirements, and other
permit conditions when it deems such action is necessary to implement a parameter -specific
Total Maximum Daily Load (TMDL) approved by the USEPA.

A. (5.) ACUTE TOXICITY (QUARTERLY) -- MONITORING ONLY
The Permittee shall conduct acute toxicity tests on a quarterly basis using protocols defined in the
North Carolina Procedure Document entitled "Pass/Fail Methodology for Determining Acute Toxicity
in a Single Effluent Concentration" (Revised -July, 1992 or subsequent versions). The monitoring shall
be performed as a Fathead Minnow (Pimephales promelas) 24 hour static test. The effluent
concentration at which there may be at no time significant acute mortality is 90% (defined as treatment
two in the procedure document). Effluent samples for self -monitoring purposes must be obtained
during representative effluent discharge below all waste treatment. The tests will be performed during
the months of January, April, July, and October.
The parameter code for Pimephales promelas is TGE6C. All toxicity testing results required as part
of this permit condition will be entered on the Effluent Discharge Form (MR-1) for the month in which
it was performed, using the appropriate parameter code. Additionally, DWQ Form AT-2 (original) is to
be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no
later than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual
chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for
disinfection of the waste stream.
Should there be no discharge of flow from the facility during any month, the Permittee will complete
the information located at the top of the aquatic toxicity (AT) test form indicating the facility name,
permit number, pipe number, county, and the month/year of the report with the notation of "No Flow"
in the comment area of the form. The report shall be submitted to the Environmental Sciences Section
at the address cited above.
Should any test data from either these monitoring requirements or tests performed by the North
Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may
be re -opened and modified to include alternate monitoring requirements or limits.
If the Permittee monitors any pollutant more frequently than required by this permit, the results of such
monitoring shall be included in the calculation & reporting of the data submitted on the DMR & all AT
Form submitted.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival and appropriate environmental controls, shall constitute an invalid test and will
require immediate follow-up testing to be completed no later than the last day of the month following
the month of the initial monitoring.

16Jun09 --UPDATE - Karen Rust (NPDES) said she would answer an email from the WiRO about
status. Apparently, the NPDES Unit received and logged into BIMS the Permittee's request to add RO
(WTP Application received 14Ju108), but in the absence of a cover letter and a check, logged it in as a
"permit renewal" [which does NOT require a fee]. The Permittee intended this application NOT as
renewal, but a MOD to the existing permit (MOD would add RO at a new Outfall of their existing
permit), but the Permittee included no cover letter to explain. Unfortunately, RO is a major MOD to a
minor industry permit and therefore requires a fee of $260. To re -log this correctly into BIMS, we must
have a letter and a check for $260 from the Permittee.

28Sep09 -- Received signed copy of Engineer's Certification Form (for fast -track Dechlor ATC
65307A01, CG&L- 29May09).
210ct09 -- Still no check for $260 - still logged in BIMS as a "renewal" not a MOD; Joe called Maureen
Jackson (Environmental Manager and Corporate Secretary, Worsley Operating Corporation) and asked
for status on her check required for the MOD - left message 13:15 hrs.
230ct09 -- corresponded with Maureen Jackson via email - she will send a letter and check 1 st of next
week. She says she has an ATC Application in progress; I told her we need to MOD the permit first.
Received check for $260 - Joe to proceed with the MOD.
02Nov09 -- Joe discussed this project in Staff Meeting; may not discharge RO to onsite WWTP; likely
need a separate outfall for RO discharge; Joe to consult Julie's recent WTP Policy revision.
08Jan10 -- Joe discussed MOD with Julie Grzyb (NPDES) considering RO @—700-1300 gpd (see WTP
Policy, Table 2.1); generated draft docs including update of Outfall 001 (WWTP) and creating Outfall
002 (RO discharge).
10Mar2010 -- After additional review and correspondence with Linda Willis (WiRO) and Julie
(NPDES), Joe redrafted the permit change pages to include 2 new Outfalls (002 Stormwater w/
Oil/Water Separator), and 003 (RO reject water), considering the new policy for RO. Joe sent email
to Kelley Johnson (910-796-7345; WiRO/ Stormwater) asking for rationale for NOT mixing the
wastewaters; cc Jeff, Julie, Linda, Bradley Bennett.
07Apr2010 -- Jeff asked about status - no new input from WiRO or CO Stormwater; Jeff suggested we
proceed as is. Joe generated draft documents and submitted to Julie G. (NPDES) for peer review of RO
outfall.
13Apr2010 — Julie returned file to Joe with minor corrections; recommends adding NH3 as N to the
permit for RO. Joe made corrections; submitted docs to Dina for Public Notice on 14Apr2010.

saying you want to modiN your existing permit. Include a summary of the changes anticipated, for example "... intend
to add a potable water treatment system using Reverse Osmosis (RO) technology."
The $260 fee is required for a "major" modification to a "minor industry" permit -no form necessary, see our website.
You must modify your permit with us in advance of your ATC request to Construction Grants and Loans.

Linda - for reasons unknown to anyone, the Permittee submitted a permit renewal application back in
April 2008. '
No one was assigned the renewal; I just found out about it today.
Our acknowledgement letter asked for a sludge management plan. The permittee sent us a response
stating that no such plan was required as they "will be discharging backwash water from the site's reverse
osmosis system into the stormwater system."
The existing NPDES permit for that facility has no limits or monitoring related to any water treatment
system. If Worsley is operating an RO system with any reject discharged, it cannot be covered under any
stormwater permit.
There are 6 different facility records in BIMS that cover the site. There are 4 State Stormwater permits,
our NPDES permit and a pump & haul permit; all have their own facility record. I will fix the duplicate
facilities tomorrow.
When will someone from the WiRO next be visiting / inspecting this site? We will work the problem
from this end, but we'll need eyes on the system to help us proceed.
